The preliminary design drawings indicated that this chimney would be retained "above the roof line", repointed and removed below to facilitate the new residential program. As construction commenced demolition provided direct observation of the chimney and framing construction. It was observed that due to the existing construction method of the roof the exterior walls were leaning out from the center of the building on all exterior walls of the original building knee walls at the third level. Also, the fourth-floor level framing was undersized and never should have been used for habitable space. A stairway opening was cut into the original third floor ceiling to create 4'h floor habitable space. This increased the effects of the roof construction on the outward lean of the exterior walls. The chimney to remain was intended to be supported on the fourth floor level and some modification of the existing structure assumed to be in place would occur. After demolition and exposure of the existing structure it was observed that the base structure assumed to be in place did not exist. To support a masonry chimney for the existing height above the roof,it would have required extensive and economically infeasible structure to support and stabilize a brick masonry structure. The General Contractor/Owner and the tax credit consultant reviewed the condition and it was determined that the chimney would be removed and replaced with a framed chimney and clad brick to match existing dimensions and profiles with a concrete cap. This faux chimney would weigh significantly less and therefore allow for reasonable modifications to the structure. Please do not hesitate to contact our office if you require additional information. Please convey my comments to the Commission. I am very concerned that this is the second instance of this developer removing chimney's without seeking Historical Commission review first. At least in this instance, he is replacing them,though I leave it to the judgment of the Commission to determine whether the proposed replacements are of appropriate quality. This developer owns 3 properties in the Federal St. neighborhood: 161 Federal, 162 Federal and the house on the court near 161 Federal whose chimneys were demolished without permission from the Historical Commission and NOT replaced. I urge you both to carefully review the plans. Also, please consider what measures, including fines, can be taken so that our neighborhood and the City so that Cougar Capital respects, instead of disregarding,the state and local regt.lations in place to protect historic assets and our neighborhood. This is a project which has submitted for and been approved for both State and Federal tax credits. The chimneys have been removed due to deterioration. The initial plan was to keep the chimneys where they are exposed to view from the roof up and repoint them. The chimneys would then be removed below the roof line and supported structurally. The engineering required to support the weight and wind load on the chimneys to remain was not practical. The decision was made to remove the chimneys and rebuild them in kind from the roof up with a plywood backup and veneer brick and mortar to match the existing. All profiles and dimensions would be respected in regards to the removed chimneys. The former chimneys are rectilinear, have dimensionally, minimal corbelling with a concrete cap. We reviewed this procedure with the Epsilon the Tax Credit Consultant and they felt that this was an acceptable approach and is within the guidelines for historic restoration I hope this clarifies this issue. Evaluate the characteristics of this building in terms of other buildings within the coa unity. This 2 1/2-story, 3-bay, center-entry, mansard-roofed house is 5 bays deep with a center entrance on the east side. A 2-story ell extends from the rear with a 1-story addition on its east side. Windows on the facade are paired and have molded frames and 4/4, double-hung sash. Other windows are single with cornice caps and 4/4 sash. Dormer windows have pediment caps. Those on the front are paired. Others are single. All have 4/4 sash. The central dormer on the main facade has a pair of Roman-arched windows with 4/4 sash and a fanlight at the top. Above this dormer is a cupola. Italianate features include the front porch with paired columns and bracketed eaves, corniced window caps, bracketed eaves, and pedimented dormers. Central emphasis is given to the main facade by an Italianate, one-story front porch, a Roman-arched, main entrance with a fanlight and double-leafed, glazed-top doors, and by a cupola that breaks the roof line above the central, facade dormer. Include uses of the building and the rote(s) the owners/occupants played within the community. St. James parish, the second Catholic parish in Salem, was established in 1850. A church was constructed at 154 Federal Street. Erection of the convent c. 1878 was part of an expansion of the parish that occurred in the late nineteenth century under Father John J. Gray, who became the parish priest in 1868. During his tenure, the parish expanded significantly with the construction of a school addition on the rear facade of the old church (c. 1870) , a convent (1878) , a rectory at 161 Federal Street (1889) , and a new church at 150-152 Federal Street (1891) . The convent was built for the Sisters of Notre Dame, an order that joined the parish in 1864 and founded a girl's school the same year. Called the Notre Dame Educational Institute and later the St. James Educational Institute, the school offices were located in the convent. By 1884, the school grew to { include 12 sisters and 500 students. The school was housed in a rear addition (c. 1870) to the 1850 church. When the new Saint James Church was built in E1891, it appears the old church was converted for educational use. St. James Parochial School was constructed on the Bite �f the old church in 1906. By 1922, approximately 700 grammar and high school students were enrolled. The school continued for half of a century until it was closed c. 1971. Harris, Chairman Dear Ms, Harris, Health and Education Services, Inc. is in receipt of the December 9, 1992 letter from the Salem Historical Commission, concerning sufficient screening for the newly constructed handicap access ramp at 162 Federal Street. The handicap access ramp was completed in total last fall. At that time, Health and Education Services, Inc. consulted with T. O'Shea Landscaping regarding a living screen as we felt this would be more attractive to the environment and acceptable to the abutting neighbor. The landscaping firm, after reviewing the conditions set forth by the Salem Historical Commission, recommended at least two Arborvitae shrubs to be planted at the designated site. Mr. O'Shea, however, also cautioned us that these shrubs must be planted in early fall or late spring. By that time, it was late fall. Mr. O'Shea was also kind enough to review local nursery inventory and reported back that it was late in the fall planting season and no more appropriate shrubs were available. At that juncture, Health and Education Services, Inc. opted to wait until the spring of 1993 to purchase and plant the shrubs_ Health and Education Services, Inc. wishes to continue with this plan, which is only a part of an overall landscaping plan, for that particular area of the property. More shrubs will be planted against the building and the abutting fence. Health and Education Services, Inc. does not wish to violate the Historic Districts Act, nor is the agency willfully trying to avoid the Commission's conditions. Aesthetically, Health and Education Services, Inc. prefers to install a living fence and implores the Commission to allow us to wait until the spring planting season before finding us in willful violation of the Historic Districts Act.
