De Mayo, Vice President Diana McIver and Associates, Inc. 5100 Bee Caves Road Austin, TX 78746 RE: Section 202 Housing Project, 403, 405, 405 1/2 Essex Street, Salem, MA (MHC# 9651) Dear Ms. De Mayo: Thank you for supplying the Massachusetts Historical Commission with the additional information concerning the proposed HUD-assisted housing project referenced above. These materials were received on July 26, 1996. The project locations are eligible for listing in the National Register of Historic Places and are located in the McIntire Historic District which is listed in the State Register of Historic Places and is also a Local Historic District. MHC staff are in receipt of the Americans with Disabilities Act Consultation Form you submitted which has been signed by the local historical commission and the local handicapped advisory committee. MHC staff have reviewed the ADA Consultation Information as well as the project plans previously received. It is understood from these plans, dated April 8, 1996, that the renovation project will involve exterior masonry repointing and stabilization, limited in kind replacement of wood trim, and the installation of a universal access ramp. The proposed plans call for an alternative path of travel to the building, rather than through the primary entrance. This project involves creating an unassisted accessible ramped entrance for people with disabilities at the rear entry. MHC has determined under the consultation procedures that compliance with the General Rule of the Americans with Disabilities Act (Title 11 28 CFR 35.151) would potentially threaten or destroy the historic significance of this building. MHC staff agrees that Title 11 28 CFR 151 (d)(2)(3) may be used because of the existing architectural constraints associated with the primary entrance. After review of this information, I concur to a finding of no adverse effect for this action (36 CFR 800.4(c) and 950 CMR 71.07 (2)(b)(2)) provided the following condition is met: The project proponent will submit an application for a variance to the Massachusetts Architectural Access Board (MAAB) for approval. 220 Morrissey Boulevard.Boston,Massachusetts 02125 • (617) 727-8470 Fax:(617) 727-5128 TDD: 1-800-392.6090 These comments are provided to assist in compliance with Section 106 of the National Historic Preservation Act (36 CFR 800) and M.G.L. Chapter 9, ss. 26-27C, as amended by Chapter 254 of the Acts of 1988 (950 CMR 71.00). A copy of these materials should accompany material submitted to the Advisory Council on Historic Preservation, The Old Post Office Building, 1100 Pennsylvania Avenue, NW, #809, Washington, DC 20004. After reviewing the architectural drawings, the Massachusetts Historical Commission's (MHC) report and the findings of our local historic district commission, it is our understanding that the project will comply with all Architectural Access Barrier Board specifications except for the placement of an access ramp to the rear of the building. We concur with the MHC findings that constructing a ramp at the front entrance of the building would threaten the historic significance of the building. We support this project and applaud your efforts to.create universal access. Please let us know if we can be of any assistance. Sincerely, Sarah G. The property referenced above is eligible for listing in the National Register of Historic Places and is also located in the McIntire Historic District which is a Local Historic District. The Salem Historical Commission will also need to be notified as they have jurisdiction over this historic district. MHC staff have reviewed the project description including project plans dated April 8, 1996 and prepared by Jaquith and Siemasko, Inc. MHC staff are currently unable to complete our review of this project. The project will involve the construction of a universal access ramp at the rear of the building. Please be aware that under ADA regulations an explanation justifying access other than through the primary entry is required. Alternative access requires fulfillment of the ADA Consultation Process. Enclosed you will find an MHC ADA Consultation Form and cover letter. Please complete this form and submit it with the other materials requested. With this additional requested information, MHC staff will be able to determine what effect the proposed project will have on the surrounding historic district. These comments are provided to assist in compliance with Section 106 of the National Historic Preservation Act of 1966 (36 CFR 800). If you should have any questions concerning the completion of the ADA form, please contact William Smith at this office. Thank you for your cooperation. Sig erred,, Paul A.
