Dear Mr. Munroe,
As the architect of record for the Prince Street Place Renovations, I
am submitting the following report to your office. As you know, work
is proceeding. Four units are ready for occupancy, and exterior work
on the whole project is underway. The project is one third completed.
Due to several factors, construction is varying from approved plans.
One reason for construction variances involves budget considerations.
In spite of strenuous fund raising efforts by Salem Harbor Community
Development Corporation, construction funds remain limited, causing
difficulties in completing kitchen and living areas as drawn.
Another reason for construction changes are ongoing building code
interpretations by the Salem Building. Department. The interpretations
have changed basement plans, existing'egress doors, existing railings,
attic ventilation, and several other areas, increasing pressure on the
project's already limited budget.
A third reason. involves your interpretation of our approved plans to
be not within zoning code requirements. The result has been a major
change in the projects exterior porch design as drawn and subsequent
major changes in the project 's parking scheme as drawn.
The above changes have resulted in a project very different from our
previously approved plans in appearance and function.
I am not suggesting that anyone is not pursuing responsibilities in
conscientious and well-meaning ways. In future projects, however, it
would be helpful to applicants if plans were thoroughly evaluated for
zoning and building code requirements before approvals were issued and
permits granted by your office. This would give both architects and
their clients an opportunity to reevaluate projects and their cost
implications before beginning construction.

The Salem Fire Department has determined that fire figh t
vehicles will not have adequate access to the buildings on Prinl
Street Place-D This determination was made by Inspector LaPointe
on September 11 , 1987 ,
In order to make the fire lane access wide enough for fire
fighting vehicles , Inspector LaPointeoutlineda plan for parking - - -
tenant vehicles on the north side of the st.te-et up on the side-
walk. (See attached parking plan) . This would allow parking for
20 vehicles (1 1/2 parking sites per apartment and 16 apartment
units ) . Inspector LaPointe also noted that tenant vehicles should
not be allowed to park between adjacent buildings or the eastern
sides of buildings IV and IX .
The Construction requirements for this plan would be to :
a. Leave all granite curbing and side walk as is.
b. Install asphalt gravel ( "hot top" ) in locations
shown on drawing,
C . Barrier posts in locations shown on drawings.
d. Mark with painted lines locations of cars -to
be parked.
The approximate cost for such a plan would be $5,500±.
Inspector LaPointe stressed that such a plan was of the
utmost urgency and should be done before November, 1987 He
also said that he would not prevent a Fire Department sign-off
on the Certificate of Occupancy because of this matter.

This Agreement shall include the following :
1 . ASSIGNED PARKING LOCATIONS for Prince Street Place tenants :
The above Tenant shall use parking space( s ) Number as
designated on the attached diagram and spot marked on the street
of Prince Street Place .
2 . TRASH STORAGE & REMOVAL :
Trash shall --be stored at the rear of the Tenants apartment unit
outdoors in enclosed garbage cans or sealed plastic bags , The
Tenant is responsible for placing trash on the sidewalk corner
of Prince Street and Prince Street Place on trash collection days .
( Trash shall not be stored at the sidewalk corner of Prince Street
and Prince Street Place ) .
3• ACCESS TO BASEMENT UTILITY METER :
Tenants having gas meters, electric service panels , and or
boiler rooms in their basement shall keep these utility locations
easily accessible for inspection or repair. This shall include
a pathway 3 feet wide free of stored items and a duplicate key
held by Landlord for basement storage room locks .
ACCESS TO APAR`IMENT UNIT:
Landlord shall have duplicate keys for entry into the Apartment
dwelling unit , The Landlord shall only enter the dwelling Unit
Per terms of the Original Lease agreement. The Tenant shall
notify the Landlord if the Tenant wishes an apartmententry lock
changed and shall provide the Landlord with a duplicate key upon
installation of the new lock .

The Landlord will enter into a Housing Assistance payments contract' (' ract") with
a Public Housing Agency ("PHA") under the Section 8 Existing Housing of the
U.S . Department of Housing and Urban Development. Under the Contract, th�11

* B. CONFLICT WITH OTHER PROVISIONS OF LEASE .
In case of any conflict between the starred* provisions of the Lease and any other
provisions of the Lease, the provisions of these sections shall prevail ,
* C. TERM OF LEASE .
The term of the Lease shall begin on and shall continue until
( 1 ) a termination of the Lease by the Landlord in accordance with paragraph (I) of
this section, (2) a termination of .the Lease by the Tenant in accordance with the
Lease or by mutual .agreement during the term of the Lease , or (3) a termination of
the Contract by the PHA.
* D. RENT . _
* I . The amount of the total monthly rent payable to the Landlord during the term of
the Lease (called the Contract rent") shall be determined in accordance with the
Contract between the Landlord and the PHA.
* 2. The portion of the Contract rent payable by the Tenant ("tenant rent") shall be
an amount determined by the PHA in accordance with HUD regulations and require-
ments. The amount of the tenant rent is subject to change as determined by the
PHA during the term of the Lease. Any change in the amount of the tenant rent
will be. stated in a written notice by_ the PHA to the Tenant and the Landlord,
stating the new amount and the effective. date of the change. Initially and until
such change the Tenant agrees to pay $ per month to the Landlord as
the tenant rent.
* 3. The tenant rent as determined by the PHA is the maximum amount the Landlord can
require the Tenant to pay as rent for the dwelling unit, including all services .
maintenance and utilities to be .provided by the Landlord in accordance with
this Lease.
* 4 . Each month, the PHA will pay a housing assistance payment to the Landlord on
behalf of the Tenant Family in accordance with the Contract . The monthly hous-
ing assistance payment is the difference between the Contract rent and the
tenant rent.
* E. SECURITY DEPOSIT .
* I . The Tenant has deposited $ with the Landlord as a security deposit .
The Landlord will comply with HUD regulations regarding security deposits from
a Tenant, and shall not collect a security deposit which is more than the
maximum amount permitted under the regulations.
* 2. The Landlord will hold the security deposit during the period the Tenant Famil
occupies the dwelling unit under the Lease. The Landlord shall comply with Str
and local laws regarding interest payments on security deposits .
* 3 . After the Tenant Family has moved from the dwelling unit, the Landlord may
('subject to State and local law) use the security deposit, including any in-
terest on the deposit, as reimbursement for any unpaid tenant rent or other
amounts, which the Tenant owes.,.under_theLease. The Landlord will give the Ten-
ant a written list ,of all items charged against the security deposit and the
amount of each item. After deducting the amount used as reimbursement to the
Landlord, the Landlord shall promptly refund the full amount of the balance
to the Tenant.

G. LANDLORD AGREES .
* I . To maintain the dwelling unit, equipment and appliances , and common �r�fsland
facilities, to provide decent, safe and sanitary housing in accordance ' he
housing quality standards (24 CFR Section 882 . 109) for the Section 8 Exis '
Housing Program, including the provision of all the services , maintenance ai
utilities set forth in the Lease, and to comply with Chapter II of the Massa-
chusetts State Sanitary Code,
2 . To complete repairs by dates specified in notice by the Section 8 Housing
Assistance- Payments Program.
* 3 . Not to discriminate against the Tenant Family in the provision of services or
in any manner, on the grounds of age, race, color, creed, religion, sex, hand-
icap or national origin.
4 . Not to enter the dwelling unit except to inspect the premises , make repairs , or
show the unit to a prospective tenant or purchaser. The Landlord will contact
the Tenant before such entry so as not to unreasonably disturb the Tenant , who
will not be unreasonable in denying entry. Onyl in case of an emergency may
entry be made without prior ,consent. If sudh emergency entry is made, the Ten-
ant shall be notified.
H . TENANT AGREES .
I . To--pay the Tenant Rent on the first day of each month unless otherwise agreed
by the Landlord.
2. To maintain the premises in clean and neat condition and at all times comply
with the provisions of HUD. Quality and Performance Standards and Chapter II of
the Massachusetts State Sanitary Code.
3. To make no substantial alteration, addition or improvement in or to the dwell-
ing unit without prior written consent of the Landlord. Such consent shall not
be unreasonably withheld, but may be conditioned upon Tenant 's agreeing to re-
store the dwelling unit'to its prior condition before moving out.
4. Not to allow on the 'premises any excessive noise or other activity which dis-
turbs the peace and quiet of other residents or tenants in the building.
5., To use the dwelling unit solely for residence by the Tenant, and as the Prin-
cipal place of residence; and shall not assign the Lease or transfer the unit .
6 . Not to permit the leased premises to be occupied by anyone except those indi-
viduals specifically named as household members on the Housing Assistance Pro-
gram application. Guests may be accomodated for reasonable short periods of
time provided said occupancy is authorized by the Landlord, and in accordance
with the regulations of the U.S. Department of Housing and Urban Developement ,
the provisions of the Housing Assistance Payments contract and the policies of
the Housing Authority
7 . To vacate"'-the premises at -the expiration of the Lease remove all personal be-
longings, return the keys to the Landlord and leave the premises as clean and
in as good condition as he found them (normal wear and tear expected) .
8 . To allow the Housing Authority and/or Landlord to inspect the dwelling unit at
reasonable--times and after reasonable notice. -
9. To be responsible for-and pay all--damages beyoag normal wear and tear.

* I. TERMINATION OF TENANCY .
* I . The Landlord shall noC terminate the tenancy except for :
i. Serious or repeated violation of the terms and conditions of the Lease ;
V ii. Violation of Federal, Sate or Local law which imposes obligations on a
tenant in connection with the occupancy or use of the dwelling unit and
surrounding premises; or
iii. Other goo¢ cause. However, during the first year of the term of the
lease, the owner may` not terminate the tenancy for "other good cause"
unless the termination is based on malfeasance or nonfeasance of the
Tenant Family.
* 2. The following are some examples of "other good cause" fof
tenancy by the Landlord: failure by the Tenant Family to acc��//ee�he offer
of a new Lease in accordance with paragraph K 'of this sectio enoffant Fam-
ily history of disturbance of neighbors or destruction of prope r of
living or housekeeping habits resulting in damage to the unit or rty;
criminal activity by Tenant Family members involving crimes of phys cal vio-
lence to persons or .property; the Landlord's desire to utilize the unit for
personal or family use or for a purpose other than use as a residential ren-
tal unit; or a business or economic reason for termination of the tenancy
(such as sale of the property, renovation of the unit, desire to rent the
unit at a higher rental). This list of examples is intended as a non-ex-
elusive statement of some situations included in "other good cause", but
shall i:. ;;o way be construed as a limitation on the application of "other
good cause" to situations not included in the list.
* 3. The Landlord may evict the Tenant from the unit only by instituting a court
action. The Landlord must notify the PHA in writing of the commencement of
procedures for termination of tenancy, at the same time that the Landlord
gives notice to the Tenant under State or local law. The notice to the PHA
may be given by furnishing the PHA a copy of the notice to the Tenant.
* J. Any notice under paragraphs I, K OR L of this section may be combined with and
run concurrently with any notice required under State or local law.
* K. After approval of a proposed new Lease by the PHA in accordance with HUD regula-
tions, the Landlord may offer the Tenant Family the proposed new Lease for exe-
cution on behalf of the Tenant Family, for a term beginning at any time after the
first year of the term of this Lease. The Landlord shall give the Tenant written
notice of the offer, with copy to the PHA, at least sixty days before the proposed
commencement date of the new Lease term. The offer may specify a reasonable time
limit for acceptance by the Tenant Family.
The Tenant may terminate the Lease without cause at any time after the first year
of the term of the Lease, on sixty days written notice by the Tenant to the Land-
lord (with copy to the PHA) . (The provisions of this subsection L are not in-
tended to limit any right of the Tenant to terminate the Lease where so provided
elsewhere in the Lease) .
* M. This Lease has been signed by the parties on the condition that the PHA will
promptly execute a Housing Assistance Payments Contract with the Landlord . This
Lease shall not become effective unless the PHA has executed a Housing Assistance
Payments Contract with the Landlord effective the first day of the term of the
Lease.
N. PROHIBITED LEASE PROVISIONS .
Notwithstanding anything to the contrary contained in the Lease, any provision of
the Lease which falls within the classification below shall be inapplicable.
I . Confession of Judgement. Prior consent. by the Tenant to be sued, to admit guilt ,
or to a judgement in favor of the Landlord in a lawsuit broght in connection
with the Lease.
2 . Seize or Hold Property. for Rent or Other Charges, Authorization to the Land-
lord to take property, of the Tenant, or hold property of the Tenant, as a
pledge or security until the Tenant. meets any obligation which the Landlord
has determined the `tenant has failed to perform.
3., Exculpatory Clause. Agreement ^by the Tenant not to hold the Landlord or Land-
lord 's agents legally responsible for any action or failure to act, whether
intentional or negligent.

4 . Waiver of Legal Notice. Agreement by the Tenant that the Landlord may insti-
tute a lawsuit without notice to the Tenant .
5. Waiver of Legal Proceedings. Agreement by the Tenant that the Landlord may
evict the Tenant or hold or s,ell possessions of the Tenant Family if the Land-
lord determines that the Tenant has violated theLease , without notice to the
Tenant or any court decision on the rights of the parties .
6 . Waiver of. Jury Trial. Authorization to the Landlord to waive the Tenant 's
right to trial by jury.
7 . Waiver of Right to Appeal Court Decision. Authorization to the Landlord to
waive the Tenant 's right to appeal a decision on the ground of judicial error
or to waive the Tenant 's right to sue to prevent a judgement from being put
into effect.
8. Tenant Chargeable with Cost of Legal Actions Regardless of 0 come of Lawsuit.
Agreement by theTenant to pay lawyer 's fees or other legal ,(Vo ps whenever the
Landlord decides to sue, whether or not the Tenant wins. . s
0. DESTRUCTION OF PREMISES .
If the premises are rendered uninhabitable by fire, flood or other
disaster during the term of this agreement, this agreement is thereupoe�.minated.
P. ADDITIONAL PROVISIONS . /�
If any, they dhould be attached, in and dated by both parties, and be
part of this Lease.
Q. CHANGES .
No changes or additions to this Lease shall be made axcept by written agreement
between Landlord and Tenant. This Lease and any attachment represents the entire
agreement between the Landlord and the Tenant.
WHEREOF , we the undersigned agree to this Lease, by signing three copies (one to be
kept by the Landlord, one by the Tenant and one by the Housing Authority) .
