Be prepared to apply for approvals well in advance of commencing any exterior work. Before making any changes to the exterior of a property in an historic district,the owner should call or visit the Commission representative at the Department of Planning&Community Development to discuss proposed alterations and to determine the category of the application(Appropriateness,Non-Applicability or Hardship). B. 'rhe Commission normally meets on the first and third Wednesdays of each month and notices are posted at City I fall. The meetings are held Lit 120 Washington Street,3rd floor,and begin at 7:00 p.m. All meetings are open to the public and any person is entitled to appear and be heard on any matter before the Commission before it reaches a decision. C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in order to make the agenda. An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the meeting. In some cases,a Certificate ofNon-Applicability may be issued by the Clerk,without review by the full Commission,after notifying Commission members and allowing 24 hours for any objection. There is no Ice for any applications. D. All applications for Certificates of Appropriateness or Hardship require a public hearing. Notice of the hearing must be posted with the City Clerk 14 days before the hearing and abutters must be notified in writing. Commission staffwill handle these procedures. An application will not be considered complete unless all work items are thoroughly described on scaled drawings and include specifications regarding dimensions, materials, and any other information needed for the Commission to visualize the changes in order to make a determination. Applications for paint colors should include a paint chip or chart. 'rhe following items should be included in your drawings as applicable(exhibits should be 8%,x I I or be able to be folded to 8%x 11): I. Site plan showing location of improvements; 2. Elevation drawings of the specific improvements; 3. DetaiWprofiles(i.e.moldings, fence caps,cornices,vents,etc.); 4. Materials(i.e.wood,brick,etc.); 5. Dimensions(i.e.size of trim);and 6. Transformers,heat pump and condenser locations,electrical entries and meters, lamp posts,stove pipes. H. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners having professional consultants such as architects or contractors are urged to have them be present at the hearing. Ifthe application is approved, a Certificate will be mailed to the mailing address provided on the application and copies will be sent to the City Clerk and Building Inspector. Please note that the application can be continued until the next meeting if the Commission deems necessary(i.e. for reasons of incomplete drawings,to perform a site visit,etc.). In August,2002,the previous owner,MaryAnne MacIver,submitted an application for a Certificate of Hardship to the Salem Historical Commission for the installation of ten vinyl windows for the first floor. In an unusual move by the Commission,they approved the installation of six vinyl,2 over 2,replacement sash along the right side and rear of the house (bedrooms,kitchen and bath windows)and encapsulation of the interior and exterior wood frames. The reason for the Hardship approval was that a lead inspection report found hazardous levels of lead,Ms.MacIver was nine months pregnant and typical lead abatement for wood would require household relocation. The Commission noted that eventually the six encapsulated windows could be reversed. The Commission also issued approval for replacement of the first floor window on the front facade and the bay window on the left side facade in kind(all to remain wood). However,shortly after,the Commission was informed that both of these windows had also been replaced with vinyl in violation by the owner. On October 9,2002,the Building Commissioner issued a letter of complaint to Ms.MacIver. I have enclosed copies of the window approvals and the letter of complaint. Following receipt of the letter,Ms.MacIver contacted Ward Councillor Regina Flynn seeking her assistance in resolving the issue. Councillor Flynn discussed the options with Jane Guy,our Clerk of the Commission. It was determined that the easiest recourse would be to allow the windows to temporarily remain,but to file a Clerk's Certificate of Vote against the property title so that the violation would be required to be corrected prior to the unit being sold. Unfortunately,the Clerk's Certificate was not filed before a sale to you took place. As per its usual practice,the Commission has elected not to burden a new homeowner with a violation that was not of their making and for which they were not aware of prior to purchasing. However,the Commission wanted you to be aware of this situation and to inform you that since the front and bay windows remain in violation,you,or future owners,will not be able to replace them with new vinyl windows should the existing vinyl windows fail. In addition,the Commission encourages you to consider correcting this violation and returning these windows,as well as the six encapsulated windows,back to the historic wood. Most exterior wood surfaces do require some kind of finish, unless the material being used is of very high quality or designed for no finish, such as cedar, pressure treated wood or redwood.
