The complaints were investigated on Monday, February 27, 2012 and a return inspection was made by this office on Monday March 26, 2012. Said property was found to be in violation of multiple Massachusetts State Building Code requirements. Each City Department present at the meeting shall be submitting their own reports regarding violations cited, so let it be noted that violations stated in this correspondence are solely matters that are governed by this office and the Massachusetts State Building Code 780 CMR,but are not the only items of concern on the property. Violations regarding hallways and stairwell egress were corrected with-in twenty four hours of our February 27`h site walk,this department thanks you for your direct attention to that matter.The following items remain outstanding and/or were noted during our visit of March 26th. I- Basement— Un-permitted plumbing work. (Section 105.0 of 780 CMR, the State Building Code) Additionally permit fee, Debris Disposal Affidavit, Homeowners License Exemption form or Worker's Compensation Affidavit are required to be submitted during the filing. 2- Exterior Right Rear Stair Landing—Removal of metal awning over existing stair that is in inmiinent danger of collapse. 3- Exterior Rear Elevation—Dryer vent exhaust shall be replaced or removed as required. 4- Basement—Replace broken inside window sash. 5- Middle Stairway— Guard rail shall be installed to prohibit travel path to dead end stair. 6- Exterior Rear Elevation—Repair and weatherize rear bulkhead to basement. Thumb latch hardware may be installed as a replacement security. 10- General Note—No storage is permitted on exterior decks, including grilles or fire pits. 11- Middle Stairway—Smoke detector on basement side of basement access door is in operable and needs to be replaced immediately. 12- Front Exterior Egress Stair—New code compliant stair and stairway guard rail must be installed. Risers, treads, guard and handrails etc. 13- Unit 1 Front—Both bedroom handsets needs to be replaced with passage way (non- locking) hardware. This is a life safety egress issue and needs to be completed immediately. 19- General Note—All light fixtures that have exposed bulbs shall be replaced or have new globe covers You are hereby ordered to begin to rectify these conditions within 30 days of receipt of this notice. The most recent complaint was relative to furniture and other miscellaneous debris being thrown over the hill, which is really nothing new. Each time a complaint is investigated, the tenants of one property accuse the tenants of the other propertv of creating problems. Please be advised that any further complaints at these properties will result in, legal action being initiated in Salem District Court. As owners, it is vour responsibility to notify, and educate your tenants regarding the appropriate storage and disposal of rubbish and general maintenance of .the area. We are referring this matter to the Building and Licensing Inspectors for the City of Salem ' for investigation and determination whether or not their, codes are being violated if these two properties constitute illegal rooming houses (more than two unrelated persons occupying one apartment.)
