As stated in our letter of February 23, 1993, plantings
installed do not sufficiently screen the deck that you constructed
at 2 Flint Street. According to your Certificate, plantings were
required to be 24-30" high when planted and of sufficient bulk to
provide a year-round screening to hide what would otherwise be an
historically inappropriate deck.
The Salem Historical Commission feels that you have been
provided ample time to rectify this problem. Therefore, in order
to avoid legal enforcment, we respectfully request that within 15
days, the plantings be installed as required or the deck be
removed.

The Salem Historical Commission would like to thank you for completing the landscaping necessary
to hide the deck at 2 Flint Street. Provided that the deck remains non-visible from the public way, it is in
accordance with your Certificate of Non-Applicability. The Commission has one final outstanding issue,
that it brought to your attention in December, 1994,concerning landscaping timbers that were installed. At
that time, the Commission requested that you either:
- Remove the landscaping timbers;
- Submit a copy of an approved Certificate;
- Submit a formal application for the Commission to review the work completed; or
- Provide documentation that the landscaping timbers were installed prior to Cie creation of
the historic district.

NOTICE OF FILING OF CLERK' S CERTIFICATE AS TO VIOLATION

Dear Mr. & Ms. Hinchey:
For over a year and a half the Salem Historical Commission has
attempted to work with you to resolve the violation which exists at
your property at 2 Flint Street concerning a deck which was
constructed and later approved under a Certificate of Non-
Applicability conditional that it be screened from the public way
year-round with adequate plantings. At least five letters
concerning this matter were sent to you from either the Commission
or the City Solicitor and, to the best of our knowledge, no
response to these efforts was received from you.
On October 20, 1994 you were mailed notice of a hearing to
which you would be provided an opportunity to comment on this
issue. You were not in attendance at this meeting and it -s the
opinion of the Commission that the deck can still be seen from the
public way. Therefore, at its regular meeting on Wednesday,
November 16, 1994, the Salem Historical Commission unaninously
voted that an egregious violation exists and to notify you of the
Commission' s instruction to the Clerk of the Commission to record
a Clerk' s Certificate as to Violation at the Essex South District
Registry of Deeds, thirty days from this date. The C--_erk' s
Certificate as to Violation will reference your property title.
Please be advised that when the work in violation is addressed
to the satisfaction of the Commission and the Commission has
collected recording fees ($20 . 58) , the Commission will vote that
the violation has ceased and will instruct the Clerk of the
Commission to record a Clerk' s Certificate as to Completion of Work
at the Essex South District Registry of Deeds .
Should the violation cease prior to January 2 , 1995 , the
Certificate as to Violation will not be recorded.

On March 5, 1992, the Salem Historical Commission issued a
Certificate of Appropriateness to allow a deck at the rear of 2
Flint Street to remain as had been constructed without prior
approval, provided that it is screened as per landscaping plan.
The heights of the plantings were to be 24-3011 when planted with
all work to be completed by 5/15/92 .
On February 22, 1993 the Commission wrote to ycu as
notification that the plantings do not sufficiently screen the
deck. The Commission requested a written response within 3C days
as to when the problem would be rectified - no response was
received. On September 2, 1993, the Commission wrote to you again
and requested that the plantings be corrected or the de--k be
removed within 15 days. Letters concerning this outstanding
violation were also sent to you by the City Solicitor on February
10, March 14, and May 2, 1994 .
While, you have been provided ample opportunity to properly
screen the deck so that it is not visible from the public way or to
remove the deck, as of this date, the violation still remains .
Please be advised that we have scheduled discussion of this
violation on the agenda of our meeting of November 16, 1994 az 7 :30
p.m. at One Salem Green. This letter serves to provide you notice
that the Commission may vote to record a Clerk' s Certificate as tc
Violation, referencing your property title, at the Essex South
District Registry of Deeds . Your attendance at this meet=ng is
encouraged, as this will be your opportunity to comment .

Please be advised that the Salem Historical Commission has
received several inquiries from residents concerning activities at
2 Flint Street. The concern is that there is an unusual amount of
automotive repair work being undertaken on the Broad Street side of
the property and that the tenants may be operating an automotive
business .
Because the Commission has no jurisdiction over use, we
referred this matter to the Building Inspector for appropriate
action. We received a reply that Mr. Tremblay could not find any
sign of ongoing automobile repairs. Residents in that area have
indicated that the work in question is being done outside of normal
business hours, particularly weekends .
At the request of the neighbors, we respectfully bring this
concern to the attention of the Board of Appeal. Thank you for
your attention to this matter.

While the Commission is in approval of the fence as
constructed, the plantings do not sufficiently screen the portions
of the deck that are still visible from the public way. The
plantings must be of sufficient height and bulk to provide a year-
round screening of the deck or the deck will have to be removed.
Within the next 30 days, kindly provide a written response on
how and when you propose to rectify this problem. If you have
questions, please contact the Clerk of the Commission, Jane Guy, at
the Salem Planning Department.

The Salem Historical Commission has made several attempts to contact you
concerning a deck that has been constructed at 2 Flint Street without
first having received the appropriate approvals from the Commission. As
of this date you have been unresponsive to our attempts , and the deck
continues to be in violation of the Historic Districts Act. We have
since referred this property to the City Solicitor' s Office for legal
enforcement.
On November 19 , 1991 , we received a complaint from a resident that
fencing is now being constructed at this property. Please be advised
that such fencing has not been approved by the Salem Historical
Commission and is therefore in violation of the Historic Districts Act.
This violation will also be referred to the City Solicitor' s Office for
legal enforcement .
You are hereby ordered to CEASE AND DESIST all exterior work at this
property. You should immediately submit applications and plans for
approval of this work or return the property to original condition by
removing the fencing and deck. Please be advised that violations of the
Historic Districts Act are subject to fines of up to $500 per day from
the date of violation.

On April 2 , 1991, the Salem Historical Commission notified the
owner of 2 Flint Street in writing that a deck on the property was
constructed without having first received the required approval
from the Commission. The homeowner was also notified by the
Building Department on April 3 , 1991 and August 13, 1991 that such
deck was installed without having first received a building permit .
On October 8 , 1991 , the Commission wrote again to the homeowner and
requested that they provide a status of this outstanding issue .

As of this date, no replies have been made to any these
letters . The Commission therefore requests that the City
Solicitor' s Office begin enforcement proceedings .
