The second and third floor units are two bedroom condominiums. The first floor has been used commercially since the building was built in approximately 1880. It was originally a grocery store owned by J. Chandler. Today, however, a commercial use seems out of step with what the neighbors would desire for this property. It is thus my intention to seek approval to convert the unit into a two bedroom condominium. I have lived on Chestnut Street for 23 years and have been privileged to raise my children in a fabulous historic house in our wonderful neighborhood. However, two of my children are now in college and within a few years will have left the nest. My intention is to rent the unit for a few years until my older children are gone and then sell my house and move into 107 Federal Street. I own several other rental properties and take pride in maintaining them well. I choose my tenants carefully, require a minimum one year lease, a credit check, and references. I served for many years on the board of Historic Salem, Inc. and have a strong commitment to maintaining the historical character of the properties in our neighborhood. The exterior of 107 Federal Street shows numerous signs of neglect with much rotted wood, missing downspouts, etc. This is partially because the previous owners of Unit 1 had not paid their condominium fees in several years, so the remaining unit owners did not have adequate funds to maintain the building properly. Last week I delivered to the treasurer of the condo association a check for$5,300 for these past due condo fees. I will be working with the other two unit owners to undertake the exterior repairs necessary to make the building one in which the neighborhood can be proud. I will be seeking approval from the Historic Commission to replace the hideous aluminum framed plate glass entry door with a traditional wooden door similar in style to the other Federal Street entry door on the building. I will also remove the air conditioner that was built in above the entry door. The front windows of the building will remain, since they are original to the building and have considerable historic value. I am investigating whether a second pane of glass can be added to them to create insulated windows. If that is not technically feasible, I will install tasteful storm windows. I will seek approval to replace the window on the corner of Beckford and Federal Street since at some point, probably in the 1950s, a louvered window was installed above the traditional fixed window. The louvered window and the fixed window below it will be replaced with a traditional double hung window of a style consistent with the other windows in the building so that some ventilation can be brought into the property. There is an original door on the Beckford Street side of the property that was boarded up with plywood at some point. The plywood will be removed and a new fixed panel installed in the bottom of the opening and functioning two-leaf french windows installed above the panel. This will not be an entry door. In addition, a window will be added on the Beckford Street side to provide required light and emergency egress required by code for the bedroom that will be built in that area. This window will be designed to match the windows on the second floor. Also, a window on the back of the building that has been boarded up for years will be reopened. It is unclear whether any zoning approvals are necessary to affect this conversion of the unit from commercial to residential use because a residential use is considered a lesser use than a commercial use. However, it is my intention to seek approval for this change from the Zoning Board of Appeals so that there will be no question about whether proper procedures were followed. The unit has three parking spaces, two tandem spaces in the Federal Street driveway and one behind the building on the Beckford Street side. It is my belief that the changes I am proposing are the best possible outcome for the neighborhood because they will remove once and for all the possibility of a detrimental commercial use of the unit in the future. 1 I have previously relayed the above information to the president of the Federal Street Neighborhood Association, who shared it with the FSNA board, but I wanted to ensure that the entire neighborhood was made aware of it. However, at the Commission's meeting of March 1, 2006, the Commission voted that an egregious violation now exists because(1)work which is not consistent with what was approved has continued to be undertaken, (2) because this has resulted in inappropriate changes to important features which has a detrimental effect on the architectural features of this building, and (3) because thirty days have passed and you have neither returned the gutters/downspouts to their previously existing condition nor submitted an application for approval of new gutters. By voting that an egregious violation exists, the Commission may now proceed with the process which could ultimately result in a Clerk's Certificate of Vote being filed with the Registry of Deeds referencing your property. This would, in effect, act as a lien on your property, which may delay any potential sale. This is particularly significant since you have units for sale and the Commission believes strongly that all approved work to correct the outstanding violation should be completed before transfer of ownership, so that a new owner does not inherit the violation. If the work does not occur prior to a sale, a buyer would be well advised to have funds set aside in escrow to cover the estimated cost of the work, in order to ensure its completion. On or about July 11 , 1934, pursuant to his desire to convert the first floor of this building from a temporarily unoccupied store into two efficiency apartments , Mr. Bonardi appeared before the Historical Cormnission with his plans to convert. Mr. Bonardi requested that the commission send a letter to the Board of Appeals, to whom Mr. Bonardi would next have to bring his plans for approval , stating that the proposed changes to the exterior of the building met with the commission's approval . The commission voted to provide such a letter. At that time, a member of the commission, Mr. John Carr, brought a motion for the removal of a telephone booth located outside the building. This motion was not considered as it was not on the agenda. Mr. Bonardi agreed to appear at the commission's next meeting if the Board of Appeals approved his plans in order to fine tune his proposed alterations; however, the phone was not to be part of that next meeting. Since Mr. Bonardi 's first application to the Board of Appeals was denied, there was no need for hila to reappear before the commission. In any event, no date was set for such a reappearance. At a meeting held on or about 30 August, 1934, the commission considered and approved the removal of the telephone booth from Mr. Bonardi 's premises. The commission took these actions without first notifying Mr. Bonardi or any of his abutters or advertising in newspapers of its intention to transact said business relating to him. As a result of said actions, a letter from the commission to New England Telephone stating its decision, the telephone was removed from Mr. Bonardi 's premises without notice to him at any time. w Bonardi/O'Brien 4 October, 1984 Not only has Mr. Bonardi been deprived of a valuable property right without due process of law, but further Mr. Bonardi has now been placed in an awkward position. He is due to appear before the Board of Appeals on 17 October, 1984, on his petition for a Special Permit to convert the existing store into an apartment and a variance from density requirements. If his petition is denied, Mr. Bonardi will have no choice but to re-establish a grocery store on the pre- mises. Mr. Bonardi has the absolute right for such an undertaking. Customer access to a telephone while not necessarily essential , would be very important to the success of his venture. He has been informed that replacing the telephone booth could cost upwards of Fifteen Hundred ($1,500.00) Dollars. Mr. Bonardi very strongly feels that he should not be forced to bear the brunt of such a cost for the unilateral action taken by the city which has affected and will affect him, all having taken place without notice to him. Mr. Bonardi plans to be doing business in some capacity in Salem and is therefore hesitant to bring a suit against any municipal body, especially when said suit might become moot. Mr. Bonardi respectfully demands the immediate replacement of the telephone.
