It is hereby certified that the Salem Historical Commission has determined that
the proposed alterations and reconstruction work as described below in the Derby
Street Historic District will be appropriate to the preservation of said Historic
District, as per the requirements set forth in the Historic District's Act (Mass.
General Law Ch. 40C) and the Salem Historical Commission.
Description
Consolidation of existing drier vents as per plans submitted with roof exhaust.
Treatment of roof exhaust to appear as a (false) chimney of stucco, not
clapboard, and to be of appropriate height and width dimensions. Details to be
worked out between owner and delegated Commission members - see below.
Remove all pipes and vents from the exterior of all facades of the building. All
unused vents to be capped and/or any openings created shall be sided to match
existing building fabric, except as otherwise indicated. Repair/replace any
missing clapboards from the building to make exterior building fabric uniform.
REAR: Reclapboard rear addition (3 sides) 4-4 1/2" exposure, grade 1,
redwood, finish side out. Replicate corner boards. Finish door
frame and trim. Removal of roof over stair. Roof to be repaired or
replaced as necessary over 2nd floor rear porch. Add hip roof over
door at bottom of stair. Existing doors to remain. Remove lattice
work. Restore ornamental corner posts on upstairs porch (reuse
existing if possible) . Replace wood railing on deck and stairs.
Rail to be 42" high. Ballasters (6" on center, square) , railing,
thickness and ground level post to be per sample available in
Commission office at Salem Planning Department. Ballasters to be
painted. Replacement of bulkhead in wood. Replace aluminum gutters
with wood.
BECKET ST.
SIDE: Remove Maytag sign. Small vent to basement to remain. Remove 1st
floor fan and rebrick opening created.
Removal of two picture windows on first floor of the rear addition
and replace with 3 windows to line up with and match 3 windows on
second floor. New windows to be six over six sash, all wood with
intregal muntins & mullions. (Casing to be 1 x 4 flat stock with 1
3/4 band molding. ) Metal vent at roof peak of rear addition to be
changed to wood.
DERBY ST.
SIDE: Small basement window to remain. Replace threshold. Trim replaced
,
on 2nd floor. Exhausts over the right door on the Derby Street
facade be removed and the opening be replaced with a transom of 3
lights of equal proportions. Details to be worked out in advance
with delegated Commission members - see below.
SIDE TO
78 DERBY: Clapboard over middle window on first floor of rear ell. Two
windows on each side to have grates removed, frame and molding
remain, and exterior wooden shutters to be installed as if closed
over first floor windows. Remove grate/fan on first floor and brick
opening created. Approval of new vent as installed below location
of vent to be removed. Metal vent at roof peak of rear addition to
be changed to wood.
PAINT COLOR: Body color to change from white to Antique White in gloss.
Painting to be uniform on entire building.
OTHER: Reclapboard shed-like addition on rear roof to match building.
Repoint bricks as necessary, matching existing brickwork.
Removal of exterior lights attached to building.
Removal of the band of shingles above the storefront in order to
have a uniform, painted brick facade.
Approval of new sign and lighting to be considered under separate
application.
Commissioners John Carr and Roger Hedstrom/John Casey have been delegated to
approve any details not yet approved.
The foregoing approved work is an interdependant package and is not separable.
All work to be completed by May 31, 1993. Painting to be completed by July 15,
1993. Failure to complete the above could result in the Commission requesting
that all City departments revoke all permits and approvals and shut down gas to
the building and/or seeking a complaint in Superior Court.

Dear Ms. Harris:
With respect to the above captioned subject, enclosed please find additional plans
depicting the subject property from each of its facades. The plans do illustrate the matters
to be addressed in the proposal previously submitted and were prepared with the
Amended Certificates of Appropriateness in mind.
Please note that I have been informed that work must be immediately instituted
with respect to the simulated chimney. This work, to be done prior to the April 7th
meeting before the Commission, was detailed on plans previously provided. Certain duct
work has been brought to the roof of the building and additional work must be
immediately undertaken to insure that the work done to date and the building itself is not
harmed by weather and elements. I have attempted to call Mr. John Carr to advise him of
these concerns but as of this writing I have not yet reached him.
We look forward to the meeting on April 7th, 1993 to finalize all remaining
matters concerning this project. We again thank you for your continued courtesy and
cooperation.

Our office has received a signed contract to provide laundry
ventilation and combustion air make-up for 82 Derby Street ,
Salem, MA.
Our office has had a verbal approval to proceed with the
project since February 10 , 1993 , and we have a signed contract
from the Century Bank dated 2-23-93 , which was received by our
office 3-8-93 .
It was previously explained to the Historic Commission that
materials would take 4 to 5 weeks for delivery, therefore , we
have a projected delivery of materials to the site by March 17 ,
1993 , with a completion date of approximately 7 working days
after delivery of equipment . We do not see any reason at this
point , which would alter our projected completion of the project .

Dear Mr. Flynn:
As you are aware, the Salem Historical Commission issued a
Certificate of Appropriateness on December 3, 1992 which outlined
work required to correct violations of the Historic Districts
Ordinance for the property at 82 Derby Street. The Commission
issued amended Certificates of Appropriateness on January 19 , 1993
and on February 4, 1993 . As required by the Certificate of
Appropriateness dated December 3, 1992, the work was to be
completed by March 1, 1993 .
To date (more than 3 months later) the work has not even
commenced, much less been completed, nor have the required drawings
been submitted. Since the potential penalties for violation of the
Ordinance run with the land, the Commission voted at its regular
meeting of March 3 , 1993 that an egregious violation exists and to
instruct the Clerk of the Commission to record a Clerk' s
Certificate as to Violation at the Essex South District Registry of
Deeds .
Please be advised the such Certificate was filed on March 9,
1993 . The Clerk' s Certificate as to Violation references the
property title. Please be advised that when the work in violation
is addressed to the satisfaction of the Commission and the
Commission has collected recording fees ( $20 .58) , the Commission
will vote that the violation has ceased and will instruct the Clerk
of the Commission to record a Clerk' s Certificate as to Completion
of Work at the Essex South District Registry of Deeds .
The Commission has lately become aware that you have found a
buyer for this property and that you may wish to consummate the
sale before the completion of the required work. In such event,
the Commission would be willing to entertain an escrow agreement,

provided that it adequately secure the completion of the required
work to the satisfaction of the Commission. To this end, we have
scheduled discussion of 82 Derby Street at the Commission' s next
meeting on Wednesday, April 7, 1993, 7 : 30 p.m. at One Salem Green.

Dear Mr. Flynn:
This department conducted an inspection at the above referenced
property with the following results:
1. The dryer venting system, which is governed by the Massachusetts
State Building Code, is in violation and must be repaired within
ten ( 10) days of receipt of this notice or the City of Salem will
have the gas for the dryers shut off.
2. The platform at the staircase located in the rear of the building
not only is a fire trap due to accumulation of lint on the under-
side but is also has loose and rotted boards, these violations
must be corrected immediately.
3. The Bulkhead going into the basement is in deplorable condition
and constitutes a danger to the safety of the public.
Also, the Historic Commission has made conditions which were to have
been completed by March 1, 1993 and to this date these conditions have not
be accomplished.

The following is my understanding of the proposal that the
Commission would like to see for the December 2, 1992 meeting.
These are to correct outstanding violations. However, they could
also serve as general maintenance and upkeep which would have a
positive effect on the historic neighborhood and would greatly
enhance the saleability of the property. Please relay this
information to Century Bank.
In addition to the proposed drier exhaust and louver as
currently applied for, the Commission would like to see the
roof exhaust enclosed ( for an effect of a simulated chimney) .
I believe Ray Noyes is familiar with the look/material
suggested.
- Removal of all pipes and vents from exterior of building.
Repair openings created to match existing building fabric.
- Repair/replace any missing clapboards from building to make
exterior building fabric uniform.
Completion of painting that was previously begun:
Body & band of shingles - Oxline Soft White
Trim (cornice work and window trim) - White
or propose new painting scheme for entire building. In any
case, the mottled coloring of the building as existing is
unacceptable.
Completion of casing work around rear door. (The Commission
did not seem too concerned that the door was likely installed
without prior approval . )
It was concluded that at the December 2, 1992 meeting, Century Bank
could request that the existing application be altered to include
the above. I would suggest that the bank propose a time schedule
for the completion of the work.

Mayor Neil Harrington stated in his May 19, 1992 letter to
us, that we should contact you concerning the problems we are
having with 82 Derbv Street (Melanie Marie's Laundry) . We
would first, like to thank the Salem Police Department for
their quick response to the many disturbances we experienced
this past spring and summer at the property and to Mayor
Harrington, Councillor George Nowak, the Historic Commission,
the Building Inspector, the Fire Department, and the Health
Department for their prompt and sincere response to our
concerns. There are still some remaining issues from our
April 24 , 1992 letter to Century Bank, the owner of the
property. We are frustrated as we imagine you are, with the
refusal of the property owner to take any steps to correct
the remaining issues despite their promises to do so. These
are enumerated below:
1) Dryer Vents
The enclosed photo illustrates the unsatisfactory condition
and location of the dryer vents. Both the back vents and
front vents (not in photo) have no filter for noise and
lint. The neighborhood experiences two kinds of pollution:
noise and air. The back dryer vents have already been
cited as a fire hazard, due to the lint build-up under the
porch. As garbage gets piled up under the porch and around
the rear entrance under the vents as shown in the photo,
the potential hazard gets worse.
2) Building Exterior
As shown in the photo, the exterior of the building is need
of major repair. 82 Derby Street is literally falling
apart. Paint and pieces of brick are falling into the
adjacent property (78 Derby Street) . Young children play
in the adjacent yard and in the street, and we are
concerned about lead Paint poisoning. 82 Derby Street is
in the Historic District and is currently in violation of
the Historic Districts Act. The current owner, is aware of
the violations (has known for over five months) , but has
not taken any significant action to resolve the violations
as promised in their letter of May 6, 1992 (enclosed) .

3) Parking
The building currently houses three income apartments and a
commercial laundry. As shown in the photo there are only
three off-street parking spaces. When these three spaces
are full the neighborhood experiences illegal parking on
Becket Ave. and parking on the sidewalk of Derby St.
Looking at the photo you might think you are looking at a
back alleyway not visible to the public, but it is not. This
picture was taken on October 11, 1992 from Becket Ave. , a
street 25 yards from the Derby Street Historic District and
the view from many of our homes. The front of 82 Derby
Street is a view that almost all visitors to our city see
when walking or driving down Derby Street. We do not
understand how a commercial establishment can continue to
operate when it is in violation of strict codes.
We invite you to look at our neighborhood to see first hand
the pride we take in our property and to see the concerns we
have with 82 Derby Street. Thank you very much for looking

On May 13 , 1992 , the Salem Historical Commission wrote to you
concerning outstanding violations at 82 Derby Street . At your
request, a second copy of the letter was faxxed to you on October
8, 1992 .
This property is currently in violation of the Historic
Districts Act for alterations that have been made to the exterior
of the building without receipt of authorization from the Salem
Historical Commission. The alterations which are in violation
include, but are not necessarily limited to, the addition of
several vents to accommodate the laundry facility and incomplete
painting. At the present time, the building has a mottled color
scheme which is totalling unacceptable. Through your acquisition
of this property, you have assumed the responsibility for
rectifying these outstanding violations .
In our May letter, the Commission sought to work with you by
offering to meet informally to discuss the resolution of these
issues prior to your submittal of a formal application. The
Commission felt that it might be beneficial to you in order to get
an idea of what the Commission is likely to approve for venting and
to get suggestions on how to correct the inappropriate alterations
made to the building' s facades . The Commission also offered their
guidance on any proposal that you may have for signage.
Because five months have passed without your response, the
Commission is again requesting your cooperation in this matter. We
feel that the resolution of these violations will increase the
marketability of the property, since most potential buyers are not
willing to be the recipients of outstanding municipal violations .
The Commission has also received several complaints from
concerned neighbors on these and various other issues . We feel
that in the interest of good public relations, Century Bank should
be willing to address those neighborhood concerns which are
reasonable and feasible. Such a relationship could also increase
the marketability of the property.
The Commission respectfully requests that Century Bank submit
an application for a Certificate of Appropriateness with a proposed
resolution to the outstanding violations. Your application must
be submitted within 15 days to avoid legal enforcement. If you
need assistance, please contact the Clerk of the Commission, Jane
Guy at the Salem Planning Department, One Salem Green, Salem, MA

Thank you for your letter concerning 82 Derby Street . I share
your concern for the condition of the property, and have instructed
the appropriate department heads to take the necessary steps to
provide relief to the neighborhood.
Some of the action taken to date includes :
1) The Salem Health Agent, Robert Blenkhorn, has cited the
Century North Shore Bank for rubbish and garbage
violations . He will monitor the property and continue to
take action as necessary .
2) The bank has advised our Building Inspectors that they
will be correcting problems related to vents from the
laundry. Other building code violations will be
addressed as they are discovered.
3) The Salem Historical Commission has advised the bank that
the property is currently in violation of the Historic
Districts Act, and has offered to assist the bank in
rectifying existing problems and in future upgrades .
4) The Salem Fire Department reported to me that fire
detection devices are currently operating correctly. The
only violation noted on a recent inspection was improper
storage of hazardous materials in the cellar, and the
bank has agreed to correct that situation.
5) The Salem Police Department has orders from Chief St .
Pierre to closely monitor the area for parking violations
and to repond promptly to noise violation reports .

Dear Neighbors of 82 Derby Street:
Thank you for your letters of October 27, 1991 and April 24,
1992 . We were unable to respond to your first letter because there
was no return address included.
The issues you have raised are very important to the quality
of life in your neighborhood and we hope that the other public
bodies who have jurisdiction over those specific, issues will
address them to your satisfaction. The Salem Historical
Commission, however, can only address the changes that were made to
the building without our authorization after the historic district
was formed. These changes appear to be the installation of
venting, incomplete painting and possibly signage. Unfortunately,
the Commission has no jurisdiction to prevent a property owner from
neglecting his property to the point where bricks fall off of the
building.
After several unsuccessful attempts to work with Mr.
Suldenski, the Commission is now writing to the Century Bank which
has recently acquired the property. As you will see by the
enclosed letter from Century Bank to the Building Department, the
Building Department has also been concerned with the code
violations at 82 Derby Street . It appears Century Bank is very
interested in addressing the code violations and we are confident
that they will resolve them quickly and cooperatively with the
Salem Historical Commission and the Building Department. We have
taken the liberty of sending copies of your letters to Century Bank
along with the Commission' s letter, a copy of which is enclosed.
The Commission hopes that all of your other concerns regarding
82 Derby Street will be addressed by the appropriate public bodies .

This is a follow up letter to our original correspondence
dated October 27, 1991 . As neighbors we are concerned about
the condition of the property at 82 Derby Street . We are
also concerned because it has come to our attention that the
property is under foreclosure which will result in another
owner, the 4th in 6 years. The property continues to
deteriorate - let us reiterate some of our concerns:
1> There have been incidents at all hours of the night
where apparently drunken people are coming and going from an
apartment in the building. The noise and disturbances
continually awaken the rest of the neighborhood. The
language is often loud and obscene. This has been
particularly a problem during the warmer months which are
once again approaching. Loud television noise comes from
the laundry and from one of the apartments at all hours and
has prompted the calling of the police by various neighbors
on several occasions. The noise continues .
2> There is a shortage of trash containers for the tenants
and the business . This results in garbage being left in
plastic bags which animals break apart . Garbage is strewn
weekly about the street and in our yards. No one in the
building takes responsibility for cleaning up and the cans
often sit in the road several days after garbage pickup.
3> The fire department has been called to the property on a
somewhat regular basis over the last several years. We
question the safety of the building and subsequently, the
safety of our homes .
4> There is partially completed exterior construction and
painting which degrades the look of the entire area. Bricks
from the building fall into one of the neighbors ' yards .
The building ;s in the historic district. yet there ; s no
indication that Salem' s regulations are bP9na followed-
5> It is highly questionable if the building is deleaded
while several young children are living there. There also
are far more people living in the building than two years
ago. This raises a question about parking space and the
problem with customers parking on Becket Ave. causing near
accidents and blocking access to residents . In addition,
due to the lack of parking, patrons of the laundry often
park on the sidewalk on Derby Street blocking the pedestrian
way and causing a general annoyance.
6> Earlier last year numerous new dryers and washing
machines were added to the laundry. After this time there
were problems with the exhaust fumes . The vents were
rerouted from the side of the building to the back. Now
there are exposed large vents protruding from the wall in a
partially completed state. Also, exhaust from those vents
now flows into other areas of the neighborhood. When there
is a nice off shore breeze one can inhale the fine scent of
exhaust fumes . We question whether the proper permits and
procedures were followed with this and other construction on
the building in the last two years.
We take pride in our neighborhood and hope that the city
will respond to our concerns . This property is an eyesore
to the Historic District and a menace to the neighborhood
and we feel that the opportunity is at hand to do something
about it .

On November 15, 1989 , the Salem Historical Commission denied
an application for a Certificate of Appropriateness to accept a
sign as installed and pink paint on the band of shingles at 82
Derby Street . The Comission approved a Certificate of
Appropriateness to paint the body of 82 Derby Street with Oxline
Soft White which would include the band of shingles that was
currently painted the pink that was denied.
While the sign has been removed and some painting of the band
of shingles in white has occurred, the Commission would remind
you that pink paint is still visible and must be covered over
with the approved white . The Commission respectfully requests
that this be completed within 30 days .

Please be informed that the sign installed and painting performed at 82
Derby Street is in violation of the Historic Districts Act. The owner, Mr.
John Suldenski, received denials without prejudice for both a Certificate
of Appropriateness and a Certificate of Non—Applicability due to failure to
attend the Salem Historical Commission' s public hearing regarding his
applications.
Enclosed are copies of the denials dated 9/7/89, which indicated that
Mr. Suldenski had 30 days to reapply and obtain approval for the work
performed. Since 30 days has passed and no application has been submitted,
the Commission is referring this issue to the City of Salem legal
department for enforcement of the sign removal. It is requested that the
assessment of fines of up to $500/day from the date of violation be
pursued. The violations occurred on or before June 21 , 1989.

I am writing in regard to John Suldenski ' s Certificate of

The new sign that John has erected is perfectly fine,
much better than the old one. I see no reason why he
should have to replace it .
Certificate of Non-Applicability:
I do not like the pink paint John has applied as a
boarder around the sign . As I previously stated the
sign is fine, but the pink is inappropriate. I like
the current color of yellow, and recommend that the
building remain all yellow with a white trim.
