DECISION ON THE PETITION OF MR, AND MRS, GILBERT GILLESPIE REQUESTING A SPECIAL
PERMIT FOR 5 RAVENNA AVENUE,
Pursuant to a proper notice of public hearing, a public hearing was held
on September 26, 1979 on the petition of Mr. and Mrs. Gillespie requesting a '
Special Permit to construct a carport to be attached to the front of their
residence at 5 Ravenna Avenue. The subject matter of this request previously
came before the Board of Appeals when petitioners requested a variance to
construct the carport in question on June 20, 1979. That request for a variance
was denied by the Board of Appeals. The Board of Appeals denial of that variance
is currently on appeal in the courts.
This request for a Special Permit is in the opinion of the Board of Appeals
improperly filed since the request must, in fact, be viewed as a request for a
variance from the side and front setback requirements of the Zoning Ordinance,
Accordingly, on the basis of this Board's prior decision on this matter, the
Board of Appeals by a 4 to 1 vote, votes to deny the requested Special Permit.
Chairman Boulger, Messrs. LaBrecque, Piemonte and Feeherry voting to Deny the
Special Permit; Mr. Nutting voting to grant the Special Permit.

The height of your boundary wall and fence measured
from your back yard is 7 ' 6". The City of Salem.
Zoning Ordinance states that it shall not exceed
6' 0". You must therefore take the necessary action
that will insure compliance with the Zoning Ordinance.

A. Residential uses
A dwellin- hereafter erected in an; district shall be loc
on a lot having not less than the minimum requirements s
e forth in TABLE I , and no more than one d^selling shall b=
built upon any such lot . No existing lot shall be Chang e
in size or shape so as to result in a, violation of the
requirements set forth in TABLE I .
In interpreting TABLE I , the following provisions shall
apply:
1. The minimum front yard depth reo .;ired shall be measurad
from the right-of-way line, t-;here a plan of the right-
of-tray is on file with the Regis=ry of Deeds , or from
a line thirty-five ( 35) feet fro-1 and parallel wik.h
the center line of the traveler .ay; in the absence of
of such a plan, to the front building line.
2. The minimum side yard width required shall be neasured
from the side lot line to the side building line, and
the mininum rear yard depth required shall be measured
from the rear lot line to the rear building line.
3. On a corner lot , the minimum froat yard depth rather
than the minimum side yard width shall be applied to
determine the setbaci; of any building from lot lines
abutting any public tray .
4. The minimum lot width required shall be measured at the
rear of the required front yard depth and on a line
parallel to the right-of-way line, .here a plan of the
right-of-way is on file with the Registry of Deeds , or
from a line twenty-five (25) feet from and parallel c:ith
the center line of the traveled ^ay, in the absence
of such a plan.
5. The building height shall be measured fro!-,i the average
elevation of the proposed finished grade at the front
line of the building to the highest point of the roof
for flat roofs , to the deck line for mansard roofs , and
to the mean height between eaves and ridge for gable ,
hip, and gambrel roofs . Fences and walls shall be
measured from the finish Rrade vertically to the highest
point .

Density Regulations in R-1 Districts will not apply to Dormitories built
. by the Salem Hospital or the Commonwealth of Massachusetts State College
at Salem.
These density regulations relative to height will apply to all housing pro-

jects even though financed in whole or 'in part by the U.S. Public Housing
Authority and/or Commonwealth of Massachusetts, Department of Community
Affairs, Division of Public Housing. Specifically excluded will be housing
for the elderly constructed by the Salem Housing Authority.
* Multi-family dwellings building in R-3 Districts on lots held under a single
$+ ownership and consisting of a minimum of two hundred thousand (200,000)
square feet may be built to a maximum height of 50 feet or four stories in
height (2/3/75) .
