Reguarding the repair and rebuilding of an existing fire
escape on the rear of 3 Eaton Place, Salem, I would like to
submit the enclosed plans. The building, 3 Eaton Place, is a
six unit residential property with the rear emergency fire
escape serving the two units on the third floor.
I have been out of the country and out of the state
for most of October and part of November, having returned
yesterday November 5, 1991 . Please be advised that I have
every intention of co-operating with all departments of the
city including the Salem Historic Commission.
I met with the building inspecter in early September,
1991 . His concern is that the emergency fire escape be in
a sound condition to provide a secondary exit from these
two units.
I would like to point out that although my building
is located in a Historic District it is set away from public
ways and blocked by other building in a way that allows it
very little impact on the area.
The Historic District boundary follows the rear of my
building, and my rear abutter, Murphy's Funeral Home , is not
in the Historic District. The only time of the year that
any of this emergency exit is visible from any public way
is in fall and winter after the leaves have fallen from the
trees that screen this fire exit. Even at that time of
year it is hardly noticable.
To improve the condition of the existing fire escape ,
a change in design to part of the fire escape was needed.
The existing basic design of detail is to remain.

- Remove the stairs and ladders of the existing
fire escape. The six existing support brackets
as shown in the plan are to remain.
- The stairs, starting at grade , will have ten steps
to the first platform, the stairs will be 36" wide
with a tread of 92" and a rise of 83/8".
- The first platform will be 5' x 3' , 2x8 construc-
tion, with 4x4 supports.
- Nine step' s will run from this platform to the
next platform. These stairs will be 36" wide
with a tread of 92" and a rise of 83/8".
- The second platform will be 4' x 4 ' , 2x8 construc-
tion with 4x4 supports.
- Six steps will run from the second platform to the
main platform. These stairs will be 36" wide with
a tread of 9z" and a rise of 83/8" .
- The final platform 30 ' x 3 ' will be 2x8 construc-
tion using the metal supports as shown. Eight feet
of this deck is to be added to the existing 22 '
and using the same detail to this 8 ' section as is
presently existing.
- All lumber will be pressure treated and three
2 x 12 stringers will be used to support each
run of stairs.
- Handrail and baluster detail is shown in the

On February 19, 1992 the Salem Historic Commission approved a certificate of
appropriateness for the reconstruction of a rear egress at 3 Eaton Place. The
certificate required that the work be completed by July 31, 1992.
During the past year I did not anticipate other priorities that arose that caused
this work at Eaton Place to progress at a very slow rate. The present economic
condition's are not very favorable and the present housing rental market of which I am
involved, is still performing poorly. Presently, I am not in a position to hire another
contractor to complete this work to my building. A knee injury that put me out of
commission for two months this past summer was only one item that 1 did not
anticipate. During the months of August thru November I averaged eighty hours per
week managing and maintaining my buildings. However, I was not able to get caught
up enough to complete the work at Eaton Place.
I would like to assure the commission that the work will be completed. And
respectfully request an extension of time on the certificate of appropriateness issued
on February 19, 1992. 1 intend to complete the work as agreed and request the
extension as follows.
By the end of May 1993 all of the remaining carpentry work will be completed.
At this time, at the end of May, you could inspect this work. Although I do have a good
portion of the pressure treated lumber, some of which is cut, it will take some time for it
to dry out so that it could take a stain. Because of this, the staining work will be
completed at the end of August at which time your final inspection would take place.
Along with this requested extension I would also ask the Historic Commission not to
instruct the clerk of the commission to record a clerk's certificate as to violation at the
Essex South District Registry of Deeds as indicated in your letter dated February 3,
1993. The Historic Commission could wait until the end of May to take such action, at
which time you will be inspecting the completed carpentry renovations.
The stairway in question is presently in a sound condition providing a
secondary exit from rental units at this address and there are not any unsafe
conditions created in regard to this stairway.

My apologies to the Salem Historic Commission for not
being present at your Commission meeting on January 22, 1992•
I was under the assumption that a notice would have been sent
to me reguarding this January meeting. Having not received
any such notice I was unaware of that meeting date scheduled.
I would like to thank the Commission for voting to continue my
application until it 's next meeting on Febuary 19, 1992.
On Saturday, January 11 , 1992, I met with several of your
Commission members at my property, located at 3 Eaton Place ,
Salem, MA. . Some of the Commission members spoke to Frank
Murphy Jr. , of Murphy's Funeral Home who is my rear abutter.
Frank confirmed at that time that the rear stairway to my build-
ing has existed since he as a child, played in the yard of his
fathers property. Enclosed is a letter from his father Francis
Murphy, also confirming that as far back as he can recall , at
least forty years , that there has been a fire escape located in
the approximate position as the newly repaired fire escape. He
has owned the building for approximately 50 years .
The stairways are partially visible during the winter
months, but my building is not set on any public way, rather set
behind homes that are on public ways. Because of this , I feel
strongly that the stairways have little impact on the area. How-
ever, I would like to amend the plans that I had submitted on
November 6, 1992 so that the stairway would blend better and be
more appropiate for my building.
I would like to ask the Historic Commission to allow me to
use to? and bottom hand rails and to use pressure treated balusters
14 x 14 spaced every six inches . During the recent site visit it
was felt by the Commission members that this treatment would be
more appropiate .
At the last meeting on January 9, 1992 , it was determined
that the other stairway, on the right side of my building, was
not visible from public ways and did not fall under the Historic
Commission regulations. During the recent site visit on January
11 , 1992, it was determined that a portion of this other stairway
was partially visible from a public way. Because of this I will
also be willing to install pressure treated balusters 14 x 14
spaced every six inches as would be done to the rear stairway.
To further soften the impact of both secondary stairway
exits I would like to stain both with a grey stain (sample
enclosed) that would be very close in color to the existing
siding of this building.
Enclosed are three letters from my abutters, the first from
Frank Murphy of Murphy 's Funeral Home supporting my efforts to
improve my building and he feels that the improvements will not
have any negative impact on the surrounding area. A second
letter from the First Church of Salem, another abutter, recommen-
ding support from your Commission in the operations and improve-
ments to my building. Also enclosed is the third letter, from
the Salem Elks Lodge , another of my abutters. They have reviewed
my plans for the proposed renovation of my rear stairway and the
trustees , officers , and members are in favor of the proposed
renovations. With this being our third public meeting reguarding
my application not once has any abutter, or neighbor spoken
negatively toward my application.
This building is a legal six unit building and must have
secondary fire exits and stairways. I am sure that the Commission
members that attended the site visit on Saturday will agree that
the location of the stairway in question is the most appropiate
location for the building.
I trust the Commission will bear in mind the present
economic conditions that are effecting all of us when it is time
to vote on my application. I have provided good, clean, well
managed, affortable housing in the City of Salem for the past 20
years . My rental income is my only income, and presently the
housing rental market is performing poorly. I would not be able
to meet the state sanitary code of minimum standards of fitmess
for human habitation if I was unable to have these required fire
exits . This would be a severe hardship to me.
I would like to thank those Commission members who took
the time to make the site visit on Saturday January 11 , 1992 and
I thank all Commission members for their help and co-operation
in resloving this issue.

which has been located at 85 Federal Street since 1940 . As
far back as I can recall, at least forty years, the property
at Three Eaton Place has had a fire escape located in the
approximate position of the newly repaired fire escape.

In late August I received a telephone call from Alan Howe who
stated that exterior staircase work was being conducted at 3 Eaton
Place. Mr. Howe stated that the work was underway and questioned
if approvals had been received by the owner for such work. They
had not. I notified the David Harris of the Building Department
who visited the site. On August 28, 1991, Mr. Harris sent the
owner, Richard Savickey, a letter notifying that a stop-work order
was issued.
Shortly after, Mr. Savickey came in to the Planning Department and
picked up an application for the Commission. At that time he
showed lie drawings of the proposed alterations and stated that it
had been completed. I indicated that the Commission would likely
have concerns with the railing detail and possibly other design
issues . The application was never returned.

A decision was made by the Salem Historic Commission to wait
until the December meeting to review my application. This would
allow your members time to visit the property.
As I mentioned at the November meeting I would be away and
unable to make the December meeting. I respectively request that
my application be reviewed at the next meeting in January when I
would be present. I understand that I will need to wave the 60
day time frame in which the Historic Commission must act on ap-
plications submitted. I do not have any problem in doing this
and I thank the Commission for granting me this request.
The fire exits at 3 Eaton Place are in a sound condition to
service the units in that building. The time needed to process my
application is not a pressing factor.
