Under the provisions of 780 CMR, Section 115.6, State Building Code, access to this property must be granted for the purposes of inspection. Please call this office upon receipt of this letter to schedule this required inspection. If this property has rental units, these tenants must be notified in advance of this inspection, so that access to these spaces may also be accomplished. This inspection must be completed on or before April 10,2006 ; failure to respond to this notification will result in fines and or a complaint being filed in Salem District Court. We purchased this home on October 20, 2005 at this time the basement was half done. This area consists of a bathroom, 2 rooms and a kitchenette (sink, cabinets and no stove).At no given time since then has this basement been used as a rental unit. As you observed on March 27, 2006 the area has been used as a family room/game room as well as storage. On March 27, 2006 you mentioned that we would be receiving a letter informing us of the results of this inspection. In this letter we were to be made aware as to whether or not changes to this area must be made. As of today's date (4/18/06)we are still awaiting the arrival of this letter. William 11 Rawlins Street Salem, MA 01970 March 6, 2006 City of Salem Building Inspector Mr. Thomas St Pierre Salem, MA 01970 Re: 8 Rawlins Street Salem, MA 01970 Dear Mr. St Pierre, Recently the two family located at 8 Rawlins Street was sold. The new owners apparently are under the impression that the house is a three family. The basement of the residence has been occupied since the purchase. Neighbors are questioning when this house became a three family without the neighborhood being notified that this change was occurring. This is creating a number of issues in the neighborhood. They are increase traffic,parking issues and weekend and weeknight late night music and noise, cars coming and going all hours of the night an early morning hours. Recently a car from this apartment parked blocking access to the stairway entrance to our house, which I consider very dangerous. Also the end of the car was over the driveway cut making it very difficult for me to get out and back into my parking space. When the owner was confronted about this vehicle his reply was "How do you know that car belongs to someone in my house"? We asked him to check and sure enough the person who owned the vehicle was an over night guest of the basement tenant. The vehicle was then moved. The owners have been spoken to numerous times about the issues of the music and the cars,but still the problem persists. Never having been a landlord I am not sure what the proper channels are that one would need to go through to have a house changed form a two family to a three family. That is the purpose of this letter, though it is my understanding that abutters are notified and involved in any requested variances to property. This is an area I need clarification on.
