FOR A SPECIAL PERMIT AT 6 FLINT STREET (R-2) A hearing on this petition was held September 14, 1988 with the following Board Members present: James Fleming, Chairman; Messrs. , Bencal, Luzinski, Nutting and Strout. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners, owners of the property, are requesting a Special Permit to extend nonconforming side and rear setbacks to allow construction of a two story porch in this R-2 district. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section V B 10,which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F and IX D, grant Special Permits for alterations and reconstruction of non- conforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after careful consideration of the evidence presented and after viewing the plans, makes the following findings of fact: 1 . No opposition; 2. Because of the size of the back yard, the porches are very much needed to service both the first and second floors. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1 . The relief requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance; 2. According to the Commission's guidelines (also enclosed) , vinyl windows are generally not approved because of the goal of preserving original materials whenever possible. While we realize you have already paid your contractor $4,500, we stongly urge that you do not incur any additional expenses. We will advertise this application with your neighbors today, so that if you do • attend the next meeting all the legal procedures will be covered. We most definitely recommend that you apply for wood windows that,would.be'in:-keeping with the style and period of your house. Please be aware that you need a building permit to undertake the proposed work of replacing all the windows in your house. Such a permit will not be issued in a historic district Without a Certificate of either Appropriateness or Hardship from the Commission. Please note that a hardship certificate cannot be granted to resolve a self-created difficulty. T We realize that you are now in a difficult position, but because of our mandate to preserve historic and architectural integrity of structures in the historic district, vinyl windows create a problem.
