Be prepared to apply for approvals well in advance of commencing any exterior work. Before making any changes to the exterior of property in tan historic district,the owner should call or visit the Commission representative at the Department of Planning&Community Development to discuss proposed alterations and to determine the category of the application(Appropriateness,Non-Applicability or Hardship). B. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City f fall. The meetings are held at 120 Washington Street,3rd floor,and begin at 7:00 p.m. All meetings are open to the public and any person is entitled to appear and be heard on any matter before the Commission before it reaches a decision. C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in order to make the agenda. An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the meeting. In some cases,a Certificate of Non-Applicability maybe issued by the Clerk,without review by the full Commission,after notifying Commission members and allowing 24 hours for any objection. There is no fee for any applications. D. All applications for Certificates of Appropriateness or Hardship require a public hearing. Notice of the hearing must be posted with the City Clerk 14 days before the hearing and abutters must be notified in writing. Commission staff will handle these procedures. A public hearing is not required for a Certificate of Non-Applicability. E. Applications must be submitted by the ownerofthe property. A contractor for the owner,at the owner's request,may submit to application on the owner's behalf. In case of tenant,a waiver of the owner's appearance may be granted at the discretion of the Commission if it is requested by the owner. F. All applications must include photos of existing conditions,taken from all public ways. No certificates can be issued until receipt of photos. G. An application will not be considered complete unless gjj,work items are thoroughly described on scaled drawings and include specifications regarding dimensions, materials, and any other information needed for the Commission to visualize the changes in order to make a determination. Applications for paint colors should include a paint chip or chart. rhe following items should be included in your drawings as applicable(exhibits should be 8%x I I or be able to be folded to 8%2 x 11): I. Site plan showing location of improvements; 2. Elevation drawings of the specific improvements; 3. Details/profiles(i.e.moldings, fence caps,cornices,vents,etc.); 4. Materials(i.e.wood,brick,etc.); 5. Dimensions(i.e. size of trim);and 6. Transformers,heat pump and condenser locations,electrical entries and titers,lamp posts,stove pipes. 11. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners having professional consultants such as architects or contractors are urged to have them be present at the hearing. If the application is approved, a Certificate will be mailed to the mailing address provided on the application and copies will be sent to the City Clerk and Building Inspector. Plett a note that the application can be continued until the next meeting if the Commission deems necessary(i.e. for reasons of incomplete drawings,to perform a site visit,etc.). In any case,the Commission must make a determination within 60 days from the date the application is received,unless the applicant waives that requirement in writing. 1. A property owner or a contractor cannot receive a building permit unless a Certificate has been issued. Please be sure to obtain appropriate permits from the Inspector of Buildings(or other necessary permits and approvals)prior to commencing work. J. The homeowner may opt not to commence the work approved(unless it relates to resolving an outstanding violation). The City of Salem reserves the right to inspect the project to determine compliance with the conditions set forth in the Cenificate issued. Violations A person commencing or completing work to the exterior of a building in an historic district without the necessaryapproval of the Commission is subject to tines of up to$500 per day from the date ofviolation. While it is possible that Commission members assumed that the fence between the two properties would face out from the Chestnut St. property, at the meeting where the item was discussed, the Commission did not discuss which way the fence between the two properties would face. When asked 3 weeks later, the applicant claims the good side previously faced in to his property and stated that he is building the fence the same. The owner at Botts Court claims that the fence was not there when they purchased the house, but that a neighbor has informed them that the good side faced Botts Court. I cannot find any photographs of the fence prior to its removal. Amazingly, this topic does not come up much. Usually fences are in several sections with posts at the end of each section, so there is often no good or bad side. When there is, the drawings submitted, or historic photographs usually show the way the fence will face. When it does come up, however, the good side, if perpendicular to and visible from the street, usually will face the street. If not, then it will face outward from the house that the fence seems to be around (i.e. if someone is putting a fence around 3 sides of their property, it would typically face out). However, if it is only on one side, there is precedent that the good side will face inward, particularly if both properties have the same trim color and the trim color matches the fence. There is nothing in the Commission's written guidelines concerning which way a fence should face. The owner atl3otts Court feels that the fence is in violation, because it should be reasonably assumed that it should face out from the Chestnut Street property. Without any photographic proof or neighbor affidavits, without any previous discussion in the minutes and without any mention in the approved certificate, does the Commission have the legal authority to force the owner of 20 Chestnut to undo the fence work done to date and rebuild it with the good side facing out? I wanted you to know that this in no way illustrates my lack of concern regarding this project. As you know, my family was away when Mr. Schooly began this project. We returned to home to find your letter about the fence. I have to agree with the Commission that a portion of the fence is being built right on the property line which means that a portion of the poles are on our property. As for the South side of our property, again, I heard from my neighbors that Mr. Schooly stated at the meeting that the property line for that side of the property was the brick walkway. The survey sticks prove this as well. If that is the case, then the fence is several inches onto our property and not being built according to the plans submitted to the Commission. Application to Salem Historic Commission for Certificate of Appropriateness The Greek Revival house at 22 Chestnut St has received no exterior renovation for at least 30 years. The rear(north facing) end of the building was in a deteriorated condition when we purchased it in 1987, and is still in the same condition. The basement room(a summer kitchen with bake oven hearth)is mildewy. Above it,the present kitchen is drafty and rarely reaches 60 degrees in winter with the heating system is going full blast. The kitchen addition represents a mdlange of elements from different eras. With the help of our architect Helen Sides, we have developed a plan to refine and renovate this part of the house without altering the existing footprint. The proposed plan will enhance the exterior appearance of the house while improving interior functionality and heat distribution. Under the proposed plan,the exterior stair that was added in the 1970s would be removed. The plan calls for restoration of the original rear entrance next to the woodshed. Existing windows on Hamilton St. will be retained, and two new north facing windows of double hung single pane glass will be added. On the Hamilton St. side, a new brick foundation will be installed and a new window added where the door is now. The roofline of the rear will be raised to meet the existing one-story roof. New custom shutters of the type that were recently fabricated for each window in the front of the house will be made and hung on the new windows. The proposed plan will add to the security of the house by removing an unused entry door leading to a ratty basement room. We thought a long time about how to improve the kitchen and rear entry,and the architect translated our ideas into a sensitive plan that retains the look and feel of the property while updating it for modern family use.
