Dear Mr. Reither:
I have received and reviewed your to build 4 town houses at 12 Putnam Street. This
project was subject to a Zoning Board of Appeal Decision.
That decision had several conditions, one of which was that the project be built per the
plans submitted.
The plans you submitted do not resemble the plans that were submitted at the Zoning
Board of Appeals hearing. Both the number of stories and the outline of the footprint
are different
At this time, I must refuse to issue you a building permit for this project.
You have the right to appeal my decision to the Salem Zoning Board of Appeals.

A public hearing on the above petition was opened on July 19, 2006 pursuant to Mass mg
General Law Ch. 40A, Sec. 11, the following Zoning Board members being present: Nitta v
Cohen, Annie Hams, Richard Dionne, Robin Stein and Steve Pinto. ry
The petitioner George Van Cott is requesting a variance pursuant to section 9-5 to allow
for amendment of a previously approved site project located at 12 Putnam Street, Salem,
MA to allow for a change in the number of stories from three (3) to Four(4), and to
change the design of the previously approved structure located in the Two-Family (R-2)
zoning district.
The petitioner is requesting a variance from maximum number of stories required in the
City of Salem Zoning Ordinance which is two and one-half(2 '/z)in the R-2 district, and
having previously obtained a variance to build up to three (3) stories, is now proposing to
build up to four(4) stories.
The petitioner is also proposing a design change to the previously approved plans.
The Board of Appeals, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the Plans and Petition submitted, makes the
following findings of fact:
1. The property at 12 Putnam Street is within the Two-Family (R-2) zoning district.
2. The petitioner proposes to construct a four-story multi-family residential structure
with attached, first-level garages. There would be a total of four residential units
in the structure.
3. Four parking spaces will move from their exterior locations to the interior
garages.
4. The dwelling units are each approximately 1,200 sq. ft. in size, excluding the
garage space.
5. Nine (9) members of the public spoke in opposition to this petition.
6. Two (2) members of the public spoke in favor of this petition.
On the basis of the above findings of fact, including all evidence presented at the public
hearing, including,but not limited to, the Petition and detailed plans, the Zoning Board of
Appeals concludes as follows:
1. The petitioner may construct the structure per the amended plans within in the
R-2 district.
2. The petitioner's request for an increase in the number of stories does not
constitute a substantial detriment to the public good.
3. The proposed amendment does not nullify or substantially derogate from the
intent or purpose of the zoning ordinance.
4. In permitting such change, the Board of Appeals requires certain appropriate
conditions and safeguards as noted below.
In consideration of the above, the Salem Board of Appeals voted, five (5) in favor
(Cohen, Dionne, Harris, Pinto, Stein) and none (0) opposed, to grant the request for a
variance and amend the previous decisions of April 20, 2005 and May 10, 2005 to allow
construction per the plans drawn by David Jaquith dated April 19, 2006, subject to the
following terms, conditions, and safeguards:
1. The developer shall change the roof pitch from a 10/12 pitch to a 9/12 pitch.
2. The developer shall lower the entire site by three (3) feet.
3. The developer shall limit the amount of bedrooms per unit to two (2).
4. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
5. All construction shall be done as per the plans and dimensions submitted to and
approved by the Building Commissioner.
6. All requirements of the Salem Fire Department relative to smoke and fire safety
shall be strictly adhered to.
7. Petitioner shall obtain a building permit prior to beginning any construction.
8. A Certificate of Occupancy is to be obtained.
9. Petitioner shall obtain street numbering from the City of Salem Assessor's Office
and shall display said number so as to be visible from the street.
10. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Planning Board.

Appeal from this decision,if any,shall be made pursuant to Section 17 of the Massachusetts General Laws

Pursuant to the Massachusetts General Laws Chapter 40A,Section 11,the Variance or Special Permit
granted herein shall not take effect until a copy of the decision bearing the certificate of the City clerk that
20 days have elapsed and no appeal has been filed,or that, if such appeal has been filed,that it has been
dismissed or denied and is recorded in the South Essex Registry of Deeds and indexed under the name of
the owner of record or is recorded and noted on the owner's Certificate of Title.

Reconsideration of Building Permit Application
Dear Mr. St. Pierre:
As you know your office,on April 26, 2005, denied a building permit to Joe Reither
based on the submitted plans of his architect. I represent George VanCottttcurrent unit
owner,who is under agreement to sell the lot in question, the closing of which is i
contingent on Mr. Reither's approved building plans.
Mr. VanCott's originally submitted plan incorporated into and approved by the Board of
Appeals always included a.30' x 80' footprint(see enclosed). The cut out portion of the
footprint was to be covered by a stairway,porch and porch roof without a foundation,
under the original design of architect, Harry Gundersen. j
The elevations should be tracked to the originally approved three (3) story structure (See
copy of Mr. Gundersen's rendering), which for purposes of the final footprint was flip
flopped to be located on the opposite side of the property.
Mr. Reither's rendering follows the three(3) story structure format as well, with the first
story dedicated to individual indoor garage units.

The applicant will also be complying with all the approved materials set forth in the list
enclosed, except that the hardiplank siding will be replaced by wood siding,which had
been the original request of Historic Salem, Inc. and the Ward 4 neighbors. The architect
explained that it has the same appearance as wood siding,but was allegedly a more
durable material.

Could we arrange a meeting at your earliest convenience with Mr. Reither, Mr. VanCott
and their respective counsel, if necessary,to reconsider your April 26,2006 denial, and
the need for an appeal. It is important that both projects be built out at the same time
because of the need for the retaining wall to be built by the owner of the Putnam Street
parcel
