PROCEDURES FOR FILING APPLICATIONS

Dear Ms. Guy :
I have a copy of the June 25,2003 and July 2,2003 minutes of the Salem Historical Commission. I
would like to correct some of the statements attributed to me as reported in these minutes.In the July
2,2003 minutes I am quoted as saying,in paragraph seven of the first page ,that "...the proposal
seemed appropriate." What I recall saying was that "...the proposal seemed appropriate as long as
the large expanse of the facade facing my house was broken up by painting the trim a contrasting
color and installing shutters on all openings to reduce the amount of bright body calor." Also,I did
state that I was very concerned as we would be looking at the large expanse of bright color all the
time,from both our patio and house,as opposed to the occupants of the three condos,who would be
inside their house and not be looking at the color much of the time.
In addition,I recall making a request in both meetings referred to above,that the owners of 102
Federal Street paint a large swatch of the proposed colors prior to the actual painting of the entire
house,to test the effect of the color.

Dear Ms. Williamson and Messrs. Homan and Koopman:
Please be advised that I have been engaged by Ms. Cleary and Mr. Hart, your
neighbors at 104 Federal Street,with respect to the effects on the use and enjoyment of
their land as the direct and proximate result of the repainting of the structure where you
reside and which, apparently, you own individually or collectively.
I emphasize that my clients' complaint does not relate to your chosen color, as a
color,per se. Rather, the issue is the visual effects created by the choice of color given of
its reflective capabilities. Simply stated,my clients are substantially affected by a.
persistent reflection and glow from your building because of the paint and the building's
orientation towards the sunlight. The visual and physical intrusions on both the interior
and exterior of my clients' land are perceptible,tangible and invasive to their ability to
enjoy their property interests.
In short, it appears that the invasive effects of the paint are substantial and rise to
the level of an actionable nuisance under the law. This legal fact is in no way diminished
by the approval of the color by the City of Salem Historical Commission.
Accordingly, my clients hereby request, through me, that you, or your attorney,
contact me to discuss a reasonable resolution of the conflict. I will forebear from any
further action up to and including October 27, 2003. If I receive no satisfactory
communication on or before that date, I am instructed to seek to enforce my clients'

Dear Bob:
Over the several years that the Historical Commission has worked with you,
we have appreciated your enthusiasm for Salem and your commitment to a high
standard of renovation work. As a recognition for your accomplishments on
Derby Street, we were pleased to present you with a Salem Historical Commission
Renovation/Restoration Award in 1984. While your work on 100-102 Federal Street
has for the most part been up to your previous standards of excellence, we are
concerned about a few violations that detract from what otherwise would be a
commendable preservation effort.
Fitst, on the rear of 102 Federal Street, you had agreed to install a 30"
wide double-hung 6/6 window instead of a single narrow-paned window shown on
the plans. We have discovered that the narrow window was actually installed.
At 100 Federal Street, we are concerned about the stockade fence to the
right of the driveway. The fence we approved at our May 2, 1984 meeting was a
standard flat board fence with a cap. When the stockade fence was installed,
we then recommended that the first four sections be replaced with a capped
flat board fence, that the posts be boxed and have caps, and that the back
cross rail be flat rather than rounded. To date, no action has been taken.
Also, the proposed fencing between the houses and to the left of 102 Federal
was never constructed, leaving the electric meters on the rear of 11102 exposed.
In the past, we have had a successful working relationship with you which
we hope will continue, but we cannot allow violations of Certificates of Appro-
priateness to go unnoticed. We would like you to correct the problems at 100-102
Federal Street as soon as possible.
