Be prepared to apply for approvals well in advance of commencing any exterior work. Before making any changes to the exterior of a property in an historic district,the owner should call or visit the Commission representative at the Department of Planning&Community Development to discuss proposed alterations and to determine the category of the application(Appropriateness,Non-Applicability or Hardship). B. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City Hall. The meetings are held at 120 Washington Street,3rd floor,and begin at 7:00 p.m. All meetings are open to the public and any person is entitled to appear and be heard on any matter before the Commission before it reaches a decision. C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the.Monday 16 days before the meeting in order to make the agenda. An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the meeting. In some cases,a Certificate of Non-Applicability maybe issued by the Clerk,without review by the full Commission,after notifying Commission members and allowing 24 hours for any objection. There is no fee for any applications. D. All applications for Certificates of Appropriateness or Hardship require a public hearing. Notice of the hearing must be posted with the City Clerk 14 days before the]tearing and abutters must be notified in writing. Commission staff will handle these procedures. A public hearing is not required for a Certificate of Non-Applicability. E. Applications must be submitted by the owner of the property. A contractor for the owner,at the owner's request,may submit an application on the owner's behalf. In case of a tenant,a waiver of the owner's appearance maybe granted at the discretion of the Commission if it is requested by the owner. F. All applications must include photos of existing conditions,taken from all public ways. No certificates can be issued until receipt of photos. G. An application will not be considered complete unless all work items are thoroughly described on scaled drawings and include specifications regarding dimensions, materials, and any other information needed for the Commission to visualize the changes in order to make a determination. Applications for paint colors should include a paint chip or chart. The following items should be included in your drawings as applicable(exhibits should be 8'/.x I1 or be able to be folded to 8'/z x 11): I. Site plan showing location of improvements; 2. Elevation drawings of the specific improvements; 3. Details/profiles(i.e.moldings,fence caps,cornices,vents,etc.); 4. Materials(i.e.wood,brick,etc.); 5. Dimensions(i.e.size of trim);and 6. Transformers,heat pump and condenser locations,electrical entries and meters,lamp posts,stove pipes. H. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners having professional consultants such as architects or contractors are urged to have them be present at the hearing. If the application is approved, a Certificate will be mailed to the mailing address provided on the application and copies will be sent to the City Clerk and Building Inspector. Please note that the application can be continued until the next meeting if the Commission deems necessary(i.e.for reasons of incomplete drawings,to perform a site visit,etc.). In any case,the Commission must make a determination within 60 days from the date the application is received,unless the applicant waives that requirement in writing. I. A property owner or a contractor cannot receive a building permit unless a Certificate has been issued. Please be sure to obtain appropriate permits from the Inspector of Buildings(or other necessary permits and approvals)prior to commencing work. J. The homeowner may opt not to commence the work approved(unless it relates to resolving an outstanding violation). Work commenced must be completed within one year from the Certificate date unless otherwise indicated. K. The City of Salem reserves the right to inspect the project to determine compliance with the conditions set forth in the Certificate issued. Violations A person commencing or completing work to the exterior of a building in an historic district without the necessary approval of the Commission is subject to fines of up to 5500 per day from the date of violation. The Commission is not responsible for an owner's neglect to inquire about necessary City permits and approvals. All records are public and we will confidentially assist you if you are concerned that someone in your neighborhood is in violation. The guidelines provide examples of what is historically appropriate (or inappropriate) for Salem's neighborhoods including trim, siding, barrier free access, doors, fences, gutters/downspouts, masonry, mechanical equipment,paint colors.parking solutions,porches/steps,roofing,satellite dishes&solar energy systems,secondary egress,skylights,utilities,windows, etc. These guidelines help you understand what changes are likely or unlikely to be approved. Your notice specified that I committed a violation due to my rebuilt deck being larger than the previous structure; however your certificate of non- applicability permitted both reconstruction and alteration of design and it did not specify any size requirements and explicitly stated it was not visible from the street. Your agency approved my design and a permit was granted, and my current deck is exactly as specified in the submitted and approved plans. I am very surprised and confused at your agency's sudden request for me to resubmit an application and, since the deck was built exactly as specified in my application submitted in July 2015,I see no need to resubmit a new application. I have enclosed a copy of the original application and photographs of the completed deck for your review. I understand a neighbor complained about my deck and said it was visible from the street in February; however, as the photos submitted with my original application and the SHC drive-by in July will show, it was not visible in July. It is only somewhat visible now due to the lilac hedge being pruned back and having lost its leaves. Let me say that I greatly value the role of the SHC and I live in this historic neighborhood and wish to maintain the character of the neighborhood. I do realize that the SHC is instrumental in preserving our quality of life through preserving quality of design. However, I have followed all the proper procedures and in this case I feel your assertion that I committed a"violation" is misguided. I have detailed my response to your notice below: 1. I followed the Salem Historical Commission and Building Department guidelines and submitted an application to the SHC and the Building Department in July 2015 to restore/rebuild my rotted back deck. My application was approved with a certificate of non-applicability issued, a building permit was issued, and the project is now complete and inspected by the building department. 2. The certificate issued to me by SHC specifically stated, "The work will not be visible from the public way." This certificate was based on photographs taken in July by me from Flint Street submitted with my application and a viewing of the property by a member of the SHC. Emails to me from SHC staff confirm this (attached). The certificate gave me permission for both reconstruction and alteration. Based upon SHC approval of my plans, a building permit was issued and the work is now complete, save for some painting to be done in the spring. 3. The plans submitted to the SHC and building department were followed exactly. The dimensions of the current deck (18' x 7') are exactly those noted on the original application and the height of the railings is what is required by code. The dimensions of the current deck are larger than the previous deck; however the deck is now historically more accurate due to the permitted alteration and reconstruction(see points 5 & 6 below). The certificate you issued specified reconstruction and alteration, so I believe that no violation was committed. Therefore I think no new application is warranted, as it would be an exact duplicate of the original. 4. As you may not be aware, my neighbor Bruce McDonald (the individual instigating this situation) has stated to me that he has no real objection to my deck; having spoken to him about this, he explained that due to his own bad experiences with the SHC over a fence, he wanted to make sure"everyone else (ie, me) follows the process." I have already explained to him via email that I followed the process and provided him with the certificate issued by the SHC stating non-applicability. I feel that due to his anger at the SHC he is trying to draw me into a dispute where none should exist. 5. With respect to the deck dimensions,the deck I have reconstructed(18'x 7) is exactly the same size as the deck original to the building when constructed in 1910. 1 know this because each of the 3 townhouses was built with an identical back deck with a supporting concrete pad underneath which is the size of the supported deck. I measured the remaining original deck at unit 35 and its concrete pad (the same size as the deck above)to confirm my current deck design. There was a mirror image deck behind unit 31 before they removed it and built a sunroom. The concrete pad supporting my deck from 1910 confirms the size of my deck at 18 x 7 feet. There are old, rusty, lag bolts sticking out of the brick wall of my townhouse to a length of 18 feet along the old concrete pad to which the original deck was attached, again confirming the original size. All of this evidence confirms that I did not exceed the original deck design for the building. 6. The SHC may not be aware, (perhaps there is a record in the building department), that my deck was reduced in size by about 70%to a width of about 7 feet in order to accommodate a wheelchair lift of an elderly occupant prior to the condo conversion. This was obvious with saw marks across the remaining floor planks, a crude gate built from pressure-treated wood (not original to 1910) to allow the wheelchair entry to the deck, and the asphalt paving applied on the original brick walkway to allow for the wheelchair. The neighbors confirm this was the reason the deck was reduced in size by prior owners. 7. My project has restored the deck design from 1910, with duplication of the original design elements using mahogany and fir. It is aesthetically an improvement over the ugly,rotted, shortened structure built of cheap 2x4s that was previously there and now matches the other building design elements as originally intended (see attached photographs). 8. With respect to due process,the issue of my deck was apparently brought up by Mr. McDonald at a meeting where my deck design was not on the agenda. The item on the agenda was the appropriateness of chimney caps planned for my condo complex. I don't think it appropriate for the SHC to take on topics such as my deck which were not previously announced and approved for a meeting. It also seems inappropriate for the SHC to somehow"link"approval of the condo chimney caps to a review of my deck design and construction, at said meeting. By allowing an unscheduled item onto your meeting agenda, you gave me no opportunity to present myself to explain this situation and simply allowed Mr. McDonald to express his views and then issue me a violation. I think this issue should have been tabled and I should have received a written notification to attend a meeting of the SHC or at least given the chance to respond to Mr. McDonald's allegations before a violation was issued. 9. In conclusion,the SHC approved my deck re-design plan in July 2015; a representative from the SHC did a drive by and determined my deck was NOT visible from the street and then I was issued a certificate of non-applicability, and I followed the submitted design plans to the letter, and the deck was inspected by the building department and approved. I have followed the proper procedures and I have not committed any violation. 12. 1 respectfully request you withdraw your demand for a new application and dismiss this matter. (CPEM, Inc.) is a private non-profit health care and educational facility which provides programs for children and adults with physical and developmental disabilities as well as their families. I. History of Association The Agency was organized in Peabody on December 7, 1950 by parents and professionals interested in providing services for persons with cerebral palsy. They incorporated on February 16, 1951 as the Cerebral Palsy Council of the North Shore, Inc. The Agency had operated as United Cerebral Palsy Association of the North Shore, Inc. from May 1, 1952 to December 4, 2001. The organization's name was changed on December 21, 2001 to Cerebral Palsy Association of Eastern Massachusetts, Inc. The primary purpose of the Association, as stated in our By-Laws, is to "establish and operate or support evaluation and treatment centers to aid in the rehabilitation, habilitation and education of persons with cerebral palsy and others with similar servicing needs in the mainstream of society . This includes barrier-free family housing, accessible transportation and community-based residential homes". The Board of Directors meets on a monthly basis. 11. Programs The programs sponsored by the Cerebral Palsy Association of Eastern Massachusetts, Inc. are as follows: A. Children's Programs 1 . Early Intervention Services North Shore Infant and Toddler Program (NSITP) CPEM established the North Shore Infant and Toddler Early Intervention Services (NSIT) in 1974. The program has two sites, Lynn and Salem and provides services to approximately 1800 fam lies on the North Shore each year. Early Intervention services are available to el gible children, birth to three years of age, who have or are at risk for developmental disabilities/delays due to established, biological or environmental factors. The NSIT Early Intervention Program provides family centered home based services to facilitate the developmental progress of children. EI staff work in partnership with parents and other caregivers throughout the process of assessment, development of the Individualized Family Service Plan (IFSP) and ATTACHED DOCUMENTATION An application will not be considered complete unless all work items are thoroughly describedand the application includes all information needed for the Commission to make a determination.
