He prepared,o apply for approvals well in advance ofcommencing any exterior work. Before making any changes to the exterior of a property in an historic district,the owner should call or visit the Commission representative at the Department of Planning&Community Development to discuss proposed alterations and to determine the category of the application(Appropriateness,Non-.Applicability or Hardship). B. 'The Commission normally meets on the first and third Wednesdays ofeach month and notices are posted at City Hall. The meetings are held at 120 Washington Street,3rd floor,and begin at 7:00 p.m. All meetings are open to the public and any person is entitled to appear and he heard on any matter before the Commission before it reaches a decision. C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in order to make the agenda An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the meeting. In some cases,a Certificate ofNon-Applicability may be issued by the Clerk,without review by the full Commission,after notifying Commission members and allowing 24 hours for any objection. There is no fee for any applications. D. All applications for Certificates of Appropriateness or I lardship require a public hearing. Notice of the hearing must be posted with the City Clerk 14 days before the hearing and abutters must be notified in writing. Commission staff will handle these procedures. A public hewing is not required for a Certificate of Non-Applicability. -• Applications must be submitted by the owner of the property. A contractor for the owner,at the owner's request,may submit an application on the owner's behalf. B. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City Hall. The meetings are held at 120 Washington Street,3rd floor,and begin at 7:00 p.m. All meetings are open to the public and any person is entitled to appear and be heard on any matter before the Commission before it reaches a decision. C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in order to make the agenda. An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the meeting. In some cases,a Certificate of Non-Applicability may be issued by the Clerk,without review by the full Commission,after notifying Commission members and allowing 24 hours for any objection. " I continue to oppose the granting of the request for a second floor balcony on the South side of the building at 103 Federal Street and wantzd to request that you not approve it. 1 am deeply disappointed that you did. Voting that evening on:he second submission of the proposal that had already been before you and which failed to pass places all homeowners in the H istoric District in double jeopardy and seems to me undesirable from the perspective of orderly procedure for the Commission itself. In the hopes that you would not vote,I prepared the following arguments that I hoped you would consider. The reasons not to approve the change were presented to you in the petition dated April 24,2013 which was signed by many neighbors and is summarized below: 1. A second floor balcony on the south facade of 103 Federal would be visible from a public way,specifically Federal Court which is both a street and a heavily travelled pedestrian way to&from downtown for residents and visitors. 2. A second floor balcony would not be contextual with the classic and non-ornamental architectural design of this eighteenth century home. Neither would such a balcony be contextual with a number of similar historic homes in the nearby vicinity. 5. There is no existing hardship that threatens the restoration and preservation of the 101-103 Federal Street building that would require the construction of a balcony to mitigate such a hardship. This 2-family home has a large backyard thatprovides ample opportunity to create private areas for outside enjoyment. The applicant has not presented any aherratives to the balcony proposal even though use of the backyard(as opposed to the balcony)is most consistent with the ways in which 2 family outdoor spaces are used throughout the area. 4. The granting of a"Certificate of Appropriateness"for the construction of a second floor balcony at 103 Federal Street could open the door for more similar requests. Such a precedent would surely threaten to change the streetscape and unique character of the Federal Street neighborhood and the National Register McIntire Historic District. I would like to add that I believe the developer has made changes not previously approved by the Historical Commission: The very wide fascia board he installed which is not appropriate to the house. - There have clearly been roof pitch changes made by the developer—otherwise he would not have said that now suddenly the roof requires a door in order to shovel snow from the roof-when such was not the case in the many years that the rear acdition has stood. - The unsightly 3 white vents on the blue clapboards on the east side of the house most visible to pedestrians and vehicles on Federal Street. At the earlier June meeting,the Historical Commission requested that the developer provide all requests for changes That had not previously been submitted and approved. So here it is (see attached). I forgot that the original reason that we had thought of the balcony was because the roof over the sunroom was twisted and distorted due to,we presumed, snow that would build up against the back face of the house. You can't really snow rake a flat roof! If we can at least get a door approved then they can go out there and clear it if they need to, but would be certainly safer and easier to shovel a balcony. Y' `+N'Q�yT � •f' �.�, a ;, _ IV( n I-= _ r � The Salem Historical Commission APRIL 24, 2013 City Hall Annex 120 Washington Street Salem, Massachusetts 01970 Dear Members of the Salem Historical Commission, As residents of the historic Federal Street neighborhood, we urge the Salem Historical Commission to deny the request by the developer and/or owner of 103 Federal Street to build a second floor balcony on the south facade of the building. J Our main objections to the construction of this balcony are as follows: 1 . A second floor balcony on the south facade of 103 Federal Street would be visible from a public way, specifically, Federal Street Court. ° Federal Street Court is a busy pedestrian thoroughfare. It is a quaint and aesthetic route leading to the Ropes Mansion Garden and the First Church. It is also a frequently used short cut to downtown Salm. A second floor balcony lies above the height of most hedges and fences making it visible from the street level. ° Photographs demonstrating the visibilty of the balcony site from a public way were submitted to your Commission on February 20, 2013. 2. A second floor balcony would not be contextual with the classic and nonornamental architectural design of this eighteenth century home. Neither would such a balcony be contextual with a number of similar historic hones in the nearby vicinity. Balcony furnishings, planters and constructed screeninq could produce a cluttered appearance that would create a visual focal point that would diminish the appearance of this home from a public way. 3.
