As a result of the inspection conducted by this office as well as the Salem Health
Department and Salem Police Department on Monday, October 22, 2012, it has been
determined that you have created and have tenants occupying an illegal 3`d floor dwelling
unit as well as two illegal units in the basement and an unpermitted bathroom at 45 Prince
Street in violation of the City of Salem Zoning Ordinance chapter 6-1 for a three (3) - unit
building in a location zoned for (R-2) two family dwellings. This office has no records of
permits for this construction and/or variance or special permit approvals for this third
floor unit. Furthermore the unit in violation contains no secondary means of egress as
required by the Massachusetts State Building Code and possible cross connections of
utilities with other units in the building
As discussed with you at the conclusion of my inspection at the site you are hereby
ordered to secure permits for its removal or legal inclusion with the second floor
apartment units within five (5) day of receiving this notice.. Additionally you are
ordered to rectify any and all cross-metering forthwith. You are hereby ordered to
immediately contact this office upon receipt of this notice; failure to respond to this
notification will be construed as non- compliance, with issuance of Municipal tickets and
including the filing of criminal complaints at District Court.
If you feel aggrieved by the Building Codes issues you have the right to appeal this order
