The hearing was closed on August 15, 2012 with the following Zoning Board of Appeals members present: Rebecca Curran (Chair), Michael Duffy,Jamie Metsch, and Bonnie Belair. t Petitioner seeks Variances pursuant to Section 4.0 and Special Permits under Sections 3.3.2 and 3.3.3 of the City of Salem Zoning Ordinances. Statements of fact: 1. In a petition date-stamped August 1, 2012, petitioner requested a Variance and Special Permits to construct a 30'x18'x12', 2nd story addition on the existing commercial building located at 8 Proctor Street. 2. Petitioner Christopher Monaco (8 Proctor Street LLP) represented himself at the hearing. 3. At the hearing, petitioner stated that there would be no increase in employees or parking needs associated with the project. 4. At the hearing, no one spoke in favor of or in opposition to the project. I The Board of Appeal, after careful consideration of the evidence presented at the public hearing, and after thorough review of the plans and petition submitted, makes the following findings: 1. Desirable relief may be granted without detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance, since the extension of the currently nonconforming use is in keeping with the neighborhood, which contains numerous other pre-existing, nonconforming industrial uses; the proposal would not increase traffic or parking needs on the site; the project would improve the property; the expansion would be only upwards within the existing footprint; and the tallest portion of the building would be on the interior of the site. 2. Special conditions and circumstances exist affecting the parcel or building, which do not generally affect other land or buildings in the same district; owing to the odd shape of the lot, areas for expansion are limited. Therefore, literal enforcement of the provisions of this ordinance would involve substantial hardship, financial or otherwise, to the appellant. 3. In permitting such change, the Board of Appeals requires certain appropriate conditions and safeguards as noted below. On the basis of the above findings of fact and all evidence presented at the public hearing including, but not limited to, the Plans, Documents and testimony, the Zoning Board of Appeals voted four (4) in favor (Curran, Metsch, Belair, and Duffy) and none (0) opposed, to grant the requested Variance and Special Permits. A Variance under Section 4.0 and Special Permits under Sections 3.3.2 and 3.3.3 are granted to allow for the proposed addition as shown on the submitted plans and elevation drawings. The Board of Appeals voted to grant petitioner's request for a Special Permit subject to the following terms, conditions, and safeguards: 1. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. A Certificate of Occupancy is to be obtained. 2 6. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to, the Planning Board. 7. Unless this Decision expressly provides otherwise, any zoning relief granted doe not empower or authorize the Petitioner to demolish or reconstruct the structure(s) located on the subject property to an extent of more than fifty percent (50%) of its floor area of more than fifty percent (50%) of its replacement cost at the time of destruction. If the structure is demolished by any means to an extent of more than fifty percent (50%) of its replacement cost or more than fifty percent (50%) of its floor area at the time of destruction, it shall not be reconstructed except in conformity with the provisions of the Ordinance. Notice of the hearing was sent to abutters and Others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner requests a Special Permit for the operation of woodworking shop and other constructed related light industrial use for the property located at 8 Proctor Street located in a R-2 zone. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is section 5-3 (2) (8), which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension of expansion, of nonconforming lots, land, structures, and uses, provided however, that such change, extension, enlargement of expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. A. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or stuctures in the same district. The nature of this operation will be to create woodworking pieces specifically for construction projects, and not for retail sale; there will be no showroom or displays. 3. The hours of operation for this business will be Monday through Friday from 7:30 a.m. until 5:00 p.m. and on Saturdays from 8:00 until noon. 4. There exists a lot that provides sufficient parking to support this business. S. Any signage for this business will be reviewed and approved where applicable by the Sign Review Board. 8. Councillor Kevin Harvey spoke in favor to this request. 7. There was no opposition to this petition. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows; 1. McIntosh , Building Inspector Dear Mr. McIntosh: Confirming my telephone conversation with reference to the continuing complaint about the rooming house occupancy of the dwelling at 6 Proctor Street . I previously forwarded a photostat showing that the previous owner of the Surrette property at 8 Proctor St. granted 60 ' right-of-way from Proctor St . plot shows driveway rights. There is just no way that 4-6 cars , plus a very active visitor traffic that ignores all posted property signs , can park without parking where they please. They have ignored your warnings of illegal use of the property , and my continued warnings to them that they are violating private property rights . In fairness I might say not all , but a few. After repeated warnings to the owner of the car in the enclosed photo , he will keep his car out for a few days , then start parking so that trucks cannot get in. This photo was taken on Saturday , the 24th. I made him remove the car , but he later parked half on the right-of-way . I have tried to cooperate, but they do as they please , never asking for permission. One of the tenants complained that his car had been pilfered at night because of the driveway building light being out . I had it repaired and have been leaving it on at night at a cost of approximately $6. 00 a month, plus the cost of the repair . What happens? Their visitors traffic now consider this a lighted public parking lot . This is posted private property. The situation that I ' m complaining about cannot be corrected as long as this property is allowed to be used as a rooming house with no place for parking except on our property . The fire dept . has been inspecting all apartments , rooming houses, etc . It is mandatory that the owners apply for a permit and inspection for compliance. I assumme noncompliance would be reported to your office . It is my wish to go through the proper enforcement channels that exist , and I would assume the Capt . Gorgin would be interested in this complaint. This letter is not intended to report every little detail , but as a follow-up on a very annoying situation. This kind of occupancy does not pay its way . We pay approximately $1 , 800. a year in taxes , and pay for private disposal service. We only have three people using these facilities (8 Proctor St . ) at this time. I believe that the landlord has made every effort to cooperate , and after receipt of the letter , the cars have at least been partially out of the driveway. I also believe that the situation of using the property as a rooming house at 6 Proctor St . , next to our property , is beyond his (the landlord ' s) control . There is no apparent parking space at 6 Proctor St. and as a result they park wherever there is space available . I am enclosing a copy of the plan showing the right of way between 6 and 8 Proctor St. 6 Proctor St. just does not have available space for the parking of all these cars. On Sunday, October 30 , for example, at 12 : 00 there were seven cars parked . One across the driveway on Proctor , three cars in or partially on the right , four of the cars were parked on the street. There are only two properties , 6 and 8 Proctor , and there was nobody at 8 Proctor . It stands to reason that all the cars belonged at 6 Proctor . Since your letter of Sept . 1 , 1 have noticed two additional cars that I have never seen before at this property. This indicates that there must be new roomers occupying part of the property. If this property is allowed to continue being used as a rooming house the situation will worsen, rather than improve. I sympathize with the landlord of the property , Maurice A. Gauthier , however , I feel until different use of the property is instigated it is going to be impossible for him to control it . If last winter is any indication , it means that after we clear the cars , when and if we can , they move right back into the plowed section. They don ' t contribute any effort in clearing the space. It is my expense to keep this space clear. This letter is intended to bring you up to date with the conditions that still exist. One of the cars was towed away from the front of the house at 6 Proctor St. The tenant who owned the car was very abusive to me even though I had nothing to do with having the car removed . He indicated that he had enough influence at City Hall that I was wasting my time making complaints . I recognize that this comment was made in the heat of anger , it also contained a veiled threat , a possibility to make trouble. I have seniority of the ownership of the properties by at least 20 years since these people have arrived . There is no previous record of any complaints. It is not my intention to move from this property , any new landlord would be far less tolerant . Rolls, Ltd . , which is the successor to Surrette Supply Co. , has been located at 8 Proctor Street for over twenty ( 20) years. We have never had any problems with the previous owners of 6 Proctor Street. The new owners are apparently using this property as a rooming house, and there are several cars owned by the occupants with no parking facilities except leaving their cars in a right-of-way that was apparently given to them by 6 Proctor Street some years ago by. We maintain and pay for hot topping and plowing in the winter time , et cetera . Their leaving their cars in the right of way deprives us of the use of it, we can not get our trucks in or out , and have to take deliveries in through our office , which is terribly inconvenient and time consuming to our office personnel. We have repeatedly requested of them to keep their cars out to no avail . The property as presently used results in it being a nuisance. They also attract a number of other cars that add to our problem. Enclosed is a plan on file showing the registered plot. Our property is posted front and side indicating no parking . It has now reachred a point where we are forced to request release from the nuisance of the use of this property as a rooming house with no parking facilities. We believe the registered owner to be Gauthier. McIntosh : Enclosed you will find a photostat of the registered letter that I sent to Maurice Gauthier in Beverly . I called Mr . Gauthier , as their was no reply to my letter , and he indicated to me that he never did receive the letter . This letter was with reference to his tenants parking all over our property. They (tenants) don' t pay any attention to us , they even indicated that they were told by Mrs . Gauthier that could park wherever they chose. To insure that they received a copy of the letter , as Mr . Gauthier said he never received my original letter , I sent another registered letter . A few days later Mrs. Gauthier called me, and wanted to know why I was sending registered letters to her , she didn ' t want any registered letters and they would not accept. I told her that if they never received the first letter , I could not understand why they would refuse a registered letter , especially if they didn' t know what it was all about . I advised Mrs . Gauthier why I was writing , and she said as long as she gets the rent she ' s not interested in what they do with the property. This almost indicates , if she is telling the truth, that she is renting the property to one individual only , that he is responsible for letting the property out to various people . There is no question in my mind that the property is being used as a rooming house. With the number of cars that are parked in and around , there is no place for them to park unless they park on our property or in the street. However , there is one individual that I have left several notices on his car asking him not to park in the right-of-way, he has ignored me completely . Therefore , on Sunday , Feb . 5 , we had his car towed . ALTERNATORS 2 The individual acted like a maniac . He was hollering and screaming and using very abusive language. He was advised if there was any matter in question to just come into the office to see me , but he never did come in. That evening I had an icepick put through my car tire twice. There were two holes , 2" apart , no indication that the tire had run over anything . The people who fixed the tire said that there was no doubt it had been punctured with an ice pick or similar object. These individuals have gotten to the point where they are now being abusive. They' re acting like we are trespassing on their rights instead of the other way around . This situation has become very strained and we are hoping that we get some relief . If they are using this property as a rooming house , which I strongly suspect , of which my only objection is the parking . We have lost the use of our shipping dock , and lately we have been bringing items in through the office because the truck drivers refuse to try to get into the yard because the cars are in the way . Because of the problem I am having next door , I am very much concerned with Edward Mello ' s request to use his property on the corner of Boston and Proctor St. ' s as wholly residential , which sounds as though they could be letting out single rooms, which sounds like double jeopardy to us. They have also got minimum parking , 3 or 4 cars at the most . If this petition is granted we will have a parking situation that will be uncontrollable .
