Be prepared to apply for approvals well in advance of commencing any exterior work. Before making any changes to the exterior of a property in an historic district,the owner should call or visit the Commission representative at the Department of Planning&Community Development to discuss proposed alterations and to determine the category of the application(Appropriateness,Non-Applicability or Hardship). B. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City Hall. The meetings are held at 120 Washington Street,3rd floor,and begin at 7:00 p.m. All meetings are open to the public and any person is entitled to appear and be heard on any matter before the Commission before it reaches a decision. C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in order to make the agenda An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the meeting. In some cases,a Certificate of Non-Applicabil ity maybe issued by the Clerk,without review by the full Commission,after notifying Commission members and allowing 24 hours for any objection. There is no fee for any applications. D. All applications for Certificates of Appropriateness or Hardship require a public hearing. Notice of the hearing must be posted with the City Clerk 14 days before the hearing and abutters must be notified in writing. Commission staff will handle these procedures. A public hearing is not required for a Certificate of Non-Applicability. E. Applications must be submitted by the owner of the property. A contractor for the owner,at the owner's request,may submit an application on the owner's behalf In case of a tenant,a waiver of the owner's appearance may be granted at the discretion of the Commission if it is requested by the owner. F. All applications must include photos of existing conditions,taken from all public ways. No certificates can be issued until receipt of photos. G. An application will not be considered complete unless all work items are thoroughly described on scaled drawings and include specifications regarding dimensions, materials, and any other information needed for the Commission to visualize the changes in order to make a determination. Applications for paint colors should include a paint chip or chart. The following items should be included in your drawings as applicable(exhibits should be 8'/,x I 1 or be able to be folded to 8'h x 11): 1. Site plan showing location of improvements; 2. Elevation drawings of the specific improvements; 3. DetaiWprofiles(i.e.moldings,fence caps,cornices,vents,etc.); 4. Materials(i.e,wood,brick,etc.); S. Dimensions(i.e.size of trim);and 6. Transformers,heat pump and condenser locations,electrical entries and meters,lamp posts,stove pipes. H. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners having professional consultants such as architects or contractors are urged to have them be presentat the hearing. Ifthe application is approved, a Certificate will be mailed to the mailing address provided on the application and copies will be sent to the City Clerk and Building Inspector. Please note that the application can be continued until the next meeting if the Commission deems necessary(i.e.for reasons of incomplete drawings,to perform a site visit,etc.). In any case,the Commission must make a determination within 60 days from the date the application is received,unless the applicant waives that requirement in writing. 1. A property owner or a contractor cannot receive a building permit unless a Certificate has been issued. Please be sure to obtain appropriate permits from the Inspector of Buildings(or other necessary permits and approvals)prior to commencing work. J. My neighbors at#49 noticed water damage in the ceiling of their second floor den. This led to a roofer inspecting the roof and discovering that the leak was coming from around the rear chimney of the building. This led to the mason. As it turns out, this is the only chimney of four on the building that has not been replaced since the home was build in 1834. The mason noted that the chimney was leaning toward our neighbor's building at#51. He believed it was dangerous to leave it standing as it was as it was at high risk for tipping over. He also noted that the chimney was in too bad a condition for a simple flashing repair. He believed it could be dismantled, brick by brick, to the roof line, and re-built strong and true. Permits were pulled and Historic Commission permission was gained for an in-kind removal and replacement. Scaffolding was erected, and over several days the chimney was removed. When the mason reached the roof line, he discovered that the base of the chimney, at least 5-6 feet in to the building, and possibly more, was crumbling, and was not a sufficient base to reconstruct the chimney. To complete the repair, 6 additional feet of the chimney, inside the building, would have to be removed and re-built, at an additional cost of approximately $5000.00. To do this work would require the opening of two ceilings and two walls on two floors of my neighbor's home. The cost of this demolition and repair of the walls and ceiling has not yet been determined. It would also require workmen to be in their home on a daily basis for approximately two weeks. Total cost for the project will be approximately $17,000. As this was going to require a major life inconvenience for my elderly, nearly home bound neighbors, and a potentially very high impact on their health,the decision to proceed could not be made. The roof was repaired, restoring its weather tight status, without the reconstruction of the chimney. The additional cost of this repair is our first hardship. We are a condominium association of two units. My neighbors are long retired, on a fixed income, and have lived in this home since 1964. When I joined the neighborhood in 2006, the condominium association reserve fund was $0.00. We have worked diligently to grow our reserve to be able to handle major repairs such as this, but we are not quite there yet. We are also faced with a major repair need to the street end of the house as water is finding its way in through gaps and cracks. My neighbors can not afford a "special assessment" for such repairs, and I can not support the cost of the repair by myself. The second, and more important hardship, would be to the disruption of my neighbors home and the risk to their health. As I said before, they are elderly, and each have a variety of medical problems. Except for the trips to the pharmacy, to Crosby's for pre- prepared meals, and to church by Ralph, and the occasional trip out by Jeannette for a medical appointment, they are always home. This chimney is in the heart of their living area and would impact their bedrooms, living area and bathroom. I worry about their increase risk for falling. I also worry about the inevitable decrease in air quality this kind of repair would cause and fear it would gravely effect their health. I am asking that you grant us a hardship exemption from replacing this chimney. Currently, for the reasons outlined above, it is not feasible for us to do. However, I would like to retain the permission of the Commission to replace it, for form and function, when the living situation of #49 changes and would allow for the work to be done. The applicants take exquisite care of their property and keep it in strict conformity with the requirements of the historic district in which their property is located. The chimney whose elimination has been requested is not at all visible from the street or from any rooms in our house. Thus to require the applicants to rebuild that chimney would be to impose enormous cost on the owners of the property without any benefit to those, like myself and my wife, who enjoy the traditionalism of the historic district in which the subject property is located. We also wish to call to the commission's attention that there are two chimneys visible from the street on either end of the roof of the subject property, so to all appearances the historic appearance of the property is fully preserved and intact.
