Be prepared to apply for approvals well in advance of commencing any exterior work. Before making any changes to the exterior of a property in an historic district,the owner should call or visit the Commission representative at the Department of Planning&Community Development to discuss proposed alterations and to determine the category of the application(.Appropriateness.Non-Applicability or Hardship). B. The Commission normally meets on the first and third Wednesdays of each month and notices are posted at City l lall. The meetings arc held at 120 Washington Street,3rd Boor,and begin at 7:00 p.m. All meetings are open to the public and any person is entitled to appear and be heard on any matter before the Commission before it reaches a decision. C An application for a Certificate of Appropriateness or Hardship must be received by 3:00 p.m on the Monday 16 days before the meeting in order to make the agenda. An application for a Certificate of Non-Applicability may normally be added to the agenda up to the day of the meeting. In some cases,a Certificate of Non-Applicability maybe issued by the Clerk,without review by the full Commission.after notifying Commission members and allowing 24 hours for any objection. There is no fee for any applications. D. All applications for Certificates of Appropriateness or Hardship require a public hearing. Notice of the hearing must be posted with the City Clerk 14 days before the hcaringand abutters must be notified in writing. Commission staff will handle these procedures. A public hearing is not required for a Certificate of Non-Applicability. E. Applications must be submitted by the owner of the property. A contractor for the owner,at the owuci s request,may subnutan application on the owner's behalf. In ease of a tenant,a waiver ofthe owner's appearance may be granted at the discretion of the Commission if it is mquested by the owner. F. All applications must include photos of existing conditions,taken from all public ways. No certificates can be issued until receipt of photos. G. An application will not be considered complete unless all work items me thoroughly described on scaled drawings and include specifications regarding dimensions, materials, and any other information needed for the Commission to visualize the changes in order to make a determination. Applications for paint colors should include a paint chip or chart. The following items should be included in your drawings as applicable(exhibits should be 9 Va x I I or be able to be folded to 8 4;x 11): I. Site plan showing location of improvements; 2. Elevation drawings of die specific improvements; 3. Detailsrprofiles(i.e.moldings,fence caps,comices,vents,etc.); 4. Materials(i.e.wood,brick,etc.); 5. Dimensions(i.e.size of trim):and 6. Transformers,heat pump and condenser locations,electrical entries and meters,lamp posts,stove pipes. H. At the hearing,the Commission will discuss the application with the applicant or his representative,hear the abutters and take a vote. Owners having professional cunstdrwts such as architects or Contractors are urged to have them be present at the hearing. Iftheapplicalionisapproved. a Certificate will be mailed to the mailing address provided on lire appliealion and copies will be sent to the City Clerk and Building Inspector. Please note that the application can be continued lentil the next meeting if the Commission deems necessary(i.e,for reasons of incomplete drawings,to perform o site visit,etc.). In any case,the Commission must make a determination within 66 days frau the date the application is received,unless the applicant waives that requirement in writing. L A property owner or a contractor cannot receive a building permit unless a Certificate has been issued. Please be sum to obtain appropriate permits from the Inspector of Buildings(or other necessary permits and approvals)prior to commencing work. J. The homeowner may opt not to commence the work approved(unless it relates to resolvingan outstanding violation). Work contmencedmusi be completed within one year from the Certificate date unless otherwise indicated. K. The City of Salem reserves the right to inspect the project to determine compliance with the conditions set forth in the Certificate issued. Violations A person commencing or completing work to the exterior of a buildiag in an historic district without the necessary approval of the Commission is subject to fines of up to$500 per day from the date of violation. Tile Commission is not responsible for an owner's neglect to inquire about necessary City permits end approvals. In the recent past concerning Mr. Becker and his plans for his Derby St house off of Hodges court there seems not to be a concern for environmental issues.That is the seepage of oil from the past Pickering Oil in Derby St. Even though it is a fact that the city has found the oil around cables. In my mind------- Mr. Becker in taking a calculated risk with digging in this area. In Mr Becker's plans, which are not clear,there is not clarification of footage in various yard plans. If he is asked to have a two car opening by the board, than the footage of the greenery facing the Derby St Historic District is greater than a four car opening.That would give Derby St 40 more feet of greenery. The board should specify the footage to make sure that this does not turn into a larger parking area that is less greenery for Derby St. The board should also look at the traffic flow and cross walk of visitors who are pedestrians, and trying to walk across the street, in this already congested ----- area with enormous trucks constantly maneuvering back and forth between the Bung Hole Liquor Store and all restaurants around. It is very difficult. 1 I have sent some legal papers from 1950 tha.specify,when Frank E Raymond bought the 27 Herbert St property the,e became no right away at all. These legal papers have been sent to Patti Kelleher. Another issue that comes to mind is that there is no information in Mr. Becker's plans that address the entry and exit of renters to and from his house. If he has a larger yard, renters will enjoy more otherwise,there is little outdoor space for them. I would like to know,what is Mr. Becker planning against the rest of my property line,across from his back door? Also what is the footage? I hope he finds a proper place for his full garbage cans and that they don't continue to be placed against my fence facing my guests. I do not know the building regulations for how close a driveway can be to a corner. I know the new standard is also no parking within 20 feet of crosswalks. Not sure about driveways and crosswalks however.The council should also be notified about this because they would have to authorize moving a crosswalk or taking out meters as they are in charge of city street ordinances.These setbacks can most likely be found in the MUTCD. I believe curb cuts go through building and engineering. Those two departments must have the regulations. Historical Background: The Derby House is believed by the current owners to have been constructed in the 1740s and to have been the boyhood home of Elias Hasket Derby(1739-1799), Salem's most prominent merchant of the late eighteenth century and America's first millionaire. These associations are confirmed by the Historic American Buildings Survey which identifies the house as having been the home of Richard Derby(1712-1783)at the time of the marriage of his son, Elias Hasket Derby and Elizabeth Crowninshieid for whom he purchased a house lot at 168 Derby Street in 1760. The physical fabric of the Derby House also supports a construction date in the 1740s. Architectural Evolution: As the Derby House currently stands, it appears to be the result of two major periods of construction, both in the mid-eighteenth century, and at least two subsequent periods of minor alteration in the early nineteenth century when the front entry porch may have been added and the early twentieth century when the northwest room at the first storey (former kitchen) was remodeled, exterior clapboards& sash were replaced, and several minor changes were made to the front door,north cellar bulkhead and east entry porch. Despite these several alterations, the form of the house remains largely unaltered from the eighteenth century and the interior possesses an exceptional number of original finishes. The earliest portions of the Derby House appear to be contained in the building's western half. This section of the house follows a characteristic New England pattern consisting of a large central chimney and one-room deep floor plan. As originally built, the north room of this section possessed a massive kitchen fireplace (now partially concealed by a later fireplace). Also surviving from this initial period of construction are a staircase with vase-turned balusters that rises in stages in front of the chimney stack, and a south parlor with a paneled fireplace wall and a fine corner cupboard with a shell arch. The second storey preserves an exceptionally fine south chamber with a paneled fireplace wall 1 t d eZ0 o f 'Z l b l qac decorated with fluted pilasters,raised panels with bolection mouldings and what appears to be a moulded stone surround with paneled plinth blocks,now painted,at the fireplace. Physical evidence suggests that the original house was more than doubled in size in the mid-eighteenth century by the construction of the building's eastern half and Beverly jog_ Floor heights in the eastern room are one step above those of the original house, suggesting that floor framing was laid atop existing sills and girts rather than tied into them There is no evidence at the cellar or attic in the form of paired sills or plates to suggest that the eastern half was a separate building that was moved to the site. Finishes and floor plan in the eastern half of the house suggest that it was constructed as separate living quarters,perhaps for a second generation of the family. This section of the house possesses a central hallway and staircase with vase-turned balusters and joined railings, a south parlor with comer cupboard and a north kitchen with a large kitchen fireplace that may have been rebuilt in the early nineteenth century. The east section of the house is served by two chimneys on which all fireplaces except the kitchen are angled comer fireplaces with paneled chimney-breasts. The existence of separate cellars for each half of the house and separate attic stairs provides additional evidence that the house contained two separate living quarters. Throughout the interior,all sections of the house retain original paneled chimney-breasts, doors&wainscots,lime plaster walls, wrought-iron hardware and other original finishes. Existing Conditions—Exterior. A. Site Drainage, Gutters& Downspouts—The property slopes gently from north to south to Derby Street where it drops nearly one storey and is held in place by retaining walls that flank the house. The varied sizes and finishes of granite blocks at the foundation of the house's south end suggest that this portion of the property was rebuilt in the late 19's or early 2e century, perhaps as a result of a street widening. Retaining walls rise slightly above grade and may hold water close to the foundation. The southwest downspout is aimed directly at the foundation and drains into a hollow against the building's southwest corner. Toward the northeast comer,grade levels are slightly higher than the house's sill. Concrete has been added at the north and east elevations of the foundation, presumably to protect the sills from and direct rainwater run-off(Photo#1). Such a build-up of concrete rarely serves this purpose successfully and often traps moisture that hastens the decay of sills and posts. Half-round gutters of galvanized iron exist at the east elevation of the house,all three elevations of the east entry porch and two elevations of the north entry porch. At the fagade(west elevation)the gutter has been replaced with a moulded aluminum gutter that sags toward its midpoint and may no longer drain to downspouts. I have sent to you a history of 27 Herbert St which is on the Washington Register of historic houses. It is one of the oldest homes 1712 thru 1783, in Salem and which has an amazing amount of original interior and I had a Boston historical expert give a rundown on it's history. His name is Brian Pfeiffer. He was impressed with it's original condition. He has steered me in keeping it functioning in the area on 27 Herbert St. by suggesting water drainage, repair of chimneys and clapboards,and other useful information to maintain the home. There are massive fireplaces behind the walls off fireplaces in areas that are walled in. It was described as a gem by Pieiffer. it also have sent some rules and regulations for the historical commission which i had here which speaks of the question of appropriateness of a visible and working parking area off Derby St. This is an obstruction to traffic on foot and in cars and trucks and certainly offensive in view of Derby St. Also it has not been proven that there is not an oil environmental concern. I have a hardship problem that has not been properly addressed by the historical committee group in that this parking situation will cause fumes and light disruption at my home. Evaluate the characteristics of this building in terms of other buildings within the community. This 2 1/2-story, 8 x 2-bay, center-entry, 2-family house first appears at the present location between 1906 and 1911. Its stylistic features, however, are of a much earlier, mid-19th century, building, suggesting it may have been moved to this site. Greek Revival elements include the save treatment of ogee cornice with frieze and gable returns and the Italianate Classical, post and lintel surround. The latter includes a heavy cornice cap accented by small, paired, jig-saw cut brackets, framing the center, entrances of paired, recessed, entries of nineteenth-century, 4-panel doors surmounted by transoms. Fenestration consists of 2/2 double-hung sash with molded trim. A pair of slim, interior chimneys stand on the ridge line. HISTORICAL NARRATIVE _ See continuation sheet. This large, frame, multi-family was built in 1908. The atlas of 1911 attributes it to Anna Rock, but she is not listed in local directories. Early tenants reflect the changing ethnic nature of the area and include Irish, Jewish, French Canadian and Polish surnames. Some are tradesmen, but most are laborers or workers in local leather or shoe factories. Mass. at the historic Richard Derby Home. I am sending a short e-mail to express my concern mainly environmental, in removing any soil that now abuts Derby St. and Hodges court. It is a concern of mine since the buried oil tanks are most likely releasing oil in various areas. I believe the city has recently put a sand like mixture on Derby St and covered it with black top. A low spot on the corner of Hodges court and Derby collects and puddles with what looks like oil residue. This area is the area where a neighbor, Mr Becker wants to have the activity of digging out soil and making a parking space. I believe this is not a well thought out idea for the welfare of the two historic homes that he is between. If, in fact, this is oil that is puddling, than why take the chance of fire. The deeper one digs, the more oil seeps into the area and it also is near where pedestrians walk the cross walk. In 1974 my father, Frank e. Raymond Jr. and his brother Sumner Raymond, a lawyer wrote a letter expressing their concerns of fire once the tanks began to deteriate. With what is being asked rT Mr. Becker, we in the historic b cr d U99:60'9 90 004 to Salem. Mass planing commission district are asking for trouble. We are acting in an unsafe manner. As my father said, " It would take only one spark to ignite the massive tanks_" With activity of cars, and people coming and going and cigarettes thrown around oil on puddles of water, it is very chancy. Why take the chance Do what is logical and say NO to chance. It means we are protecting our historic district and the lives of people there in. I believe we must set up a plan to make the best possible decisions in situations such as this and keep in mind the logic of what we are truly facing. There can be parking lots built by investors, right in the area but not on abutting areas of this potential disaster sight. Dear Pattie Kelleher, 1 --- rules-- three from the historical commission. They are: 1 .--Derby St. historical district.-- 1971 and map 2---Salem Planning Dept----General laws of Mass. 3---Salem Historical Commission guidelines All aggressions against me as a Salem citizen and tax payer and land owner include: 1 ---Air pollution—CO2 from cars coming and going into a proposed parking lot under my bedroom window of the house that has been there since 1730. 2.--Noise pollution from the parking lot of cars coming and going. 3--- light pollution from the cars and probable other lights. I consider all these pollutions an aggression against a neighbor. The second item which I will speak of is concerning the subject of erosion. 1 ---Because our side yards have been joined and one to another on my back yard area, since 1730, the stability of the land depends on them both. If the land is changed or moved, the stability becomes unstable and both of their foundations are at risk. The very large tree is a stabling force for both yards. The map shows where they are buried and the abutter addresses. At a previous meeting I was at, there was talk of oil coming up in a school yard. If the Baily's and myself are abutters in the buried oil situation, then why haven't we had yearly reports on the condition of the buried hazedous waste—also other abutters. My feelings are that the tanks are deteriating [of course since they were buried in 1974] and oil is seeping into the ground. Ground water can not be absorbed into the soil, if oil were there, and erosion would occur. Which might be occurring in my neighbor's yard now. If my neighbor takes soil from his yard to build a retaining wall, he might meet bad soil with oil. If we are experiencing oil contamination, shouldn't we as abutters have updates on the condition of these tanks. Should'nt the city, state or federal government give the abutters yearly evaluations of the condition that exists? Perhaps if there is someone with erosion problems, we should be caucious and try and fix it, without making it worse by taking out more soil, and causing a neighbor to have the same problem. If my neighbor takes soil from his yard, it can not be a clean cut, and my ground will be effected and erosion will take place in my yard. A retaining wall to build a parking lot would be a sore sight to the historic district and a disaster to my property and life. Part Two--- the time we live in All through the United States, we are living with mistakes of the past, environmentally. We in the historic district are living with one concerning contaminated soil. Our soil on our waterfronts is eroding due to rising water and tides. I see it in cities such as Chicago. The known treatment for now is more soil, grass and trees to absorb the excess water. The soil in our historic district must be protected in this manner, if we are to maintain a seaside, which is most important to our health and economy. We must have elevated soil not take it out for parking spaces made of black top with no ability for absorption.. Richard is father of Elias Hasket Derby, of the brick Derby house, next to the custom house on Derby Street. 27 Herbert Street is a beautiful piece of Salem Maritime history. The home is pristine in its architecture and historical shape. Very little over time has been done to alter it's original condition. A Boston architectural person, Brian Phiffer, has said that it is an architectural gem.. this home is precious to the maritime history of the area. The "bunghole"property across the street has been a problem, as it is liscenced as a package store, and not for serving liquor and they sell nips which people drink before leaving the store and at least twice a year someone 1 plows through my fence .Nips should not be sold there—please look into this. The "bunghole story" gives a bad impression of the area. To get to the letter you sent concern-ng Salem Residential Rental Properties, I hear from tenants that they have been told, that their new owner wants to build retaining wall against my property in order to build an underground garage. This is very dangerous to "The Derby Ward Home", as it probably would cause the same erosion to my property that now exists at the previous Benton home, now owned by Salem Residential Rental Properties. The old Benton property has eroded grounds due to excess water and lack of grass or plantings and lack of rules for tennants. An overgrown beautiful tree, not properly taken care of, now supports the yard soil and keeps more erosion from taking place. The tree ca_-i be massively cut back and see if it lives, and a retaining wall built on Derby St. plus plantings in the yard and grass and a few rules for tenants. Perhaps smaller trees,hedges to secure the fence and smaller plants or bushes. What I am trying to say is You as historical watch people must watch the present owners to see they dcn't spoil Salem historical maritime history. I have lived many years, I have seen much that has gone on in real estate markets. There are ruthless individuals who only care for the "almighty buck",with little concern for history, architecture or people or people involved in such—only the buck. The job of the Historical Commission I feel is to protect historical homes and areas such as 27 Herbert St. from the aggression of people who only care for the dollar. The concerns I have with the plans of my neighbor's proposal for a parking garage or space is as follows: 1—A garage or parking space--It will take over an entire yard. There will be no grass to absorb water to fight erosion. There will be air pollution, noise pollution, and light pollution with cars all times of the day and night. It will be like living in the street. 2—Esthetics in a historic neighborhood--a garage will be an eyesore and look like a factory complex with no grass or yard as the Baily's and I have tried to inspire. 3—Erosion-- There is erosion that could be helped by grass and plantings. Other reasons for erosion might be environmental. Perhaps oil seeping into the soil which would cause water not to be able to be absorbed easily. Digging a foundation for a garage would be dangerous for my house as my foundation is so near to the area where you would be digging and erosion would happen to my land. 4—Buried Pickering Oil -- The 4th and final concern and the most important is a potential environmental hazard, which I am an abutter of (in reference to the map with the tanks of oil) so are the Baily's and other's. The neighbor's plot is between two abutters of the buried oil. Any digging you do will be consequential. The conclusion is: Given our lack of knowledge, it is ill advised to permit building on this land that is so close to an unstable environment of oil and potential hazard. I would like a written report from the city or government concerning the present condition of the buried oil on Derby street and the probable deteriorating tanks.
