The Petitioner seeks a Special Permit per Sec. 3.3.3 Nonconforming Structures of the Salem Zoning Ordinance to structurally change the existing nonconforming structure. Statements of fact: 1. Larissa Lucas,petitioner, presents the petition. 2. In the petition date-stamped May 23, 2016 the Petitioner requested a Special Permit per Sec. 3.3.3 Nonconforming Structures to allow the petitioner to structurally change the existing non-conforming structure. 3. The petitioner proposes to construct an enclosed four (4) feet by five (5) feet structure in the rear corner to square off the building where there is currently an existing shed of the same dimensions. 4. The expansion will provide for a small kitchen expansion and rear entrance to the house. 5. The property is located in a historic district and the Salem Flistotical Commission reviewed and approved the proposed work ruling that the construction was in conformance with the historic character of the building and neighborhood. 6. The requested relief, if granted, would allow the Petitioner to structurally change the existing non- conforming structure. 7. At the public hearing nine (9)members of the public spoke in favor of, and nonein opposition to, the petition. The Salem Board of Appeals, after careful consideration of the evidence presented at the public bearing, and after thorough review of the petition, including the application narrative and plans, and the Petitioner's presentation and public testimony, makes the following findings that the proposed project meets the provisions of the City of Salem Zoning Ordinance: City of Salem Board of Appeals June 29,2016 Project: 15 River Street Page 2 of 2 Findings for Special Permit: The Board finds that the structural change is not substantially more detrimental that the existing nonconforming structure to the neighborhood. 1. Social, economic and community needs served by the proposal are not affected. 2. Traffic flow and safety, including parking and loading will not be affected. 3. Adequacy of utilities and other public services will not be affected. 4. Impacts on the natural environment, including drainage will not be affected. 5. Neighborhood character- The proposed addition conforms to the character of the neighborhood and structure. 6. Potential fiscal impact, including the impact on City tax base and employment is positive. On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5) in favor (Ms. Curran (Chair), Mr. Duffy,Mr. Copelas, Mr. Watkins, and Mr. Tsitsinos) and none (0) opposed, to grant a Special Permit per Sec. 3.3.2 Nonconforming Uses of the Salem Zoning Ordinance to allow the petitioner to change a use from one non-confottning use to another non-conforming use, subject to the following terms, conditions and safeguards: Standard Conditions: 1. Petitioner shall comply with all city and state statues, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. Exterior finished of the new construction shall be in harmony with the existing structure. 6. A Certificate of Inspection is to be obtained. 7. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to the Planning Board. The concern was investigated on Thursday May 10,2016 by our office and after review the zoning issue is valid. At the time the permit was issued, a site plan was not provided with the application showing the proximity to the lot line and alteration to an existing non-conforming structure. Additionally, the wording of the permit application made me believe that this was a box bay, not an addition to the home. I am sorry for the confusion but at this time, I must revoke Permit No. B-16-427, issued on May 6, 2016, and issue a new permit so that your contractor may continue other parts of your project not related to the construction of the addition. . The City of Salem Zoning Ordinance requires, a Special Permit, issued by the Zoning Board of Appeals,to alter the pre-existing non-conforming structure. The City's zoning ordinance provides: 3.3.3 Nonconforming Structures. The Board of Appeals may award a special permit to reconstruct, extend, alter, or change a nonconforming structure in accordance with this section only if it detennines that such reconstruction, extension, alteration, or change shall not be substantially more detrimental than the existing nonconforming structure to the neighborhood. The following types of changes to nonconforming structures may be considered by the Board of Appeals: LReconstructed, extended or structurally changed; 2.Altered to provide for a substantially different purpose or for the same purpose in a substantially different manner or to a substantially greater extent. I can understand your disappointment with the chain of events, but this actually may have saved you a larger and more expensive problem in the future. A Building permit, issued by us, can be challenged for up to six years after the issuance of said permit. Section 303 . 2 of the Code states clearly that "exterior walls of Type 4 frame construction shall not have openings of any type when located three (3) feet or less from interior lot lines" . Inasmuch as one corner of the building lies 3 . 17 feet from the Interior lot line, as shown on enclosed copy, of a portion of plan recorded at the Registry of Deeds , Plan Book 217 , Plan 22 , the building is shown to be sited In at a slant . This slanting creates a distance of less than three (3) feet on the other corner . It Is then readily apparent that no windows ( "openings" ) may be placed Into the rear wall of 15 River Street . Accordingly, It Is my opinion that the Historic Commission should not approve a design of this house that has windows on that side of the building . Ms . Gadala also has serious concerns with other problem areas which windows would create for her such as diminished privacy, Increased noise, the appearance of the windows from Andover Street , Annie C. Harris: I have inspected the building as per your request and found the following work to be performed prior to closing-in. 1 . Install 2 x 8 ledge below all floor perlins in the existing floor at the carrying beams in the bath- room on the first floor . 2. The second floor landing at the main entrance will be reframed to accommodate the new spiral stair . Minimum height clearances shall be satisfied. 3. Hangers or 2 x 4 plates shall secure all floor perlins in the remainder of the building. Difficulties surrounding approval from the local historical society have forced the owner to forego ridge vents. In my experience, a simple roof structure similar to the new roof at 15 River Street will not be adversely affected. There will be some "fishmouthing" of the shingles and they may wear more quickly, but they will perform as otherwise intended. Jennings Residence, 15 River Stree= Dear Mr . Santry : At your request, Mr . Jeremiah Jennings retained a Structural Engineer to provide recommendations and inspectional services for ongoing renovations to his residence at 18 River Street in Salem . As you know, this house required considerable §tFUG tUra.l upgrading to both the existing framing and foundation conditions . Last December , during the initial stages of construction, I surveyed the house and made a series of recommendations regarding structural upgrading to the house. On May 3 1989, I inspected the completed framing and foundation conditions . The foundation walls were rebuilt in some areas where the existing foundation had deteriorated . The new foundation was constructed with reinforced masonry and is in sound condition. The main carrying beams supporting the first floor and bearing walls above were either replaced or reinforced with additional posts . Deteriorated beams and other framing elements in the remainder of the house were replaced or permanently reinforced. A new shed dormer was added and adequately framed . The majority of the original second floor framing was in sound condition and left in its original condition in keeping with the historical background of the house. This floor will be used for bedrooms with minimal live loads and is structurally adequate for its intended use.
