Dear Allen,
We have carefully reviewed your Proposal dated 9/11/00 for roofing work to be done at 174
Federal Street, Salem, and have determined we would like to accept your proposal, subject to the
following adjustments and clarifications:
Right Side Fiat Roof. You mention removing crown and installing new fascia. What appears to
be crown molding is actually a small gutter, the south side of which has rotted out. We do not
wish to use the old gutter but would like to replace the rotted section with a molding that closely
matches the remaining gutter. We assume the edge finish of the flat rubber roof would have the
appearance of a normal drip edge so as not to be too far out of character with the building.
Front Shelf RooE We assume you noticed the rotted edge of the soffit where it meets the roof
(including a squirrel hole) and would replace that wood as necessary while placing the flashing
material under the siding.
Upper Flat Roof. We assume the flashing to be installed where it meets siding would involve
removing siding to proper flashing height and reinstalling the siding(with new as necessary).
Shingled Portico (Over entrance to Unit 13, in the rear). We have decided to forgo this item
and understand the cost will be reduced by the $280.00 you mentioned.
"Flat Portico" (Over entrance to Unit A). We assume you also will be removing a small
portion of the comer vertical facia, as well as the siding, to a height to allow the flashing to
extend to the left edge of the portico roof. We understand the joint from such removal maybe
visible upon completion, but should be as unnoticeable as possible.
We have enclosed a check in the amount of$1,522.00 as 1/3 of the revised total of$4,565.00
($4,845.00- $280.00). We will immediately proceed with the necessary Historical Commission
approvals. Let us know when you could start.

undertaken which is ordinary maintenance and/or repairs which will result in no change in color,

on Monday, February 2, 1998 at 11:20 A.M..
Notice: If this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's
responsibility to ensure that this unit complies fully with 105 CMR 460.000: Regulations for Lead Poisoning

Residential Housing
The following Is a brief summary of some of the I_gal remedies tenants may use In order to get hogsing code violations
corrected:
1. Rent Withholding(Massachusetts General laws,Chapter 239,-section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your resit payments.You can do this without being evicted if:
A. You can prove that your dwelling unit cr common areas contain code violations which are serious enough to cndangcr
or materially impair your health or safety and'thaCyour landlord)ai6w about the violations before you were behind in-
yourrent.

conducted an inspection and found the following violations:
Article 1 . 113. 1 Property is being reconstructed, altered, repaired and

Article 1 . 104 Building is not being maintained in a safe and sanitary
condition.

b) expose and friable asbestos pipe insulation
throughout basement.
c) means of egress blocked, not lighted and in need of

Article 2300 Existing roof and flashing needs repairs.
Article 2700 Electrical wiring and equipment for light, heat and power
experiencing overloads and exposed wiring in some areas.
(NO PERMIT FOR WORK)
Article 2800 Plumbing and gas piping in need of repair. Heating and
water piping disconnected.
Article 3200. 4 Hazardous exitways
a) Less than two acceptable exitways serving each story.
Article 3401 . 10 Handrails missing and need repair.
Article 3401 . 12 Gutters and downspouts missing and need repair.
Article 3401 . 13 Wall and ceiling finishes missing allowing for flame spread
hazard through interior walls and ceiling.

Report: On Friday , August 22, 1997 1 went to 174 Federal street to contact the
owner and notify them of safety problem of the third floor windows being
removed which was allowing rain and animals into the home.
I rang the front door bell to see if anyone was home and a woman
living on the first floor opened the door. At which time I identified myself
as the Assistant Building Inspector and handed her a business card.
The woman introduced herself as Elizabeth Mix , the tenant in apartment
# 1. 1 asked if the owner lived there and she stated no. I then ask if she
knew were I could get in touch with him.
Ms. Mix then stated she was glad to see someone from the inspectors
office because of a number of hazards that existed in the home and was
not sure of who she should have contacted.
Ms. Mix then invited me in to show me the hazards that she was talking
about. At this time I enter the home and found the following violations.
Violations:
Article 1. 113.1 Property is being reconstructed, altered , repaired and

of the problems. She is pregnant and has a six year
old son living with her.
I explained to her that I would review the problems with
other city inspection agencies on Monday and contact her
later on Monday.

Enclosed please find copies of photographs which indicate the
present location of the four skylights at 174 Federal Street . The
location of each skylight has been numbered.
In order to clarify the terms that the Commission will accept
a settlement in this case, please be advised that the Commission is
willing to allow the retention of either skylight numbered "#1" or
skylight numbered "#4" provided that no changes are made in either
size, style or location. The remaining skylights should be removed
and the roof should be resurfaced to match existing. The
Commission would further require that the removal of skylights and
resurfacing of the roof be completed by August 30, 1992 .

Relative to the above named case, a deposition of Mr. Wallace
was conducted at my office on November 13, 1991.
At the conclusion of this deposition Mr. Wallace informed me
of the details of a proposed settlement which he wishes to offer.
Mr. Wallace is offering to remove two of the alleged illegal
skylights at this time. He would like to retain the two skylights
which open into the attic bedroom. These are the two skylights on
the westerly side of the building closest to Federal Street.

that was mailed to you on December 13, 1990 . Please note that
the repainting portion of your application was continued because
the Commission requires evidence cf the color scheme of the house
prior to when painting began.
It is the opinion of the Commission that the pediment portion
of the building would historically be the color of the body of
the house and not the accent or trim color. In this regard, the
Commission respectfully requests that you attend the meeting of
January 16, 1991. If you desire to retain the accent color on
the pediment, of which we have noted that painting has recently
begun, you should bring evidence that the paint scheme was a

we give our permission for the side of our newly
constructed fence facing 174 Federal St. to be stained gray if
deemed appropriate by the commission. We request that the fence
cap remain white. This would ammend the certificate granted the
end of June for the fences to be white.

This is the letter of confirmation for the commission.
We presume that you will apply quickly for this as this process
is now delaying the completion of the fence we had wanted fin-
ished before September .
Since as you are changing the color, we presume you will _
purchase the stain and will stain the fence. We prefer Pratt
and Lambert or -California stains but you are probably trying to
match your house by using the Cabot stain so will agree to that
if the commission does.
Please let us know when this will be on the agenda so we
can have a time frame for expecting the staining to be
completed. Our request is that is has to be done with two coats
of stain this fall . We know you' ll take weather conditions into
consideration so that the job will be done well and will last a
good many years before having to be restained. We used oil base
stain and understand that you will do likewise and in the
future will use a latex stain if it needs to be redone.

Now comes the Plaintiff , Salem Historical Commission of the
City of Salem, and says as follows:
1 . The Plaintiff , Salem Historical Commission of the City
of Salem (hereinafter referred to as the 'Commission' s
is an entity created pursuant to M.G .L . Chapter 40C
with an address of One Salem Green, Salem, Essex County,
Commonwealth of Massachusetts.
2 . The Defendant, Donald Wallace, is an individual residing
at 174 Federal Street, Salem, Essex County, Commonwealth
of Massachusetts .
3 . The Defendant is the record title owner of the premises
located at 174 Federal Street, Salem, Massachusetts,
within an Historic District in the City of Salem.
4 . Said premises are governed by ordinances promulgated by
the Plaintiff , Commission.
5 . On or about October 30 , 1989 , the Defendant, Donald Wallace
filed an Application for Certificate of Hardship with the
Plaintiff , Commission.
6 . On or about November 15 , 1989 , a hearing was held by the
Plaintiff , Commission, during which said Commission denied
Defendant ' s application for the installation of four ( 4 )
skylights , and ordered the removal of said skylights
which the Defendant, Donald Wallace, had already in-
stalled ( See Notice of Denial of Application for a Certi-
ficate of Appropriateness attached hereto) .
7 . Despite the demands of the Plaintiff , Commission, the De-
fendant, Donald Wallace, has failed or refused to remove
the four (4 ) skylights .
WHEREFORE, the Plaintiff , Commission, demands Judgment against
the Defendant , and that this Honorable Court :
A . Order the Defendant , Donald Wallace, to remove said
skylights;
B . Issue an injunction preventing the Defendant from
doing any further construction, alteration, or re-
novation without appropriate approval of the Plain-
tiff , Commission;
C . That appropriate damages be awarded; and
D . Award the Plaintiff costs in this action.

As City Solicitor, I am in receipt of a request from the Salem
Historical Commission to take action against you relative to ordinance
violations at 174 Federal Street.
It is my understanding that you have installed four skylights
without approval from the Commission. Under the law, legal action can
be commenced against you for this.
Accordingly, I would ask that you contact me immediately so that
we can discuss this matter . It is my hope that an amicable resolution
can be reached without filing a lawsuit .

Dear Atty. Daly:
Please be informed that skylights installed at 174 Federal
Street are in violation of the Historic Districts Act. The
owner, Mr. Don Wallace, was denied applications for Certificates
of Appropriateness and Hardship at a duly called public hearing
held on November 15, 1989 at which a quorum was present. In the
decision filed with the City Clerk' s office dated November 20,
1989, Mr. Wallace was given a thirty day period of compliance for
the removal of the four skylights in violation.
Enclosed are copies of the decisions and correspondence
related to the violation. Since over 30 days has passed and the
skylights have not been removed, the Commission is referring this
matter to the City of Salem legal department for enforcement.

On August 31, 1989, I received a telephone call from a neighbor stating
that a skylight was being installed at 174 Federal Street. Mr. Don
Wallace, the owner, had been permitted to install a dormer on the property
because it was not visible from a public way. This permission was given in
the form of a letter from Sam Healy to the Building Inspector stating that
the Commission did not have jurisdiction on the dormer because it was not
visible.
I left a message on Mr. Wallace' s answering machine to call me but did not
get a return call. I sent a letter from the Commission on August 31 , 1989
to Mr. Wallace, certified mail, return receipt requested, requesting that
he cease and desist and submit necessary applications. On September 20,
1989, I received my letter back unclaimed. The post office had given Mr.
Wallace notice on 9/2/89 and 9/7/89 that they had a certified letter.
On September 20, 1989, I noticed that Margaret O'Brien, the Planning
Department' s Home Improvement Program Coordinator, was mailing Mr. Wallace
an application for contractors interested in being qualified to do work for
homeowners utilizing the Home Improvement Program. We included the
Commission's letter of 8/31/89 with the application.
On 10/18/89 Dick Oedel left a message on Mr. Wallace's answering machine.
On 10/19 and 10/20 Mr. Oedel spoke to Mr. Wallace and asked him to be in
touch with me by 2:00 p.m. on 10/23.
On 10/24 I received a letter from a neighbor regarding the violations along
with a summary of previous experience Mr. Wallace has had with the
Commission.
On 10/24 I received a call from Mr. Wallace and informed him that I must
receive an application for the work performed or else I will have to start
legal proceedings.
On 10/30 Mr. Wallace submitted his applications and requested that he be
put on the 11/1 agenda for discussion. The public hearing will be 11/15.

We are writing in regard to work being done at 174
Federal Street without notification to neighbors and without
permits issued by your board. Since this is not the first time
work has been done without permit we are especially concerned
that this practice will continue and the purpose of home
ownership in an historic district is being nullified.
Skylights were put in the roof a few weeks ago and we made
inquiry with the commission as we never received notice of a
hearing. We would find one skylight acceptable within commission
appropriateness but find the amount presently installed
unacceptable. We especially are displeased that we had no
knowledge of this work to be done until hearing the actual
installation by the workmen.
Don Wallace received a certificate of hardship in Sept.
1986 for a window installed under similar circumstances. He went
before the board about staining his house but he also used
another color not mentioned. We have no problem with the added
color as such but do have a problem with not abiding by the
terms of the certificate.
Enclosed are copies of letters regarding said certificate.
Also enclosed is a letter from the office of the building
inspector regarding concerns that neighbors had about the number
of people at such residence. Mention is also made of a deck. A
deck was being built without permission and with disregard to
zoning requirements that it be a certain distance from abutter 's
property line.The building inspectors had the work cease but the
deck was never dismantled until we recontacted the inspector 's
office after two or three years of waiting.
We are presently in touch with the building inspector 's
office because a second electic meter has been installed and we
have not received notification of this single family house
becoming a two family dwelling.
We had expected that Don Wallace,owning a painting company,
would be aware of the need for permits since he employs workers
to do construction work also. We are extremely frustrated with
his disregard for the guidelines of home ownership within this
historic district and with the fact that we are thus appearing
to be the bad guys with our justified concerns. He seemingly
does what he can get away with and does nothing until we
complain( in the past we 've communicated our concerns to him
first to allow rectification of the problem without having to
notify anyone else but that approach proved unsuccessful) .
Your asssistance in this matter is appreciated. We
deliberately chose to move into this neighborhood to be among
other home owners concerned with the integrity of their homes
and the district.

Dear Mr . Munroe,
This letter is an inquiry to your office about work
being done on the premises of 174 Federal Street owned by Don
Wallace.
A second electric meter has been installed to the outside
of the house. We have received no notification that this single
family dwelling was being converted into a two family dwelling.
We have heard an extensive amount of work being done on the
inside of the house seemingly beyond what his permit states. As
you may recall he had no permit for that work to be done until
your office was notified.
Having a two family dwelling will probably be much more
preferable than the numbers of tennants he ' s had residing there
over the years. But I ascertain that a necessary procedire needs
to be followed in order to make such a transition.
We request that your office be in touch with our neighbor
Don Wallace(no relation) and that he adhere to the proper pro-
cedures.
We are also currently in communication with the Historic
District Commission regarding work that he has done on his
house,again without proper permit, under the commission' s juris-
diction. Enclosed is a copy of the letter being sent to them as
the follow up to a phone call.
We would prefer that our neighbor follow the guidelines for
home ownership in Salem and that we not have to be placed in the
position of watch guard to protect our property' s value.
The number of tennants has decreased and we appreciate your
looking into this matter . We did evidence some hostility towards
us by some of his tennants but it was not continued so we did
not notify you , the mayor ' s office or the police.

This letter is in regards to a deck being built at the
property of Donald Wallace at 174 Federal Street . A permit was
never sought or granted for such construction. You stopped the
construction but the framework has been left as when you saw it.
Damage has been done to the fence separating our properties due
to the construction that was begun. We are asking that the
frame-work be taken down so that a deck can be built in
accordance with the existing building codes for Salem.
We also wish to inquire about the number of persons living
at such residence. Our information is that two people may be
boarders in a neighborhood zoned residential as ours. We do not
know how many people are living at 174 Federal Street at present
but it is seems to be a "rooming house" with more than the
allotted two roomers. We presume that you can give us the
necessary information on who handles such matters or make such
inspections.
What are the guidelines for having a business in a home?
Our neighbor runs his painting business from his house and we
never received notification about a granting of a variance.
We deliberately moved into an historic district to prevent
these types of problems and we have expressed our concerns to
our neighbor in the hopes that he would rectify such
discrepancies. We have waited months to hear from him but to no
avail . We would have much preferred to deal privately with him
than to make a formal complaint . As members of Historic Salem we
are very concerned about maintaining the integrity of the neigh-
borhood and the preservation of our older homes.

Dear Mrs. Wallace:
At its September 3, 1986 meeting, the Salem Historical Commission
reviewed two applications from Don Wallace for his house at 174
Federal St. The Commisison approved a Certificate of Non-Applicability
for r&clapboarding and staining in the same color as these items are
considered repairs and not under the Commission's jurisdiction. A
Certificate of Hardship was granted for the window.
Because you brought this item to our attention, I wanted to
explain the circumstances under which the Hardship certificate
was granted. In this case, it was not issued for financial reasons,
but rather because the conditions especially affecting this building
(the fact that the houses are so close together and the window is
set so far back from the street); meant that the impact of the
change was so minimal that it would have been a hardship for Mr.
Wallace to reverse the alteration. Under the Salem Historical
Commission Ordinance, abutters are allowed to comment on changes
to neighboring buildings if they would like to do so which is why
the attached notice is enclosed.

Pursuant to Massachusetts General Laws , Chapter 40C, the Salem.

Dear Mrs. Wallace:
At its September 3, 1986 meeting, the Salem Historical Commission
reviewed two applications from Don Wallace for his house at 174
Federal St. The Commisison approved a Certificate of Non-Applicability
for rAclapboarding and staining in the same color as these items are
considered repairs and not under the Commission's jurisdiction. A
Certificate of Hardship was granted for the window.
Because you brought this item to our attention, I wanted to
explain the circumstances under which the Hardship certificate
was granted. In this case, it was not issued for financial reasons,
but rather because the conditions especially affecting this building
(the fact that the houses are so close together and the window is
set so far back from the street) ; meant that the impact of the
change was so minimal that it would have been a hardship for Mr.
Wallace to reverse the alteration. Under the Salem Historical
Commission Ordinance, abutters are allowed to comment on changes
to neighboring buildings if they would like to do so which is why
the attached notice is enclosed.
