McIntosh Zoning Enforcement Officer Public Property Dept. One Salem Green Salem, MA 01970 Dear Mr. McIntosh: Mr. and Mrs. Gilbert Gillespie,;5"Ravenna Ave:,_Salem, MA received a notice from your department regarding a fence in their back yard. I have known Mr. Gillespie for many years and find that he is an outstanding citizen and a fine gentleman. If there is any consideration you might give him to avoid this financial hardship, it would be most appreciated. Very truly yours, . George A. Aubertin RFi f :V`:D Ctu of Am 179 { 9. Pv=b of 1P2i1 CST'! ucFICE SALEM, MASS. SEPTEMBER 26, 1979 DECISION ON THE PETITION OF MR, AND MRS, GILBERT GILLESPIE REQUESTING A SPECIAL PERMIT FOR 5 RAVENNA AVENUE, Pursuant to a proper notice of public hearing, a public hearing was held on September 26, 1979 on the petition of Mr. and Mrs. Gillespie requesting a ' Special Permit to construct a carport to be attached to the front of their residence at 5 Ravenna Avenue. The subject matter of this request previously came before the Board of Appeals when petitioners requested a variance to construct the carport in question on June 20, 1979. That request for a variance was denied by the Board of Appeals. The Board of Appeals denial of that variance is currently on appeal in the courts. This request for a Special Permit is in the opinion of the Board of Appeals improperly filed since the request must, in fact, be viewed as a request for a variance from the side and front setback requirements of the Zoning Ordinance, Accordingly, on the basis of this Board's prior decision on this matter, the Board of Appeals by a 4 to 1 vote, votes to deny the requested Special Permit. Chairman Boulger, Messrs. LaBrecque, Piemonte and Feeherry voting to Deny the Special Permit; Mr. Nutting voting to grant the Special Permit.
