Highway undertook a land taking on behalf of the City of Salem for a portion of land at 1 Harrington Court. Later that year, it was determined that the State would not need the land for the By- Pass road project and Assistant City Solicitor Len Femino was asked to proceed with the necessary work to return the land back to the Clevelands. It appears that this was never done. I have attached all the documentation that I have collected regarding this issue. Could you please proceed with whatever follow-up paperwork that needs to be done to put this land back in the Cleveland's name (i.e. Council approval to dispose of property, deeding back to Clevelands, etc.). The City has no need to keep the land, the Clevelands were never paid for the land and, according to Frank Kulik, City Assessor, they have been paying taxes on the land all along. Thanks! The State and City currently want to widen Bridge Street from two to five lanes (including a parking lane) between Boston Street and North Street. We believe that this project will have a major negative affect on our neighborhood in the McIntyre Historic District. Traffic noise in the neighborhood will rise dramatically. Please note that this section of Bridge Street sits in a river basin and all noise is magnified by the natural topography and local building placements, an effect very much like that which causes echoes in canyons to be magnified for great distances. A slight increase in noise level will make the present marginally tolerable noise pollution totally intolerable. We are sure that cars and trucks will accelerate on this proposed bypass thereby increasing the traffic noise five-fold. Our backyards will also no longer be safe for our children since tractor trailers and other large vehicles will travel at higher speeds within five (5) feet of our lawns. We are also concerned about the State's proposal to move the canal. This project will unearth large amounts of toxic wastes. Apparently, authorities wish to de-water this sludge in close proximity to our street and to the Historic District. This engineering recommendation is wholly ill-advised. We have every intention of conducting our own engineering tests on this sludge and of seeking protection for our families under the Federal and State environmental protection laws should these tests prove positive. Widening Bridge Street between Boston and North Street will not appreciably decrease traffic congestion since all traffic will be funnelled into the North Street/Bridge Street cloverleaf and Washington Street rotary, or into Boston Street, two areas which have drastically reduced speed zones, complex intersections and street front retail zones. This bypass will accomplish nothing and will only waste tax payer money. We strongly recommend abandoning this portion of the bypass plan. Should this bypass section be a necessary component of a new Salem-Beverly bridge under highway construction codes, we urge the City and State to scrap the present design and build a second two-lane road at least 200 feet further away from our neighborhood by bridging the canal instead of moving the canal. Bridge Street should be maintained for only local traffic by prohibiting large trucks and by reducing the speed limit. Of course, with our alternate recommendation, we also strongly urge you to consider strong noise abatement measures such as barrier walls, similar to those found in Minneapolis, and large tree and shrub plantings. Your review of these serious environment issues and your help with our concerns will be sincerely appreciated. SECTION 5 The fifth section of city highway hereby altered and laid out in behalf of the City of Salem, consists of widening the southeasterly intersection of Flint Street and Bridge Street and is bounded by the line of said intersection and by the line described as follows: Beginning at: a point on the easterly street line of Flint Street, said point bearing north 370-36' -29" east being 26 .98 feet distant from station 129+26.43 of the Flint Street baseline, hereinbefore described, and extending thence, leaving said easterly street northwesterly to northeasterly by a curve to the right of 35.00 feet radius, 46.85 feet to the point of ending thereof, on the southerly street line of Bridge Street, said point bearing south 330-18' -02" east and being 6. 14 feet distant from station 149+34. 18 of Auxiliary baseline, "C" hereinbefore described. The Location Lines of the sections of city highway, altered and laid out as hereinbefore described, are to be further defined by bounds set thereon at angle points, points of curvature, and at the points of beginning and ending thereof, where feasible. Easements are hereby taken on behalf of the City of Salem in the parcels of land shown on the plan to which reference is hereinafter made as Parcel 4-C-2-C, and Parcel 4-C-3-C, for the purpose of relocating, constructing and maintaining a portion of the North River Canal, and consists of the right to enter upon said land at any time to construct thereon and use said canal as 1990 L.O. 6659 in Salem Page 7 relocated- and to perform any other incidental work pertinent thereto. Said easements are permanent in nature. DeVillars Secretary of the Executive Office of Environmental Affairs Commonwealth of Massachusetts 100 Cambridge Street, Room 2000 Boston, MA 02202 RE: Salem/Beverly Bypass Dear Mr. DeVillars: We live on Harrington Court in Salem, Massachusetts directly next to Bridge Street (Highway 107) , or next to the proposed "Beverly-Salem Bypass". The State and City currently want to widen Bridge Street from two to five lanes (including a parking lane) between Boston Street and North Street. We believe that this project will have a major negative affect on our neighborhood in the McIntyre Historic District. Traffic noise in the neighborhood will rise dramatically. Please note that this section of Bridge Street sits in a river basin and all noise is magnified by the natural topography and local building placements, an effect very much like that which causes echoes in canyons to be magnified for great distances. A slight increase in noise level will make the present marginally tolerable noise pollution totally intolerable. We are sure that cars and trucks will accelerate on this proposed bypass thereby increasing the traffic noise five-fold. Our backyards will also no longer be safe for our children since tractor trailers and other large vehicles will travel at higher speeds within five (5) feet of our lawns. We are also concerned about the State's proposal to move the canal. This project will unearth large amounts of toxic wastes. Apparently, authorities wish to de-water this sludge in close proximity to our street and to the Historic District. This engineering recommendation is wholly ill-advised. We have every intention of conducting our own engineering tests on this sludge and of seeking protection for our families under the Federal and State environmental protection laws should these tests prove positive. Widening Bridge Street between Boston and North Street will not appreciably decrease traffic congestion since all traffic will be funnelled into the North Street/Bridge Street cloverleaf and Washington Street rotary, or into Boston Street, two areas which have drastically reduced speed zones, complex intersections and street front retail zones. This bypass will accomplish nothing and will only waste tax payer money. We strongly recommend abandoning this portion of the bypass plan. Should this bypass section be a necessary component of a new Salem-Beverly bridge under highway construction codes, we urge the City and State to scrap the present design and build a second two-lane road at least 200 feet further away from our neighborhood by bridging the canal instead of moving the canal. Bridge Street should be maintained for only local traffic by prohibiting large trucks and by reducing the speed limit. Of course, with our alternate recommendation, we also strongly urge you to consider strong noise abatement measures such as barrier walls, similar to those found in Minneapolis, and large tree and shrub plantings. Your review of these serious environment issues and your help with our concerns will be sincerely appreciated. Guy RE: 1 Harrington Court DT: July 17, 1989 The following is a summary of events regarding the vinyl siding issue at 1 Harrington Court owned by Lawrence & Barbara Cleveland. 1 . On May 25, 1989 Chairman Harris notified Kathy Winn of the Salem Planning Department that a contractor's sign was displayed at the property and that it appeared that vinyl siding was going to be installed. Ms. Winn called the Clevelands and told them any work required approval from the Historical Commission. The Clevelands stated that they thought that their contractor had taken care of necessary permits, that they were going away for the weekend, and asked if someone could call them next week. Ms. Winn stated that no work should be conducted. (See note to Ms. Guy from Ms. Winn. ) 2. On May 29, 1989, Ms. Guy asked Mr. Harris of the Building Department if the Clevelands had a building permit for any work being done at their property. Mr. Harris stated that there was none issued and went to the site the following day to see what was being done. Mr. Harris told Ms. Guy that it appeared that only windows were being replaced, which do not require a building permit. 3 . Ms. Guy attempted to contact the Clevelands by telephone on May 29, 30 and 31 but no calls were returned. 4. On May 31, 1989, Ms. Guy mailed a letter to the applicants indicating that they were in violation and requesting that they cease and desist. The letter was sent Certified Mail. The post office attempted to deliver this letter on 6/1/89 and 6/6/89 but it was returned to the Planning Department unsigned. (See letter dated May 31 , 1989 and corresponding envelope.) 5. On June 8, Mr. Harris issued a stop work order for being in violation of the Mass. State Building Code, Section 113 .0 (No permit on record) after visiting the site again and seeing vinyl siding being installed. At some point between 6/8/89 and 6/14/89 the stop work order was removed or sided over. Another stop work order was issued. (See letter dated June 8, 1989) 6. On June 12, 1989, Mr. Santo of the Building Department, unaware that Mr. Harris had the departmental card out of the file due to the violation, issued a Building Permit. (See copy of departmental card. ) 7 . On June 14, 1989, Mr. Santo revoked the Building Permit. (See letter dated June 14, 1989. ) 8. On June 14, 1989, Mr. Cleveland contacted Ms. Guy. Ms. Guy mailed the Clevelands Historical Commission applications. (See Letter dated June 14, 1989) 9. On July 5, 1989, the Historical Commission denied the Cleveland' s application to install vinyl siding.
