Dear Tom and Michael:
Thank you both for coming out yesterday and offering your expertise regarding my aviary. I
have filled out the appropriate paperwork, as you suggested,to the Historical Commission and
will be taking pictures to deliver to Jane Guy in the next day or two.
As per your recommendations,the aviary will be moved at least five feet straight forward from
the property line to be in compliance with the existing building code guidelines of such a
structure maintaining its out-of-public view from the street line to be in compliance with the
Historical Commission's guidelines.
As you stated,the building is within size guidelines not to need a permit.
Again,my many thanks to you both; it was a pleasure talking to you both.

Good morning Jane.I live at 188 Federal St. I am aware of my neighbor's,Pam Waldron's,hearing for Certificate of Appropriateness
to"move side lot line fence in rear of property" on this Wednesday's HSC meeting agenda.
My concern has to do with the fence portion of the application as there is a possibility that I cannot be present at this meeting. Would
it be possible to give me more details so that I can determine what to write in a letter to be read in my absence if need be?
More specifically:
1. Is it the fence that abuts my property at 188?I am assuming it is.If not,disregard the following concerns.
2. How does the actual course of the fence determined?I know that the land was recently surveyed by a surveyor hired by Pam. There
are only two markers that I can see-one at the rear of the property and one at the front(street side).Can the proposed new location of
the fence be clearly marked prior to construction?
3.There is a large,beautiful maple that is on the property line. What are the considerations/options for constructing a fence around it-
making sure that the health of the tree is not compromised?
4. When will the fence be moved?Can I be notified so that I can keep my dog and children(from her dogs)safe while there we
"holes"?
5. Possibly a mute point but...WHY does Pam want(presumably)to move a recently installed fence(2-3 years ago)only what seems
to be inches from its current location?In my opinion it seems to be a costly production to gain what seems to be a only few in-hes.
She hasn't been the most reasonable neighbor in the past 18 months.

Update since you asked: I have not heard a word regarding the structure on my neighbor's lot and the issue has
been removed from the Commonwealth app. so I'm not sure where it stands which is a bit frustrating.
However, I have been informed by this same neighbor that she plans to move and add to her fence. I do not see

children, live at 188 Federal Street here in Salem. We have lived at this residence for 12 years

boarder, we live in the McIntire Historic District and appreciate the HSC guidelines as a way to
preserve both the history and aesthetically pleasing attributes of Salem. We have invested well
over$100,000 since we bought our house in 2003,always improving and maintaining the
historical integrity of our house and property. We expect our neighbors to do the same.
Unfortunately, our abutting neighbor,Pamela Waldron, residing at 192 Federal Street, has
constructed a structure,with a concrete foundation,framed 2x4 walls and ceiling, covered with
wire mesh for housing her exotic bird collection in the warmer months. Not only is this structure
a complete eyesore, the inhabitants have extremely raucous calls, often heard 4 or more houses
away, attested to by friends that live this distance away.
My concerns are:
1. Proper procedures for both Building Permit and Historical Commission Guidelines were not
followed or considered.
2.. Even IF above said structure was approved and a permit was issued, it is not in compliance
with with Salem's city ordinance,3.2.4-Accessory Buildings and Structures,because it
directly,within 1 foot, abuts the property line. If it is to be considered a"coop" then, as you
know,the requirements are 10' of side lot lines according to 3.2.7- Urban Agriculture.
3. The noise that the birds make from this "aviary": Specifically, the Scarlet and Blue and Gold
Macaw parrots. Two or more of these birds are in this structure at any given time and a large macaw
can scream at the same decibel (-120-140db) level as a rock concert or an idling jumbo jet engine-
not exactly pleasant or a sound that"annoys or disturbs a reasonable person of normal sensitivities"

Also noteworthy: This issue was reported on the app Commonwealth Connect on April 12, 2015.
See attached photo. It has been reopened as of this afternoon.

The current exemption for "homeowners" was extended to include owner-occupied
dwellinas of six units or less ano to allow such homeowners to engage an in-
aiv+aual for hire who does not possess a license, provided that the owner
acts as supervisor. (State Building Code Section 1
DEFINITION OF HOMEOWNER:
• Person(s) who owns a parcel of land on which he/she resides or intends to re-
side, on which there is, or is intended to be, a one to six family dwelling,
attached or detached structures accessory to such use and/or farm structures.
A person who constructs more than one home in a two-year period shall not be
considered •a homeowner. Such "homeowner" shall submit to the Building Official,
on a form acceptable to the Building Official, that he/she shall be responsibic
for all such work performed under the building permit. (Section .
The undersigned "homeowner" assumes responsibility for compliance with the Stcte
Building Code and other applicable codes, by-laws, rules and regulations.
The undersigned "homeowner" certifies that he/she understands the Town of
Building Department minimum inspection procedures and requirements
and that he/she will comply with said procedures and requirements.

HOME OWNER 'S EXEMPTION
The Code state that : "Any Home Owner performing work for which a building
permit is required shall be exempt from the provisions of this section
(Section 109. 1 . 1 - Licensing of Construction Supervisors) ; provided that If a
Home Owner engages a person(s) for hire to do such work , that such Home Owner
shall act as supervisor . "
Many Home Owners who use this exemption are unaware that they are assuming
the responsibilities of a supervisor (see Appendix 0, Rules and Regulations
for Licensing Construction Supervisors , Section 2. 15) . This lack of awareness
often results In serious problems, particularly when the Home Owner hires
unlicensed persons. In this case our Board cannot proceed against the
unlicensed person as It would with licensed Supervisor . The Home Owner acting
as supervisor Is ultimately responsible.
To ensure that the Home Owner Is fully aware of his/her responsibilities, many
communities require, as part of the permit application, that the Home Owner
certify that he/she understands the responsibilities of a supervisor . On the
last page of this Issue Is a form currently used by several towns. You may
care to amend and adopt such a form/certification for use In your community.
