PROCEDURES FOR FILING APPLICATIONS
A. Be prepared to apply for approvals well in advance o:commencing any exterior work. Before making any changes to the exterior of a property
in an historic district,the owner should call or visit the Commission representative at the Department of Planning&Community Development
to discuss proposed alterations and to determine the category of the application(Appropriateness,Non-Applicability or Hardship).
B. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City Hall. The meetings are h:ld at
120 Washington Street,3rd Floor,and begin at 7:00 p.m. All meetings are open to the public and any person is entitled to appear and be heard
on any matter before the Commission before it reaches a decision.
C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in
order to make the agenda An application for a Cenifioate of Non-Applicability may normally be added to the agenda up to the day of the
meeting. In some cases,a Certificate ofNon-Applicability may be issued by the Clerk,without review by the full Commission,after notifying
Commission members and allowing 24 hours for any objection. There is no fee for any applications.
D. All applications for Certificates of Appropriateness or Hardship require a public hearing. Notice of the hearing must be posted with the City
Clerk 14 days before the hearing and abutters must be notified in writing. Commission staff will handle these procedures. A public hearing is
not required for a Certificate of Non-Applicability.
E. Applications most be submitted by the ownerof the property. A contractor forthe owner,at:he owner's request,may submit an application on
the owner's behalf. In case of a tenant,a waiver of the owner's appearance maybe granted at the discretion of the Commission if it is requested
by the owner.
F. All applications must include photos of existing conditions,taken from all public ways. No certificates can be issued until receipt of photos.
G. An application will not be considered complete unless all work items are thoroughly described on scaled drawings and include specifications
regarding dimensions, materials, and any other information needed for the Commission to visualize the changes in order to make a
determination. Applications for paint colors should include a paint chip or chart. The following items should be included in your drawings as
applicable(exhibits should be 8'/2 x I 1 or be able to be folded to 8%2 x 11):
I. Site plan showing location of improvements;
2. Elevation drawings of the specific improvements;
3. Details/profiles(i.e.moldings,fence caps,comites,vents,etc.);
4. Materials(i.e.wood,brick,etc.);
5. Dimensions(i.e.size of trim);and
6. Transformers,heat pump and condenser locations,electrical entries and meters,Imp posts,stove pipes.
H. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners
having professional consultants such as architects or contractors are urged to have them be present at the hearing. If the application is approved,
a Certificate will be mailed to the mailing address provided on the application and copies will be sent to the City Clerk and Building Inspe_tor.
Please note that the application can be continued until the next meeting if the Commission deems necessary(i.e. for reasons of incomplete
drawings,to perform a site visit,etc.). In any case,the Commission must make a determination within 60 days from the date the application is
received unless the applicant waives that requiremert in writing.

Instead of increasing the height of the railing by adding two horizontal rails and repairing the original railing, it
is proposed to replace the railing as follows:
1. Replace the original 20"high, 1-3/8"balusters with new 28"high, 1-5/8"balusters of similar design.
Proposed baluster is Dixie-Pacific"Colonial/2"x28"520228CL". Catalogue sheet and 24"sample submitted.
(Turned length on 24" sample is the same as the 28"baluster,square ends are each 2"longer on 28"baluster.)
2. Replace the top and bottom rails with new rails milled to match the original,unpainted profiles of the existing
rails.
NOTES:
A. New spacing of balusters: I-5/8"balusters+ 1-5/8" space=3-1/4"o.c. spacing.

AGREEMENT
Agreement made this second day of May, 2002, by and between Stephen F. Newburg and
Richard F. Newburg (hereinafter"buyer") and the Salem Historical Commission, a duly
constituted municipal body of the city of Salem, Massachusetts (hereinafter"the Commission").
RECITALS
1. WHEREAS, the Buyer has entered into a Purchase and Sale Agreement for the
property located at 271 Lafayette Street, Salem, Essex County, Massachusetts (hereinafter"the
property" or"said property"); and
2. WHEREAS, said Commission has jurisdiction over said property, pursuant to the
Ordinance relative to the Establishment of the Lafayette Street Historic District; and
3. WHEREAS, the Commission has filed a Clerk's Certificate as to Violation at the
Essex South Registry of Deeds (Book 12416, Page 168)relative to work undertaken in violation
by the current owners, Clifford and Susan Abelson (second floor, front porch railing alteration),-
and
lteration);and
4. WHEREAS, the Buyer has agreed to correct the existing violation after the
aforementioned sale of said property has been completed and after the Buyer has first submitted
and received approval of scaled drawings for the work to be completed; and
5. WHEREAS,the parties have agreed that the Buyer will escrow$3,500.00 to
secure the full completion of the required work on or before November 1, 2002, subject to the
terms and conditions enumerated herein:
NOW THEREFORE, in consideration of the mutual promises and covenants contained
herein, the parties mutually agree as follows:
1. The Buyer shall deposit $3,500 in an interest bearing escrow account at the Salem
Branch of Eastern Bank in the name of Anne L. Busteed in her role as Treasurer of the City of
Salem, who shall act as sole agent of said account. Said $3,500 shall be deposited prior to May
10, 2002.
2. As hereinafter more particularly set forth, the purpose of said$3,500 escrow is to
secure completion of the required work at said property (replacement of second floor, front porch
railings with railings to be approved by the Commission).
3. Any activity concerning said funds shall be governed by the within terms and
conditions of this Agreement.
4. The Buyer shall complete the required work on or before November 1, 2002.
5. In the event that the Buyer has fully completed the required work on or before
November 1, 2002, as determined by the Commission in its sole discretion, said agent shall
forthwith release said funds, together with interest, to the Buyer. Said determination shall be
communicated by the Commission in writing to said agent forthwith upon its determination of
completion.
6. In the event that the Buyer has not fully completed said work on or before
November 1, 2002, as determined by the Commission in its sole discretion, then said agent shall
thereafter release such funds as are requested in writing by the Commission to fully complete
said required work, which release shall be done forthwith upon any written request by the
Commission.
7. In such event, the Buyer hereby irrevocably agrees that the Commission shall
have the full power and authority to complete said required work and the Buyer shall not hinder
or restrict those retained by the Commission for such purpose in any way. In such event, all
decisions with respect to completing said required work, such as whom to hire, where and what
items to purchase, etc., shall be made by the Commission in its sole discretion, provided however
that in no event shall the Commission exceed the scope of the required work.
8. The Buyer hereby agrees that its agents, transferees and assigns, both past, present
or future shall also be bound by the terms of this Agreement.
9. Any funds remaining after the Commission has completed the required work,
together with any remaining interest, shall be refunded to the Buyer forthwith upon the
Commission's determination of said completion.
10. In the event that the funds are insufficient to fully complete the required work, the
Buyer agrees to promptly pay for any required work contracted or specified by the Commission
after said funds have been exhausted to complete said work.
11. The Buyer shall fully indemnify and hold the Commission and the City of Salem
harmless for any loss or expense the commission incurs as a result of any breach by the Buyer of
this Agreement including (without limitation) for attorney's fees.
12. Should the aforementioned sale of the property fail to close and the Buyer does
not purchase the property, this Agreement shall become null and void.
13. Any written communications between the parties, and between the Commission
and said agent, shall be by certified mail, return receipt requested.

to it in the event the Buyer fails to complete said work on or before November 1, 2002, or in the
event of any breach by the Buyer of this Agreement.
15. In consideration of the Commission's willingness to entertain the within
Agreement,thereby allowing the Buyer to consummate the sale of said property prior to the
satisfactory completion of the required work as said property, including the correcting of all
existing violations, the Buyer hereby irrevocably waives its respective rights to appeal any aspect
of this Agreement, including (without limitation) the transfer documents and/or agreement
conferring jurisdiction over said property on the Commission, the Commission's determination
of the existing violation, the nature and terms of this Agreement, and the scope of the required
work, and they shall take no steps at variance with such waiver.
16. If any portion of this Agreement is deemed to be invalid, its remaining provisions
shall nevertheless remain in full force and effect provided that they reasonably reflect the parties'
overall intention in executing this Agreement.
17. Stephen F.Newburg and Richard F. Newburg hereby certify that they have
complete authority to commit to the terms and conditions of this Agreement and shall
nevertheless furnish sufficient documentation to the Commission to reasonably verify same prior
to their execution hereof.
18. This Agreement shall be governed by the laws of the Commonwealth of
Massachusetts.

During the gluing process, each clamp on the shaft is
hand torqued to ensure equal pressure along the shaft, and —
clamps are left in place for a full 16 hours.
Meticulous finishing ensures that our columns perform
to your expectations.All shafts that are to be used on exteriors
are painted inside with asphaltum; pine columns are treated
with a wood preservative. Columns to be painted are primed
after turning and sanding with an oil-based primer. Each
coat of primer is sanded to give an excellent surface for your
final coats.

Mark Jolly,the contractor forthis project, contacted me about replacing the porch. I told him to provide
photos&an application for Non-Applicability if he was doing the work in kind or if it was not visible from
a public way.
On 8/5, after I got the Certificate signed, he told me the rail was to be increased in height to meet code.
I told him that this could require a Certificate of Appropriateness. He said it was not visible. I told him I
would look at it over the weekend and speak with him on Tuesday the 1&.
When he called on the 10"', I said it was visible and that I would speak to the Chair. I spoke to the
Chair that day and he said he would prefer that the rails stay as is and a bar(metal?) be added to the
top of the rail to meet height code. This would allow for retention of the existing railing which has turned
balusters and would likely be less costly. In any case, the applicant would have to go through the
appropriateness process.
Mr. Jolly called back on the11t' and I explained the situation and stated that he could propose more
than one option
I have not issued the Certificate of Non-applicability as of this date because the work is not in kind and it
is visible. I am awaiting a new application from the applicant.

It has come to the attention of the Salem Historical
Commission that an alteration (handrail) has been made to the
property at 271 Lafayette Street. The work has been completed
without first having received the appropriate approvals from the
Commission. We respectfully request that within 30 days, you
submit a completed application for the Commission' s review or that
the handrail be returned to its original condition.
In addition, for several years the Commission has attempted to
work with you to resolve the violation which exists at this
property concerning front porch ballasters that were replaced with
those that do not replicate the previously existing ballasters .
Since the violation still remains, we have scheduled discussion of
this violation on the agenda of our meeting of November 17, 1993 at
7 : 30 p.m. at One Salem Green. This letter serves to provide you
notice that the Commission may vote to record a Clerk' s Certificate
as to Violation, referencing your property title, at the Essex

First Floor Porch
1. Install new poured concrete footings to a depth of T-0", on which will rest the galvanized post bases.
2. Remove existing columns supporting the first floor structure and replace with new wood columns on galvanized
post bases. (These columns will be covered by trim.)
3. Remove and replace existing first floor joists and floor structure. Raise outside edge of porch floor to reduce
slope to approximately 1/8"/foot.
4. Remove existing fir floor decking. Replace with new 1"x 4"tongue and groove fir decking.
5. Re-install or replace trim and lattice work enclosing the area beneath the porch. The left(south)and the right
(north)sides will each be one panel(a panel is an area of lattice surrounded by a frame of Ix pine trim). The
long(east)side will consist of one panel extending from the left end of the porch to the center column/left side
of the door, and one panel from the right side of the door to the right end of the porch.
• Trim: The trim surrounding the lattice shall be lx pine, and shall match the existing trim.
• Lattice: At the option of the Owner,the lattice may be either re-used or new wood of the same dimension
and spacing as the existing. Plastic lattice shall not be used.
6. Access to under the porch and the basement: Replace the existing cut-down interior door with a new flush door
of 3" to 4" tongue and groove beaded edge boarding, supported on the inside with a "Z" frame construction.
7. Stairs: All new construction.
Treads: Fir, solid construction,probably two pieces due to depth of tread. Same overhang,front and sides.
Risers: Solid,pine.
Face of stringers:Painted-no applied trim.
Under stairs: Open-no lattice panels parallel to stair run. (The porch lattice panel will run under the stair
at the porch line.)
Handrail and bottom rail: New to match the existing(unpainted)top and bottom rails of the first floor
porch.
Balusters and spacing:New to match the existing balusters(1 G" turned)and spacing(23/4'o.c.)on the first
floor porch. Handrail height to be 2'-9" above nosing.
Top and bottom posts: New 7" square posts.with I x beveled edge base 9" high,and a beveled 1'/z° thick top
cap extending%'over a %d' scotia. Height of the bottom post shall be T-O" above bottom tread, and height
of the top post shall be such that the bottom of the scotia moulding is 2f"above the top of the new top 1'h"
diameter top rail(about 3'4").
Stair width: Width maybe either the full original width (front post to corner column) (preferred by the
Historical Commission)or it may be the narrower width as shown in submitted photographs.
8. Columns: Re-use existing columns. except repair as required and a) replace the bottom flat section of each
column base with a ventilating-type metal base;b)install a 1" dia. ventilation hole on the inside face of each
column near the top(or provide alternate ventilation);and c)flash the tops of the columns with aluminum,
copper,or lead flashing,painted.
9. Railings and balusters: Re-use the existing top and bottom rails and balusters. Install new balusters identical to
the existing rear porch balusters where balusters are missing or where square balusters exist. (New balusters
shall match the original,unpainted profile of the existing balusters.)

10.Raised railings: Install two 1-5/16"dia. horizontal wood rails above the existing top rails to provide an overall
railing height of 3'-0". (Present railing height is 28". Therefore the two new horizontal rails above the top
railing will create two spaces of about 23/,"each.) Install intermediate I'S"wide supports,lag bolted to the top
rail: one at the center of the railing at each porch end,and two between the south end and the center column.
Center each intermediate support over the nearest baluster. The new railings are to be visually continuous
across the face of the intermediate supports, although they can be spliced at the supports. See attached
drawing Sl'A-1. revised 9 8,99,for support design.
11.Remove and do not replace the existing clothesline framing.
12.Remove and do not replace the extraneous wood edge above the two left columns.
13.Retain the existing porch ceiling.
Second Floor Porch
1. Remove second floor porch enclosure(the exterior window and wall inserts). Owner has the option to not re-
install the enclosure at this time. If the enclosure is not re-installed, store for later use,if possible.
2. Raise the outside edge of porch floor to reduce slope to approximately 1/8"/foot.
3. If the.second floor porch enclosure(the exterior window and wall inserts)is not re-installed, the second floor
exterior building wall, window, and door openings exposed by removal of the porch enclosure, shall be
restored with clapboards and other details to match the existing rear facade.
Also, if the second floor porch enclosure is not re-installed, the following options are provided:
• Upgrade the 2nd floor porch railing utilizing the approved Ist floor porch railing detail; or
• Retain and repair the existing 2nd floor porch railing as required and secure the porch access door from
the inside in order to prevent access to the porch. (Access to this porch will have to be prevented as it will
now be left with a railing that will be lower than allowed by the building code.)
Paint Colors
1. Everything will be white except that:
° Lattice will be dark green,same as present color.
Porch deck will be gray.
Stair treads will be gray.
General Conditions
1. In order to compare new construction with that presently existing, no finish trim or materials that will mot be
re-used on the building shall be removed from the job site until the project is completed and accepted by the
Salem Historical Commission. Note:This does not mean that only representative samples must be retained.
All finish trim and materials removed from the building and not re-used must remain on the site.
2. This scope of work must be attached to the building permit application.

Several months ago you attended a meeting of the Salem Historical
Commission with regard to the replacement of a railing on the second floor
of your property at 271 Lafayette Street. It had been determined that the
ballasters which were installed are historically inappropriate and, at that
time, you indicated that you would return to the Commission with a
resolution to the issue.
Although the Commission is not always able to quickly follow up on
violations in historic districts, it is still the responsibility of the
property owner to be in compliance of the Historic Districts Act.
Violations are liable for up to a $500.00/day fine from the date of
violation.

Dear Ms . Harris :
In response to your letter of July 18, 1989 , I would like to
provide you with a summary of my understanding of my meeting
with the Historical Commission.
On January 13 , 1988 , I met with the Historical Commission re-
garding the second floor porch which had recently been completed
at my house located at 271 Lafayette Street in Salem. At that
time, 1 related to the Commission that I had met with one of its
representatives in the fall of 1987 . We discussed my intentions
regarding the porch to be rebuilt. I informed the Commission
that I indended to rebuild the porch as it then existed (which
I fully intended to do) . I was never informed that I had to
rebuild it the way it existed; nor was I ever told that if I
did not rebuild it as it then existed, that I would have to

After approximately one month of searching for the same ballasters
as were removed from the porch, the contractor (also unaware of
the Historical Commission' s restrictions) , suggested we use the
same design as existed on the rear porch. I agreed, and we
completed the porch.
At my meeting with the Commission in January, 1988 , I repeated
the narrative above. When I told about my search for the
ballasters , someone on the Commission remarked offhandedly, "Oh,
no, you have to handturn those ballasters to get them to match. "
If that was common knowledge to the Commission, why wasn' t I
informed of that at my fall meeting? In addition, at the January
meeting, I was told that someone on the Commission would contact
North Shore Vocational in order to see if they would undertake
the job to make and replace the ballasters . As I had heard
nothing from the Commission for 16 months , I went ahead and re-
painted the house, including the new wood on the porch.
I have spent many hours and many thousands of dollars in main-
taining this property both for safety and cosmetic purposes . I
feel that it is inappropriate and unfair that I must now spend
several thousand dollars more to replace the ballasters on a
newly rebuilt and repainted porch. I especially feel it is un-
fair that the compliance regulations were never explained to me.
In view of the foregoing, I do not intend to replace the railing
and ballasters , nor am I in a position financially to do so. If
the Commission provides me with a viable alternative, as had been
promised, I shall take it under consideration.

Procedures for Filing Applications
A. There is no fee to come before the Commission.
3. Be prepared to apply for approvals well in advance of commencing any e,rerior work. Before making any changes to the
arterior of a prooerEV in an historic district. the owner should call or vis_t the Commission representative at the Salem
Planning: Department to discuss proposed alcerations and to determine the category of the application (Appropriateness.
son-Applicab Ll Ltv or Hardship).
C. The Commission normaliv meets on the first and third Wednesdays of each month and notices are posted at City fall. The
meetings are held at One Salem Green. 2nd floor, and begin at 7:30 p.m. All meetings of the Commission are open to the
public and any person is entitled to appear and be heard on any matter before the Commission betore it reaches a decision.
D. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m. on the Mooday,lt days before
the meeting in order to make the following agenda. An application for a CertLficate of Non-Applicability may normally be
added to the agenda up to the uav of the meeting.
E. All applications for Certificate of Appropriateness or Hardship require a puo Lic hearing. Notice of the hear-.ng oust be
posted with the City Clerk 14 days before the nearing and abutters must be notified in writing. Commission statf will
handle these procedures. A public hearing is not required for a Certificate of Non-Applicabtlity.
� . Applications must be submitted by the owner of the property. In case of a canant, a waiver of the owner's appearance may
ae granted at the discretion of the commission if it is requested by the owner.
G. An application will not be Considered complete unless all work items are thoroughly described on scaled drawings and
include specifications regarding dimensions, materials, and any other information needed for the Commission to visualize
the changes in order to make a determination. Applications for painc colors should include a paint chip or chart.
Applications for changes other than Paint colors must be accompanied by scale drawings that adequately illustrate all
proposed changes. The following items should be included in your drawings as applicable:
1. Site plan shoving Location of improvements:
2. Elevation drawings of the specific improveaentsf
3. Details/profiles (i.e. moldings, fence cap$, cornices. etc.);
4. Materials (i.e. wood. brick, etc.);
5. Dimensions (L.e. size of trim); and
6. Transtormers, heat pump and condensor Locations. electrical entries and meters. lamp posts, stove pipes.
H. At their convenience, a representative of the Commission will take pictures of the property from the public way for
presentation at the meeting. It is not necessary that the applicant be home or be present.
1. At the hearing. the Commission will discuss the application with the applicant or his representative, hear the &batters anc
cake a vote. Owners having professional consultants such as architects or contractors are urged to have chem be present ar
the hearing. If the application is approved a Certificate will be issued. mailed to the applicant and copies will be sent
to the City Clerk and Building Inspector. Please note that the application can be continued until the next meeting if the
Commission deems necessary ( i.e. for reasons of incomplete drawings, to perform a site visit, etc.). In any use, the
Commission must make a determination within 60 days from the date the application is received.
J. A property owner or a concractor cannot receive a building permit unless a Certificate has been issued or the applicant he
a letter from the Commission stating that the change involved is not subject to the Commission's jurisdiction.
K. The City of Salem reserves the right to inspect the project to determine compliance with the conditions set forth in the
Certificate of Appropriateness.
Violations
A person commencing or completing work to the exterior of a building In an historic district without the necessary approval o
the Commission is subject to fines of up to $500 per day from the date of the violation. The City of Sales is not responsibl
for an owner's neglect to inquire about necessary City permits and approvals.
