I wanted to memorialize our telephone conversation on
Tuesday, January 16, 1996, regarding tha letter dated January 9,
1996 from Leo E. Tremblay, Inspector of Buildings (attached
hereto for your easy reference. I shall prepare a formal
response regarding the use of the main house by David F.
Driscoll, Esquire, for his law practice .
The allegation set forth in paragraph 3 that, "the non
conforming use of the structure has been abandoned for a period
of over two (2) years therefore the property legally reverts back
to a legal two (2) family dwelling, and can not be used for
office space" is clearly erroneous. The medical service or
professional use of the building was never abandoned as the
premises were advertised and placed in the hands of a broker for
re-rental through approximately January 1995 when the premises
were then let for professional offices; i.e. , law offices for
Attorney David F. Driscoll.
I will furnish you with a more complete response within
seven days. In the meantime, thank you for your attention and
courtesy in this matter.

On May 6 , 1992 , the Salem Historical Commission approved a
Certificate of Non-Applicability for the replacement of an existing
stockade fence to match the previously existing fence in all
respects . The Certificate stated that the length of the fence must
match what was previously existing.
It appears to the Commission that the length of the
replacement fence is not as long as the previously existing fence.
In consequence, the driveway opening is now considerably wider than
that which previously existed. Therefore, we respectfully request
that, within 30 days, the fence be continued to the edge of the
driveway or that you contact the Clerk of the Commission, Jane Guy,
at the Salem Planning Department to arrange for discussion of this
issue to be placed on an upcoming agenda.

Procedures for Filing Anplicacions
A. There is no tee co come before the Commission.
B. Be prepared to aopiy for approvals well in advance of commencing any exterior work. Before making any changes co the
exterior of a property in an historic district, the owner should call or visit the Commission represencatzve At the Salem
Planning Department to discuss proposed alterations and to determine the category of the application (Appropriateness.
Von-Applicability or Hardship).
C. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City Hall. The
meetings are held at One Salem Green. 2nd floor, and begin at 7:30 p.m. Ali meetings of the Commission are open to the
public and anv person is entitled to appear and be heard on any matter before the Commission before is reaches a decision.
D. An application for a Certificate of Appropriateness or Hardstip must be received by 3:00 p.m. on the Monday 16 days before
the meeting in order to make the following agenda. An application for a Certificate of Non-Applicability may normally be
added to the agenda up to the day of the meeting.
E. All applications for Certificate of Appropriateness or Hards.iip require a public hearing. Notice of the hearing must be
posted with the Cicv Clerk 14 days before the hearing and abutters must be notified in writing. Commission statf will
handle these procedures. A public hearing is not required for a Certiticace of Non-Applicability.
F. applications must be submitted by the owner of the property. In case of a tenant, a waiver of the owner's appearance may
to granted at cne discretion of the Commission It it is regtestea by the owner.
C. An application will nor be considered complete unless all work items are thoroughly described on scaled drawings and
include specifications regarding dimensions, materials, and any other information needed for the Commission to visualize
the changes in order cc make a determination. Applications for paint colors should include a paint chip or chart.
Applications for changes other than paint colors must be accompanied by scale drawings chat adequately illustrate all
proposed changes. The following items should be included in your drawings as applic�Ie:
1. Site plan showing location of improvements:
2. Elevation drawings of the specific improvements;
3. Details/profiles (i.e. moldings, fence caps, cornices, etc.);
h. Materials ( i.e. weed, brick, ecc.);
5. Dimensions ti.e. size of [rim): and
6. Transformers, heat pump and condensor locations, electrical entries and meters, lamp posts. Stove pipes.
If. At their convenience, a representative of the Commission will cake pictures of the property from the public way for
presentation at the meeting. It is not necessary chat the applicant be home or be present.
1. At the hearing, the Commission will discuss the applicati<n with the applicant or his represencatfve, hear the abutters am
cake a vote. •owners having professional consultants such as architects or contractors are urged to have them be present ai
the hearing. :f the application is approved a Certificate will be issued. mailed to the applicant and copies will be sent
to the City (Aerk and Building Inspector. Please note that the application can be continued until the next meeting if the
Commission deems necessary ( i.e. for reasons of incomplete drawings, to perform a site visit. ecc.). In any case, the
Commission must make a determination within bO days from the dace the application is received.
J. A property owner or a contractor cannot receive a building permit unless a Certificate has been issued or the applicant ha:
a letter from the Commission stating that the change invclved is not subject to the Camofsscon's jurisdiction.
R. The City of Salem reserves the right to inspect the project to determine compliance with the conditions at forth in the
Certificate of Appropriateness.

changes are likely or unlikely to be approved. The Commission supports your efforts to improve your property and can guide
you on historical appropriateness. various books and City-wide architectural inventories are available to help you identify
the style and age of vour home. Also available are rehabilitation guidelines, misc. legislation, pictures. books. and other
