NOTICE OF DENIAL OF APPLICATION FOR A CERTIFICATE OF
APPROPRIATENESS
RE: 86 Federal St.
On Wednesday, September 7 , 1994 , the Salem Historical Commission
voted on a motion to approve the installation of landscaping
timbers (as already installed) above the granite on the front of 86
Federal Street. The motion was denied by a vote of three in favor
and four opposed.
The Commission further voted, by a vote of five in favor and two
opposed, to instruct the Clerk of the Commission to file a Clerk' s
Certificate as to Violation, referencing the property title, at the
Essex South Registry of Deeds.

Dear Mr. & Ms . Felt:
In May and October of 1993, the Salem Historical Commission
wrote to you concerning a retaining wall constructed without prior
approval at 86 Federal Street. This was followed by a letter to
the City Solicitor in February, 1994 requesting the commencement of
enforcement. In March, 1994, the Commission received a letter from
the City Solicitor stating that he was contacted by Mr. Felt, who
informed him that "they are going to remove the wooden retaining
wall in the spring" . His suggestion at that time was to "do
nothing and see if he does remove it in the spring" .
Spring has now come and gone and the retaining wall still
remains . We would respectfully request that the wall be removed by
August 1, 1994 to avoid impending legal enforcement.

NOTICE OF DENIAL OF APPLICATION FOR CERTIFICATE OF APPROPRIATENESS
On Wednesday, October 5, 1983, the Salem Historical Commission voted
unanimously to deny the application for a Certificate of Appropriateness
for construction of a brick shrubbery enclosure at 86 Federal Street.
This vote was based on the the Commission's finding that such construction
would be incongruous to the historic aspects and architectural characteristics
of the surroundings and of the McIntire Historic District. In this finding,
the Commission considered the architectural value and general design of
the building and the relation of such features to similar features of
buildings and structures in
the surrounding area.

Dear Mr. Felt:
Thank you for your application for a brick shrubbery enclosure at
86 Federal Street. This application was reviewed by the Commission
at our meeting of October 5. At that time, though the Commission
applauded your concept of landscaping in front of the building, they
found several problems relating to the use of a brick wall at that
location.
As you know, the granite footing, existing and as replaced by you in
concrete, served originally as the base of a fence, undoubtedly in iron.
Historically, this was the typical treatment along the street for houses
set as yours is. Brick does not appear in old photographs/drawings/plans
as you propose it, and the Commission's finding was that to introduce
this element would be incongruous to the district and historically
inappropriate. For that reason, your application was denied.
As you reconsider plans for the shrubbery area, you may want to consider
simply_ retaining the granite with the shrubbery behind or, if an enclosure
is still 'Preferred and as iron is not readily available, a solution in wood
fencing might be developed.
Please contact the Commission if we can be of assistance to you. We
look forward to working with you further on this project or as you proceed
with your renovations.
