MY fence was removed during the current construction project almost over a year ago. I did give permission for it to remove with the understanding it would be replaced/ or reinstalled. During the course of construction approximately 80% has been removed, while the remaining fence has suffered severe damage. With the up coming Halloween Season approaching I am very concerned about the existing conditions. My tenants have tolerated a loss of privacy as well as increased noise levels during this time period. My 1st floor tenant, an older lady has had to yell at people who will walk into my back yard to relieve themselves after the local bars close. This is an unpleasant situation to say the least. Before the project , smokers would conjugate outside the Witches Brew side door under the canopy. Now with the addition is they come out to smoke on this side of the building they will be directly under my tenants bedroom windows. Another unpleasant & unacceptable condition. At least before, the fence provided some what of a buffer to people traffic in that location. With that new wall, although beautiful, will provide a nice place for people to sit & hang out. In short I'd like to see my fence back up. It was 6 feet tall, provide a buffer to the Witches Brew parking lot traffic, Privacy to my tenants use of my back yard & limited intrusion by those who might venture into my back yard. I don't think it is unreasonable for me to expect my fence to be reinstalled right now & before the Halloween tourist season begins.( Oct. 1,2005) I would like to receive more consideration than I have up to this point regarding this project! I would expect more from someone that wants to be a good neighbor! Thank you & the Historic Commission for attention to this issue. Additionally, in my opinion, his efforts to upgrade the appearance of his building are in keeping with the renovations that have occurred next door (which I believe were under the auspices of the National Park Service) and have made his building much more attractive and even more historical in appearance than some of the others nearby. In my experiences as a regular customer at his eaft,Mr. Kounsalieh is a generous, hardworking local business owner,who is sincere in his desire to do right both by the city and by his customers. Moreover, I am sure that, with some attractive seasonal plantings, the new stone wall will meet the spirit of your requirements. I urge the Historic Commission to approve this renovation project as it has been accomplished. I know that Mr. Kounsalieh humbly desires the approval of the Commission and wants the Witches' Brew to continue to be an attractive, historically compatible, and inviting Salem experience for visitors to our city. BUILDING FORM 156 Derby Street ARCHITECTURAL DESCRIPTION See continuation sheet. Describe architectural features. Evaluate the characteristics of this building in terms of other buildings within the community. This 2 1/2-story, 2 x 5-bay, side-entry, gambrel-roofed building has experienced substantial alteration leaving few, exterior, architectural clues as to its previous appearance. Local maps from the early twentieth-century show it as a 2-story tenement. The Salem Historic District Study Commission report indicates the only major ornamental feature, the "colonial" door frame at the main entrance with narrow plain pilasters, a frieze, and a low-relief pediment is a 1970's installation. Other elements such as window frames and sash give no indication of any pre-20th century style or fabric. Fenestration at the second floor level retains molded frames and early 20th-century sash with vertical muntins. Expansive, late 20th-century, 5-bay wall dormers have also been added to the roof line. Around 1985, Edward Windsor Carberg based on his own recollection described the building previous to the 1970's rehabilitation as " . . .a house with simple lines, wooden, topped by a saddle roof. . . ." 1 HISTORICAL NARRATIVE X see continuation sheet. Discuss the history of the building. Explain its associations with local (or state history. Include uses of the building and the rolecs) the owners/occupants played within the community. A title search is required to date and identify ownership of this property. Representations on local maps indicate a building existed on this site before 1851, but do not confirm it as this one. A report by Edward Winsor Carberg attributes all the property on the north side of Derby Street between Palfray Court and Daniels Street to Theophilus Sanborn (b. Gilmanton, N.H. , May 12, 1785; d. Salem, December 13, 1860) who came to Salem before 1809 and became a leading merchant and owner of a wood wharf, located at 115 (later 175) Derby Street in 1837 (demolished in the early 1900's) . His business, Thomas Sanborn and Company included his sons, Franklin T. Sanborn and George Sanborn as partners. on Theophilus Sanborn's death, his property was divided between his sons, a 1 daughter, Lydia Sanborn Russell (1821-1896) , her husband, George Russell (1816-1890) , and two sisters, Caroline L. Sanborn Kimball and her husband, David C. .Kimball, and Lucy A. Sanborn Havend of Charlestown. The heirs maintained the estate until October 30, 1867 when they sold to John Hurley of Salem and his brother, Michael Hurley of Lynn, for $2,271.42 (Bk. 733; Pg. 179) . They gained a final share of the holding from Elizabeth M. Sanborn, the next year (Bk. 790; Pg. 296) . The latter deed mentions that the Sanborn heirs had already disposed of a portion of the estate to Mary Driscoll, wife of Patrick Driscoll. In the 1890' s he is listed as operating a grocery at 44 Broad Street. In 1881, when street lists become available in local directories, this property is identified as having two occupants, both laborers with Irish surnames. Turn-of-the-century maps show the house as a 2-story tenement. Very early in thetwentieth century, tenancy changed to members of the Polish community which moved intothe neighborhood at that time. By 1911, although residential tenants remained, commercial space had also been introduced into the building. Martin Golin, a dealer in coal and wood as well as dry goods and men's furnishings operated at both this address and 36 Turner Street. He was succeeded c. 1915 by Antoni Petoski (variously also Petorski) , who kept a pool hall as well as lived here with his wife Sophia. Around 1922, Petorski began a business cutting leather soles. The Derby Sole and Cut Leather Company remained here until 1932. During the next ten years, Adam Dobrosielski lived here with his wife Constanna and operated the New Derby Lunch.
