PROCEDURES FOR FILING APPLICATIONS
A. Ile prepared to apply for approvals well in advance orcontmencing any exterior work. Before making any changes to the exterior of property
in an historic district,the owner should call or visit the Commission representative at the Department of Planning Sr.Community Development to
discuss proposed alterations and to determine the category of the application(Appropriateness,Non-Applicability or Hardship).
B. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City I[all. The meetings are held at
120 Washington Street,3rd floor,and begin at 7:00 p.m. All meetings are open to the public and any person is entitled to appear and be heard
on any matter before the Commission before it reaches a decision.
C. An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m.on the Monday 16 days before the meeting in
order to make the agenda. An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the
meeting. In some cases,a Certificate of Non-Applicability maybe issued by the Clerk,without review by the full Commission,after notifying
Commission members and allowing 24 hours for any objection. There is no fee for any applications.
D. All applications for Certificates of Appropriateness or Hardship require a public hearing. Notice of the hearing must be posted with the City
Clerk 14 days before the hearing and abutters must be notified in writing. Commission statFwill handle these procedures. A public hearing is
not required for a Certificate of Non-Applicability.
E. Applications must be submitted by the owner of the property. A contractor for the owner,at the owner's request.may submit an application on
the owner's behalf. In cast of a tenant,a waiver of the ownces appearance maybe granted at the discretion of the Commission if it is requested
by the owner.
F. All applications must include photos of existing conditions,taken from all public ways. No certificates can be issued until receipt of photos.
G. An application will not be considered complete unless iLLLwork items are thoroughly described on scaled drawings and include specifications
regarding dimensions, materials, and tiny other information needed for the Commission to visualize the changes in order to make a
determination. Applications for paint colors should include a paint chip or chart. The following items should be included in yourdrawings as
applicable(exhibits should be 8'h x I 1 or be able to be folded to 8%a x 11):
1. Site plan showing location of improvements;
2. Elevation drawings of the specific improvements;
3. Details/profiles(i.e.moldings,fence caps,cornices,vents,etc.);
4. Materials(i.e.wood,brick,etc.);
5. Dimensions(i.e.size of trim);and
6, rrmnstormers,heal pump and condenser locations,electrical entries and meters, lamp posts,stove pipes.
H. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners
having professional consultants such as architects or contractors are urged to have them be present at the hearing. If the application is approved,
a Certificate will be mailed to the mailing address provided on the application and copies will be sent to the City Clerk and Building Inspector.
Please note that the application can be continued until the next meeting if the Commission deems necessary(i.e. for reasons of incomplete
drawings,to perform a site visit,etc.). In any case,the Commission must make a determination within 60 days from the date the application is
received,unless the applicant waives that requirement in writing.
1. A property owner or a contractor cannot receive a building permit unless a Certificate has been issued. Please be sure to obtain appropriate
permits from the Inspector of Buildings(or other necessary permits and approvals)prior to commencing work.
J. The homeowner may opt not to commence the work approved(unless it relates to resolving an outstanding violation). Work commenced must
be completed within one year from the Certiticate date unless otherwise indicated.
K. The City of Salem reserves the right to inspect the project ha determine compliance with the conditions set forth in the Certiticate issued.
Violations
A person commencing or completing work to the exterior of a building in an historic district without the necessary approval of the Commission is subject
to fnnesofup to 5500 per day from the date ofviolation. The Commission is not responsible for an owners neglect to inquire about necessary City permits
and approvals. All records are public and we will confidentially assist you if you are concerned that someone in your neighborhood is in violation.

I apologize for not being able to attend this meeting.
Steve and Julie would like to add headroom to their second floor bath. Currently the
"mirror wall" is only 5 ft. tall. By adding a shed dormer they could achieve full height
space. They are hoping to do this work as quickly as possible.
Wishing to minimize design fees, the best way to determine window size is by actually
framing the dormer. We plan to use wooden sash with divided Ltes that would operate as
an awning. They may decide to use windows the full 6'-8" of room length or center a
single unit in the dormer of about 2 feet in width.
Because of the hurry-up nature of this project is it possible to approve this Application of
Appropriateness(if necessary) contingent on a board member being assigned to oversee
the selection of a window unit which will be determined during construction?

Appropriateness to Kathleen Zubick to reconstruct a rear porch at 11 Cambridge Street,conditional

Thank you for your letter of May 25, 2004 responding to the violation notice issued for
painting of your rear porch.
As you know, painting, which was a condition of the approval of your porch alterations,
remains incomplete. It has also been observed that portions of the porch which were approved to be
painted appear to be varnished rather than painted. This is in violation of your Certificate, which
states: "porch railing,balusters and stair risers are to be painted to match the existing front porch,
the pergola and screen to be painted the trim color and the decking and stair treads to be clear stain or
stain no darker than 13 Cambridge Street."
In order to complete the required painting work,the Commission has voted to extend the time
frame of your Certificate for 90 days. Required painting must be corrected and/ Or completed by
August 31, 2004 in order to avoid further violation procedures.
Please note that the work on the front porch decking was approved by the Commission, per
your request,as optional work. You are not required to perform the work on the front porch decking
and this work is not subject to violation procedures. Should you decide to commence that work,

Dear Jane,
I am responding to the Commission's written request (received 04-24-
04) that the painting of my front porch and rear deck be completed within
one month.
On 05-24-04, I finished a Certificate Computer Training Course in
conjunction with the Mass Dept. of Transitional Assistance (DTA). In
accordance with DTA guidelines, during the coming three months, they will
be assisting me to find employment.
Unfortunately, until I am employed, I am financially not able to
undertake the reconstruction of my front porch decking, nor complete the
remainder of the required painting work.
Although the Commission Notice stated: "It has come to the attention
of the Commission that the painting has not been completed as required", I
am surprised that I was never personally contacted by someone from the
Commission to assess the progress I have made thus far. I feel this is
particularly important, especially in light of the fact that the lattice screen
was stolen the day after the final payment to the Contractor—who verbally
threatened me that he would return to tear down the work and re-sell the
lumber. Therefore, may I suggest that we schedule a meeting at my home to
discuss the extent of the remaining work.

With two small children, ages three and two, we acted upon
parental impulses to construct a fence for their safety . It
was in July , that a car traveling along our one-way street

she was drawing with chalk in our driveway .
