MASSACHUSETTS 01970 August 22, 1991 DECISION Arthur Bell 42 Clifton Heights Lane Marblehead, Ma 01945 Dear Mr. Bell : On July 25, 1991, the Salem Historical Commission sent you a letter which stated that the fence installed at 7 Lynn Street in Salem deviates from the approved Certificate of Appropriateness . As per your conversation with our clerk, you were scheduled first on our next agenda for the meeting of August 7, 1991 . When you failed to appear at that meeting, you were notified by telephone that the issue was continued until the meeting of August 21 , 1991 . Since you also failed to appear at that meeting, the Commission has taken the following action. The Commission unanimously approved a motion that the height of the posts of the fence must be lowered so that the bottom of the cap is roughly 1" above the level of the pickets . The existing square beveled cap and finials (round balls) must be reused but the beading between the cap and finial must be removed. Enclosed please find a sketch which indicates what should be removed. The Commission further approved a motion that this work must be completed prior to its next meeting of September 11, 1991 . The Commission feels that it has attempted to be accomodating to your needs as a homeowner and asks that you cooperate in completing the work outlined in this decision in order to avoid legal enforcement. I will replace the driveway gate, including a three foot section next to the house, and a nine foot section, which will be left in an open position to accomodate daily traffic on the driveway, but which, if ever neccesary, would be capable connecting with the 3 foot section, enclosing the yard. The "permanent' position of this gate will follow the contour of the driveway, approximating 120 degree angle (see drawing).
