You are absolutely correct that the Commission reviewed this fence through an application from the Bachman's for 376 Essex Street back in 2004. I apologize for not thinking to check your neighbor's file prior to issuing the Notice of Violation letter to you. I have enclosed a copy of the approved fence Certificate. Please note that if you are planning on keeping the fence at the height as is currently constructed, you will need to apply for an amendment, as the previously existing fence matched that height of the front green fence. In addition, you will need to add additional boards so that the fence abuts the post at the comer. Since the Certificate expired in April, 2005, at the October 19th meeting, the Commission extended the Certificate for all fence work to be completed by July 19, 2006. Once again, I apologize for our mistake. Right after we spoke, I sent off an email to the Historic Commission members(I will forward you a copy after I send this). I have attached a PDF of the 1996 survey form (with no balustrade), as well as the front page of the 1976 form(with a balustrade whose details cannot clearly be seen). However, there is a picture of the house with the balustrade in the Bryant Tolles' book Architecture in Salem. The photo would have been taken no later than 1982. 1 scanned the page and attached it, as well. I hope your second impression of the Salem Historical Commission is better than the first. There are some very professional volunteers on the board, who could work with you to help identify similar balustrades and/or carriage houses in Salem. Specifically, Vice Chair Jessica Herbert(978-594-5922), who is a local developer, and architect David Hart (978-745-2172). Again, my apologies...and thank you for your graciousness in responding to our error. -Jane Jane A. We purchased the house at the end of 2009, and the balustrade was not in place at that time. The previous owners were fairly certain that it had been missing for decades, even as they tried to find good sources for the 3/23/2010 Page 2 of 2 design of a historically accurate replacement. As your files indicate, the picture taken in 1996 shows the feature missing. I don't recall what you said about the 1976 photo, except that it was not a very good image and probably not helpful in identifying the correct design. A quick check of the files prior to the issuing of a cease and desist notice would have saved both of us,what I feel was an unnecessary and unfortunate introduction to the Historic Commission. We are not only supportive, but enthusiastic about our responsibility to be active and faithful stewards of the Clarence S. Clark House. Upon purchase of the property, I had already begun the process of researching neo-colonial balustrades and looking for other properties in the neighborhood that might have similar architectural features. I have also understood that resources on the property may exist at the PEM. I look forward to following that lead and others as we work over time to implement historically accurate upgrades to this wonderful property. Our previous home, an antique at 12 Kent Street in Scituate, was constructed on one of the fust 12 granted parcels in the village in the early 1600's. The land having been occupied continuously since the fust settlers, we had our home fully researched and documented. We recently proudly installed the historic plaque on the house after an incredible effort on the part of the Town Historic Commission to cross-reference tax, census, and building design records for the property. My guess is that installing a plaque at 376 will be easier given how much is already know about the house. I have read about the process in Salem on your web site and look forward to initiating that effort in the future. In the meantime, rest assured that we intend to do what we can to discover what the balustrade on our entrance porch originally looked like and have it replaced. I look forward to the opportunity to work with the Commission, seeking its advice and approval when I am confident of a correct design. In the meantime, as we agreed, you will correct your records to remove the erroneously issued notice of violation. Again, thank you for your advice and for the conversation. He just purchased this house about a month ago and the railing we sent him a violation notice for has been gone for over 14 years! I accept the blame for this as I should have checked my photo file before sending a violation letter....however, I had assumed since you live just 5 houses away that you were confident that the railing had been recently removed. Thankfully, Mr. Immerman took the high road and was very nice about our goof and our too quick to react"welcome to salem, now cease and desist' letter. Going forward, if anyone wants to report a violation, there are 2 ways I would like to handle it: • if the work is actively being done(contractors on site), call me right away, I will check the file for a Certificate and, if none, will send the building inspector out there to stop trie contractors. • for all others (non-active), please take a photograph of the property and email it to me with the address of the property and indication of what you think is in violation. I will check your photo against the file photo and bring it up at the next meeting. If you don't have a digital camera, let me know and I will try to get out to the site before the next Commission meeting. Thanks! -Jane Jane A.
