The proposed pmjeet is to protect and preserve the weather envelope of the library by conducting the ordinary
maintenance of repairing or replacing the extet`_or wood surrounding the windows of the library that have
deteriorated from age and weather. The work does not involve a change in design, material,color, or outward
appearance of the structure. The CPA awarded the Library a grant for the project in FY 16.
The project was designed by the Library's architect,Robert Farley, and consists of restoring select Library window
sills,wood window jambs, and wood window trim mouldings to good condition,utilizing repairs or replacements.
Western Red Cedar or Mahogany wood will be used, depending upon availability. When new wood elements are
installed, back priming of all surfaces will be done prior to installation. All exterior mouldings and exterior wood
surfaces will receive new paint finishes: 1 coat of approved primer and 2 coats of approved finish coats of green
color to match the original finish.

SECTION 01010
SUMMARY OF WORK
1. GENERAL SCOPE OF WORK
A. The Work under the Contract consi>ts of:
1. Removal of bricks, stone, wood, mortar, metal, etc. as indicated.
2. Disposal of removed materials in accordance with all local codes and regulations.
3. Cutting existing brick joints to the required depth and repointing with colored mortar as
specified.
4. Cutting existing stone joints and grouting with new colored grout as specified.
5. Installing new brick-work and stone-work where indicated.
6. Washing down all masonry wort following re-pointing and installation of new materiais.
7. Cleaning all exterior glass after completion of the work.
8. Removal of grey green deposits on existing stone work.
9. Repair of existing wood trim at stair enclosure above rear roof and re-paint.
10. Remove existing sealant and install new sealant at stone joints where indicated.
11. Alternate No 1: Remove sealant at perimeter of all existing exterior windows of the building
and install new backer rod and sealant.
Alternate No 2: Scrape and paint existing wood roof cornice at all sides of building.
Alternate No 3: Scrape and paint existing steel window frames at glass block windows at
Rear Wing.
B. In addition, the Work under the Contract includes:
(1.) Work outside the Project Site as called for in the Contract Documents and as required for the
performance of the Work.
(2.) The restoration of any items damaged or destroyed by encroaching upon areas outside the
Project Site.
(3.) Providing and restoring, where appropriate, all temporary facilities.
F. REPAIR OF CRACKS
1 . Fine Cracks: Install sealant as recommended by the
sealant manufacturer. Dust immediately after application
with brownstone dust to match adjacent stonework.
2. Larger Cracks: Seal surface of crack with non oily clay tc
prevent leaks. Inject adhesive grout using a 60 m. m. (2
oz.) single -use syringe designed for use by veterinarians.
Finish the exposed surface to match the adjacent stone.
3. Pin and Grouting: Seal cracks with non-oily clay to prevent
leaks. Drill staggered rows of holes, (max. diameter %")
through the face of the stone. Fill holes and cracks with
adhesive grout. Insert pins and counter sink. Diameter
should be 1/8" smaller than the hole. Patch the holes with
plastic repair Custom System 45 to match adjacent stone.
G. REPAIR OF DETERIORATED STONEWORK;
1 . Plastic Repair: Cut back deteriorated stone to clean
sound surface. Prime surface as recommended by the
manufacturer. Install mechanical keys and wire lath for
deep repairs. Apply System 45 as recommended. Mix only
as much material as is required for immediate use. Trowel,
brush , spray or casting are all acceptable application
techniques to achieve the desired finish. Final surface shall
match the adjacent stone color, texture and configuration.
Do not apply at temperatures below 50 F. or when
temperature will drop below 50 F. prior to thorough drying or
as recommended by the manufacturer. IN hot or windy
conditions, delay drying by applying water mist or wet
burlap for at least three (3) hours after application.

Remove existing 28 feet of landscape timber retaining wall on right side of walkway
to Library's ground level entrance. Install custom cut,new granite curbing as new wall.
Existing wall is about 11-13"tall. New granite wall will be slightly higher by one to
three inches in order that each end of the new wall will meet the level of the existing
walls at either end. The granite for the retaining wall and the curbing will be laid out
in three foot lengths.
Remove existing 34 feet of landscape timbers lining the left side of walkway. Install new
custom cut granite curbing sitting above the grade of the walkway by a couple inches.
Curbing will be six inches wide to match other side.
The new granite is Caladonia. It will be custom cut on all sides,thermalled on the top,
front, and top few inches on the back.

Dear Ms. Simon:
The Salem Historical Commission is pleased to send this letter in support of the Salem Public
Library's application for a Massachusetts Preservation Projects Fund Grant. The Library is
located within Salem's McIntire Historic District. Of High Renaissance Italian design, the
building was constructed in 1855 as the home of Captain John Bertram. Upon his death, the
building passed to the City of Salem, and has been the home of the Salem Public Library since
1889.
The Library's roof is in poor condition and badly needs major repairs. The project will replace
the original slate roof and repair and restore the copper balustrades on both the upper and lower
roofs. It is vitally important that this work be done,both to maintain an historic and important
Salem structure but also to assure that the library's outstanding and historic collection will not
suffer water damage.
The Salem Public Library is an excellent library, active and heavily used. The Salem Historic
Commission has approved this project and is glad to lend its voice in strong support of this grant.
We hope you will look favorably on this application.

Salem Public Library Roof Repairs Narrative
We propose to perform the following repairs to the existing hip roof of the Salem Public Library:
1. The present three skylights located on the rear roof plane are in poor condition, leaking and
in need of replacement. The skylights were apparently installed to provide light to the attic
space. The installation of new lighting however make the skylights no longer necessary. We
have no early photographs to determine if they were part of the original construction,
there is evidence however that the openings were cut in after the roof was constructed.
I would venture a guess that the skylights were added during the 1888 conversion from a
residence to a public library.
Given the fact that the skylights offer little architectural significance to the Italianate style
and they no longer perform a necessary function and are in need of replacement,the library
trustees request the commission review the evidence and approve the request for removal.
2. The present flat seam copper roof is in poor condition and should be replaced. In lieu of
copper we recommend installing 60 mil EPDM rubber roofing.This material can be
installed with possibly two seams for the entire roof. This will reduce the chance of leaks
considerably and is a more economical installation.The roof is not visible from street level
with the exception of the copper edge flashing below the balustrade. This edge will be
replaced with new 16 ounce copper to match the existing.
3. The slate roofing has some cracked and missing slates. These will be replaced with new
slates matching size and color as close as possible.
4. The present copper balustrade has some open seams allowing water to enter. These seams
will be closed and re-soldered. Some will be patched and soldered with new copper. We
will attempt to hasten oxidization to match the green color of the existing copper.

The Salem Historical Commission, by unanimous vote at its September 7, 1988
meeting, strongly endorses the Salem Public Library's request for a variance from the
Salem Building Inspectors requirement that the main stairway in the Library be enclosed
to render it fire rated.
The said stairway is one of the most significant and intact interior features of this
building, itself an important contributory structure in the McIntire Historic District.
Enclosing this stairway would destroy a cultural resource that would otherwise bring
enjoyment and enrichment to future generations of Salem residents. In addition, the
fireproofing would be historically inappropriate and detract from the authenticity of this
museum quality building.
It is for these reasons that the Salem Historical Commission urges the State Building
Code Appeals Board to approve the varance to let the stairway stand as is.

Dear Mr. Cloherty:
At its meeting of March 6, the Salem Historical Commission completed review
of the plans for renovation of and additions to the Salem Public Library. We
are pleased that with your cooperation throughout the review process, we were able
to reach mutually satisfactory solutions to those design elements which originally
were of concern to our Commission. Final issuance of the Certificate of Appropri-
ateness on the Library application is, however, as in all cases before the Commis-
sion, contingent upon proper abutter notification. According to Massachusetts
General Law, Chapter 40C, the Commission must either hold a formal public hearing
or, if it elects not to do so, notify abutters by mail of an application before
the Commission. Abutters then have a 10-day period to request to come before the
Commission to be heard on the application. Should an abutter raise important
issues- of architectural compatibility, the Commission has the option of reconsider-
ing its vote. Otherwise the vote is confirmed.
In this case, several abutters did respond and were placed on the agenda for
our meeting of April 3. At that time a number of issues were explored, and the
Commission felt the need for more information before confirmation of the vote to
approve. Questions related to: whether the elevator has been moved; existing
available space and code violations; and status of the four-story addition before
the Board of Appeals.
The Commission requests that the Library meet with them at our meeting of
April 18th. The meeting will begin at 7:00 p.m. at One Salem Green. I am confi-
dent that at that time any concerns can be successfully resolved, and again
appreciate your cooperation.

We are in receipt of your letter dated February 10, 1989 together with
a copy of the legal opinion prepared by Mr. O'Brien in connection with the
stairway roof enclosure.
We appreciate your keeping us informed of your planned appeal from the
Building Inspector's decision, and we await what we hope will be a
favorable outcome.
As you know, we have over the last several years worked hard with you
and the library trustess in an effort to arrive at mutually acceptable
solutions to the library's need for expansion and we think we have been
successful in this regard. Should the need arise, we remain committed to
working with you and the library trustees. However, we respectfully
disagree with Mr. O'Brien's opinion that the library would not have to
reapply for a Certificate of Appropriateness or a Certificate of Hardship
in the event that the planned appeal is unsuccessful.
Our position is that the Commission did in fact act on the application
on the Certificate of Hardship within the sixty (60) day period, and that
if it turns out that for one reason or another what we approved cannot be
built, then it is incumbent upon the library to reapply.

By letter dated January 25, 1989 you have requested
my opinion of several questions which have arisen due to
conflicting directives from the Building Inspector and
Historical Commission relative to the materials composition
of the book stack roof rear egress appurtenance of the Phase
II exterior changes to the Library. Specifically, you have
asked the following:
In light of conflicting instructions,
is the determination of the Building
Inspector final, and may we therefore proceed
with our orignal copper design as approved
initially by him?
Or, given this determination of
noncompliance of glass, must we now appear
anew as petitioners to the Historical Com-
mission for some alternative approval?
And, should it be necessary for
us to appear anew as petitioners to the
Historical Commission for some alternative
approval on this item, are then any and/or
all other approvals voted at Commission
hearing on January 4, 1989 and continuance
on January 18, 1989 subject to being reopened
by the Commission?

First, Chapter 143 , Section 3 of the General Laws vests
with the Building Inspector authority to issue or refuse
building permits. Without going into Chaper 143 in detail,
the bottom line is that the Building Code as interpreted
by the Building Inspector governs the composition of building
materials.
Secondly, in my opinion, there is no legal compulsion
to again appear before the Historical Commission. General
Laws Chapter 40c §11 provides that the Commission must make
a determination on an application within 60 days of the filing
of the same. In the instant case, the original application
was filed on November 27 , 1989 and a final determination
was voted by the Commission on January 18, 1989, well within
the statutory time frame. However, for the reasons stated
in the previous paragraph, when there is a conflict between
the Building Inspector and other municipal authorities relative
to building materials and permits, the Building Inspector
controls. As 60 days has expired since submission of the
original application and the Building Inspector has determined
that the glass construction voted by the Commission is not
appropriate, the copper construction as originally petitioned
has been approved by virtue of the operation of general laws
Chapter 40c §11. However, from a public relations standpoint,
it would be better to reappear before the Commission to obtain
approval of the copper design or an acceptable alternative
if the same will not interfere with the Library' s bidding
process timetable.
Lastly, as I stated above, there is no compulsion for
the Library Trustees to appear anew as petioners. However,
if the trustees reappear before the Historical Commission,
that appearance would be solely limited to the issue of the
book stack roof rear egress appurtenance.

you that I withdraw our Application to the Salem Historical Commission which
petitions for a new hearing regarding the Salem Public Library stair enclosure
on the high rear book stack roof, the hearing date of which was scheduled for
February 15, 1989•
We want you to know that it is our intention to fully comply to the extent
allowed by law with the Commission vote of January 18, 1989 as described in the
Certificate of Appropriateness dated February 7, 1989•
To this end, we have already filed an Appeal Application with the State
Building Code Appeals Board requesting an interpretation of the Building Code
that would permit construction of the stair enclosure on the high rear book
stack roof with glass sides as the Commission voted, notwithstanding the
communication sent to us by the City Building Inspector dated 1/24/89 which
disapproved the glass enclosure. Should the Building Inspector's interpretation
of the Code be upheld by the Sate and the glass sides disallowed, then the copper
construction as originally petitioned would be built (City Solicitor to Library

We shall report to you promptly the determination of the* State Building Code
Appeals Board, once made.

As we have discussed dur_ng the plan review for the Main
Library building, in order to utilize the third floor two (2)
means of egress must be provided as required under Article 22,
Section 2200:4 of the Massachusetts State Building Code.
I am aware of the histor_c significance of the library
building and have spent considerable time with your Architect,
Robert Farley, in an attempt to serve both the interest of public
safety and at the sime time make these building modifications
less offensive to the Historic Commission. I believe we have
succeeded in both with the present plan showing the roof egress,
walkway and railings, and egress entrance to the new stairway
in the old book stack area.

With regard to the petition currently before you for work at the Salem
Public Library, 370 Essex Street, tte Salem Historical Commission is most
concerned that no resolution of the parking problem there impact on the
library's side yard and fountain. These elements are integral to the site
and architectural expression of this High Renaissance Italianate building,
setting it off grandly and graciously as befits its studied formalism. .
The negative impact which parking on this site would have on the architec-
tural integrity of the building and on the historic character of the Essex
Street neighborhood would be a loss for all of Salem.
Our Commission would strongly oppose any proposal to provide parking
that disturbed fhe fountain and fenced yard. Please feel free to contact
the Commission if we can be of any assistance to you as you study this .

Sorry I missed you the other day when you were here.
Here's a new story; or really a new chapter in an
old story:
Fri . 3/27 at 10:00 a.m. your Becky Curran has agreed
to meet with Farley and me re: landscaping plans,
BUT, in addition to general planning, we shall be
planning to comply with a Superior Court "Stipulation"
with neighbors Connolly and Hale (copy enclosed) in
which we agreed to do certain plantings and, as well ,
fence construction. Interested?? I thought so! !
At this point Farley and I haven 't even thought
about fences yet -- but we' ll have to.
Perhaps we can set up a meeting for next week or
after to talk "fences" if you'd like to be involved
in the planning. Or, perhaps you'd like to join us
with Becky on Friday if you can.
At any rate I look forward to seeing

Library Trustees have voted to appeal to the state Building Code Appeals
Board a decision of our local Building lispector regarding his interpretation
of the Code which would require that the Library's historic nineteenth-century
main staircase be fully enclosed and fully fire-rated from first to second
floor. Library plans for Phase II do provide for such an egress at another
location in the building.
Library Trustees wish to be able to preserve and restore this historic
stair for aesthetic enjoyment and enrichnent of generations of Library users
to come, while providing a modernized and safe facility.
Your support, Annie, and the support of the Salem Historical Commission,
would be most helpful to us in our preservation efforts at our upcoming state

that Farley had suggested setting back the wall 6 - 12 inches. I could
find no other reference to the dimension of that setback; so, I would
assume that six inches is o.k. Thanks for the time you spent to help

Mr. Padjen said that presented another kind of security problem. Members sug-
gested that the Monroe Street side might be better served using a regular fer-ce,
possibly a regular picketed fence with a cap. Distance across the lawn from
the sidewalk and into the area of the courtyard makes it a fairly long view.
The question of whether the berm should be extended toward the brick wall
at the front of the building was discussed, but members felt it would be pre-
ferable to keep it in front of the main portion of the house $area as it is at
present. Mr. Clarke suggested pushing the brick wall back from the front
facade, and having it begin at the back of the quoins. Most members agreed with
this idea which would allow the main house to stand slightly apart from the
wall; however, Mr. Farley felt the area of the quoins was too far back. He sug-
gested going back six to 12 inches. Ms. Hilbert said she thought Mass. Histor-
ical would be in favor of the idea since it would preserve the outline of the
original part of the house. The wall would then look more definitely like an
addition, which is preferable.
Mr. Clarke noted that if a simpler, type of steel fence is designed for the
Monroe Street side, the doors in the courtyard would be more visible. Mr. Far-
ley is to consider redesign and come back to the Commission.
The next item discussed was the front portico which will be fully restored.
Column shafts have been plastered over. They plan to remove shaft from the tap
of base molding to underside of capitol and replace with new carved brownstone
.` shaft with proper fluting. Balustrade needs restoration work. Other carpentry
will be done as required. The doorway will be fully restored to its original
look. The doors will probably be refinished. Mr. Farley sakd the front
facade of the building with brownstone window surrounds is deteriorating badly.
They plan to survey to determine which need to be replaced, and will try to
match as closely as possible. Ms.. Hilbert asked about leadtime required.
Mr. Farley said if material is ordered from England it would take at least
eight weeks. He mentioned that there is a firm in Quincy which could provide
the stone, though it would require carving. The brickwork on the entire build- .
ing is to be repointed. The bracketed cornice which is made from wood will
be repaired and scraped down and repainted. The slate roof needs patching and

that will be done. Regarding the new elevator shaft, Mr. Farley said he isn't
able to match the brick which is on the building now, but has found one which
is pretty close. They are experimenting with test panels trying different
mortar colors and tooling to try to get the color as close to the existing as
possible. There is a problem with coursing and jointing which they hope to
solve by doing several test panels. Members of the Commission will be able to
examine the test panels when they are ready. Mr. Carr spoke about the look of
the solid wall of brick which is to be the new elevator shaft. He asked about
the possibility of a recessed panel in the center of that area. Mr. Farley
said though the shaft would be seen from an angle, he agreed that the idea of
a recessed area would be possible and would reflect the quoining on the main
part of the building somewhat. Mr. Padjen asked about ventilation of the
elevator shaft. Mr. Farley said it would be on the roof. Mr. Padjen suggested
finding a way to keep it off the roof and placing it on the backside hidden by
louver, even though it might be slightly visible from Federal Street.

An update --
. . . this Thursday the Salem Evening News will be running official notice
of the formal bidding process for the Main Library rehabilitation
project. Sub-trade proposals are due 3/25 and bids from general con-
tractors will be received 4/4. Work should commence in May, and will
last ten months. When I receive printed Plans and Specifications at
the end of this week, I will have a final set sent to you.
T. Ford Co. of Beverly has received from City Solicitor Michael 0"Brien
the Purchase and Sale Agreement for the South Branch property, and we
await their signature and deposit, at which time they will apply to
appear before the Board of Appeal as purchaser-under-agreement.
Gerry, I want to thank you for the personal assistance and support
that you have extended to the Library throughout your tenure as Planner,
as well as for the generosity you have shown in allowing the time for your
staff to work with us on so many occasions when we have needed their advice.

Commission has offered Library
Trustees support for their plans
to renovate the main branch of
the public library.
According to library Director
Patrick J. Cloherty, the com-
mission last week OK'd the pro-
posed exterior work for the
trustees' $1.3 million project,
which is designed to provide
emergency repairs to the
crumbling building, as well
make the structure accessible to
the handicapped.
A larger obstacle for the
trustees may be receiving ap-
proval from the Board of Ap-
peals.When the matter came up
before the board several weeks
ago, it was continued after a
large number of neighbors
showed up to voice concerns.
The trustees will attempt to
ease those concerns in a meeting
with residents Wednesday at 8
p.m. at the library.
Cloherty said among the
points agreed to in hearings
before the Historical Commis-
sion, are that the wooden
moulding casings of the present
windows be preserved. Only the
moving sashes will be replaced,
thus maintaining the building's
historic appearance.
Also agreed to was that the
front brick wall of the library
courtyard have a capstone on
the top to match the building
brownstone. In addition, agree-
ment was reached on a fence
style for the Monroe Street side
of the courtyard.
Cloherty said the commission
offered approval on two other
points that have been brought in-
to question by neighbors. One
was the intention of trustees to
maintain the greenspace and the.
1855 Victoria fountain at the cor-
ner of Munroe and Essex
streets, rather than convert it to
parking.
Residents have been concern-
ed the proposed expansions, :.
coupled with closing of the other
branches, will pose a parking
problem in the area. Among the
variances the trustees will need
for their plan is one exempting
them from parking
requirements.
Cloherty said the commission
also supported the trustees on
their reluctance to bring the new
addition to the library out front,
rather than at the rear northeast
corner. The addition is designed
to make room for a ground floor
children's area.
Cloherty said changes re-
quested by the commission
would probably cost trustees
several thousand dollars over
their original plans. But he said,
"We have no complaints. We
think things have gone very
well. We feel there's been no in-
terference with the functional
aspects of our planning, which
was our prime consideration."

'Members of the Historical Commission might
want to reexamine their methods of doing
business. The other night, 11 members of an ad
hoc committee that has formulated plans for a
Salem "Freedom Trail" sat in the audience for
more than two tours before the commission got
around to taking up their proposal.
While the committee members sat waiting,the
commission proceeded through a lengthy hear-
ing with neighbors concerned about the proposed
renovations to the public library.It then went on
at a snai_'s pace through several minor building
projects of interest to no one in the room but the
owners and the board.
The commiss'ion's behavior was downright
'rude. At the very least, it could have informed
the committee members early on that their issue
would not be taken up till well after 9:30, allow-
ing those who m'_ght have had other things to do
to leave and come back. Better still, it should
make clear in advertizing a meeting when each
issue is to be addressed.
We were also puzzled that the commission saw
fit to discuss the pians of the library trustees
without having invited the trustees to the
meeting. The commission has now met with
trustees one meeting and neighbors at another:;;

A hearing on this petition was held February 20, 1985 and continued until March
20, 1985 with the following Board Members present: James Hacker, Chairman;
Associate Member Richard Bencal, Acting Secretary; Messrs. , Gauthier, Luzinski and
Strout. Notice of the original hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The petitioner has requested a Special Permit from density and setback requirements
and a Variance from parking requirements to allow rehabilitation and the construction
of an addition at 370 Essex St. in an R-2 zone.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this
Ordinance, the Board of Appeal may, in accordance with the
procedure and conditions set forth in Section VIII F and IX D,
grant Special Permits for alterations and reconstruction of
nonconforming structures, and for changes, enlargements,
extension or expansion of nonconforming lots, land, structures,
and uses, provided, however, that such change, extension, en-
largement or expansion shall not be substantially more detri-
mental than the existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests;
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health ,
The Board of Appeal, after consideration of .the evidence presented at the pjblic
hearing, makes the following findings of fact:
1 . The building is in disrepair and is in dire need of the
proposed renovation;
2. The building in its present state is not accessible to the
handicapped residents of the community and area;
3. The proposed single story addition will greatly enhance the
usage of the facility thus serving the public good;
4. Tremendous support for the plans was shown by neighbors, abutters
and other residents of the City and area;
5. Opposition to the addition to the building was presented by some
neighbors, abutters and other residents of the City and area.

On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . The proposed renovations, handicapped access and elevator will
not be substantially more detrimental than the existing nonconforming
use and will greatly enhance the use of this facility by others in
the community;
2. The proposed addition of a single story at the rear of the building will
enhance the usage of the facility and will not be substantially more
detrimental than the existing nonconforming use.
Therefore, the Zoning Board of Appeal voted unanimously 5 - 0 to grant the Special
Permit requested for the renovations of the building, installation of a handicapped
access and the installation of an elevator per the plans submitted for the Salem
Public Library at 370 Essex St.
Also, the Zoning Board of Appeal separately voted unanimously 5 - 0 to grant a
Special Permit for the addition of a single story and egress at the rear or the
building at 370 Essex St. per the plans submitted with the condition that all
aspects of the plans and alterations to the plans must be done in conjunction and
cooperation with the City Planner and Library Commission.
The petitioner has also requested a Variance from the parking requirements of the
Salem Zoning Ordinance.
The Variance which has been requested may be granted upon a finding of the Board
that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship, financial or otherwise, to petitioner; and
c. desirable 'relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
public hearing and after viewing the plans of the property in question, makes the
following findings of fact:
1 . The neighbors, abutters and others are in favor of the plans presented;
2. The property in question is unique due to its architectural and aesthetic
qualities;

On the basis of the above findings of fact, and on the evidence presented at the
public hearing, the Board of Appeal concludes as follows:
1 . The property in question is unique because of the existing structure;
2. The property has been used for approximately ninety-seven (97) years
as a Public Library;
3. The conditions described above which affect the land in question but
not the zoning district generally, causes special hardship to the
petitioner;
4. The desired variance may be granted without substantial detriment to
the public good.
Therefore, the Zoning Board of Appeal voted unanimously 5 - 0 in favor of granting
the variance requested by the petitioner for relief from the parking requirements
at 370 Essex St.

At its meeting of March 6, the Salem Historical Commission completed review
of the plans for renovation of and additions to the Salem Public Library. We
are pleased that with your cooperation throughout the review process, we were able
to reach mutually satisfactory solutions to those design elements which originally
were of concern to our Commission. Final issuance of the Certificate of Appropr_
ateness on the Library application is, however, as in all cases before the Commis-
sion, contingent upon proper abutter notification. According to Massachusetts
General Law, Chapter 40C, the Commission must either hold a formal public hearing
or, if it elects not to do so, notify abutters by mail of an application before
the Commission. Abutters then have a 10-day period to request to come before
the Commission to be heard on the application. Should an abutter raise important
issues of architectural compatibility, the Commission has the option of reconsider-
ing its vote. Otherwise the vote is confirmed.
In this case, several abutters did respond and were placed on the agenda for
our meeting of April 3. At that time a number of issues were explored, and the
Commission felt the need for more information before confirmation of the vote to
approve. Questions related to: whether the elevator has been moved; existing
available space and code violations; and status of the four-story addition before
the Board of Appeals.

On behalf of my father, Mr. Frank V. Hale, of
5 Monroe Street I wish to object to the application
for certficate of appropriateness applied for by
the Salem Public Library at 370 Essex Street.
While clearly the Library requires restoration and
should be made safe for the use of all Salem residents,
young and old, the present plans of the Library Trustees
are more geared toward expansion.
The planned addition to the library will permanantly
detract from the appearance of the library and the
neighborhood homes.
The historical characteristics of the Essex Street
Library and the surrounding homes demand that the first
aim of the Library Trustees should be to provide a safe
and functional facility within the existing structure.
The present plans call for an expansion which in one
case will place part of the new Library building within 2 1/2
feet of the Hale property at 5 Monroe Street. This Library
addition cannot be constructed or maintained, nor can
adequate fire egress be available without tresspassing
on private property.

Street neighborhood would be a loss for all of Salem.
Our Commission would strongly oppose any proposal to provide parking
that disturbed the fountain and fenced yard. Please feel free to contact

Dear Ms. Fitzgerald:
The Salem Historical Commission enthusiastically supports the enclosed
application to the MHC for funding to repair and restore the Salem Public
Library building at 370 Essex Street. Not only is this property listed on,
the National Register, but it is also part of the local McIntire Historic
District. Since the Salem Historical Commission also acts as a local historic
district commission, our members are very concerned about the fate of this
building.
The Library is prominently located on Essex Street, a major thoroughfare
which bisects the district. The building is well-known as an architectural
landmark and as a popular public facility.
Designed in 1855 by Salem architects Emmerton & Fuller for Capt. John
Bertram, this structure served as a residence until 1887 when it was donated
to the City by the heirs of the Bertram estate. The building has housed the
main branch of the Salem Public Library ever since.
On a street largely composed of wooden dwellings ranging from Georgian to
Colonial Revival in style, the Salem Public Library stands out as one of the
few brick buildings on Upper Essex Street and the only one with brownstone trim.
Designed in the Italianate style, it is symmetrically composed with a handsome
portico, large capped windows, and corner quoins.
Because routine maintenance has been delayed due to funding shortages, the
masonry exterior, parts of the slate roof, several windows and the brownstone
trim are in a state of disrepair. Also, the brownstone portico columns have
been cemented, an unfortunate alteration to a prominent architectural feature.
The bricks need repointing. and some of the brownstone is falling off the building
and requires immediate attention. The ability of the City of Salem to carry out
these repairs would be greatly facilitated with assistance from the MHC.
We feel this building merits MHC funding because of its architectural

distinction, its position as a contributing structure in a local historic district,
and its importance to the City as a public facility, and we hope that this appli-
