Dear Ms. De Mayo:
Thank you for supplying the Massachusetts Historical Commission with the additional
information concerning the proposed HUD-assisted housing project referenced above. These
materials were received on July 26, 1996. The project locations are eligible for listing in the
National Register of Historic Places and are located in the McIntire Historic District which is
listed in the State Register of Historic Places and is also a Local Historic District.
MHC staff are in receipt of the Americans with Disabilities Act Consultation Form you
submitted which has been signed by the local historical commission and the local handicapped
advisory committee.
MHC staff have reviewed the ADA Consultation Information as well as the project plans
previously received. It is understood from these plans, dated April 8, 1996, that the
renovation project will involve exterior masonry repointing and stabilization, limited in kind
replacement of wood trim, and the installation of a universal access ramp. The proposed
plans call for an alternative path of travel to the building, rather than through the primary
entrance. This project involves creating an unassisted accessible ramped entrance for people
with disabilities at the rear entry.
MHC has determined under the consultation procedures that compliance with the General Rule
of the Americans with Disabilities Act (Title 11 28 CFR 35.151) would potentially threaten or
destroy the historic significance of this building. MHC staff agrees that Title 11 28 CFR 151
(d)(2)(3) may be used because of the existing architectural constraints associated with the
primary entrance. After review of this information, I concur to a finding of no adverse effect
for this action (36 CFR 800.4(c) and 950 CMR 71.07 (2)(b)(2)) provided the following
condition is met:
The project proponent will submit an application for a variance to the Massachusetts
Architectural Access Board (MAAB) for approval.

Thank you for the information you submitted, received May 20, 1996, concerning the proposed HUD-assisted
housing rehabilitation at the location referenced above. The property referenced above is eligible for listing in
the National Register of Historic Places and is also located in the McIntire Historic District which is a Local
Historic District. The Salem Historical Commission will also need to be notified as they have jurisdiction over
this historic district.
MHC staff have reviewed the project description including project plans dated April 8, 1996 and prepared by
Jaquith and Siemasko, Inc. MHC staff are currently unable to complete our review of this project. The project
will involve the construction of a universal access ramp at the rear of the building. Please be aware that under
ADA regulations an explanation justifying access other than through the primary entry is required. Alternative
access requires fulfillment of the ADA Consultation Process. Enclosed you will find an MHC ADA Consultation
Form and cover letter. Please complete this form and submit it with the other materials requested. With this
additional requested information, MHC staff will be able to determine what effect the proposed project will have
