SCOGLIO, TRUSTEE FOR A SPECIAL PERMIT FOR 3 RIVER STREET , SALEM C I T y L. nc S, .L _. - A hearing on this petition, was held November 30, 1983 with the following Board Members present: James Hacker, Chairman; Messrs. , Charnas, Hopper, Luzinski and Associate Member Bencal. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner requests a Special Permit to allow him to convert an existing two- family dwelling into a two unit condominium in this R-2 district. The Board of Appeal, after hearing the evidence presented at the hearing, makes the following findings of fact: 1 . Petitioner has failed to present sufficient credible evidence concerning the degree of hardship which would be caused by the conversion on existing tenants, and the steps, if any, taken by petitioner to alleviate such hardship. On the basis of the above findings of fact, and on the evidence. presented at . the hearing, the Board of Appeal concludes as follows: 1 . Because of the dearth of credible evidence presented, the Board cannot assess the degree of hardship the petitioner's plan would have on existing tenants, nor can it assess what steps, if any, petitioner has taken to alleviate any such hardship. McIntosh One Salem Green zap-nzi� March 2, 1983 TO WHOM IT MAY CONCERN: RE: 3 River Street The Massachusetts State Building Code Section 2101; paragraph 6.2 requires a minimum of seventy (70) square feet for each habitable room. • The requirements for stairways is a minimum of three (3) foot clearance. The construction of an interior stairway may violate the square foot requirement for habitable rooms as it relates to the rear ell of the above referenced property. The minimum standards of fitness for human habitation calls for seventy (70) square feet of floor space for one person occupying a bedroom, fifty (50) square feet minimum per person if more than one person is occuping a bedroom.
