Dear Mr. Blenkhorn:
We have requested by letter and telephone a review of your decision
that the above referenced buildings of the Salem Point Coop are
required to be inspected by your agency for a "Certificate of
Fitness" .
These units are being completely rehabed with new walls, ceilings,
flooring, windows, doors, appliances, plumbing, wiring and in some
cases new roofs and heating systems.
The "Certificate of Fitness issued by your inspectors state the
units "meet the minimum standards of fitness for human habitation" .
All areas checked by your agents have already been inspected by
other City of Salem agencies and must meet the more stringent
requirements of the electrical, plumbing, gas, building and fire
and safety inspector before issuing a Certificate of Occupancy.
We are proud of the completed apartments and would welcome an
inspection by your agency but the $25. per unit inspection fee for
seventy seven units is a financial burden for this development
which will provide affordable housing for many low income Salem
families.
If "Certificates of Fitness" will not be required, please refund
fees paid for units at 20, 22, 38 and 46 Peabody Street. If your
decision is that the fees will be required, please consider this
letter an appeal of that decision and notify this office of the
appeal procedure.

In response to your letter dated August 28, 1992 regarding the above listed
properties and the Certificate of Fitness, the following applies:
Amendment to City of Salem Ordinance, Section I, Chapter II, Article XIII
of the Salem Code of Ordinances of 1973, paragraph (j) : Exemptions:
"Exemptions from this ordinance shall include property owned and
managed by the Salem Housing Authority and any new construction
completed less than five (5) years prior to date on which the
rented dwelling unit, apartment, or tenement become vacant."
The above information concludes that a Certificate of Fitness is necessary for the
properties listed, as the units are not exempt. The '$25.00 fee per unit is required.
The appeal procedure for the City of Salem falls under the same section,
paragraph (f) : Appeal Procedure:
"The-appeal procedure from any decision of the Board of Health shall
be same as that set forth in Chapter II of the State Sanitary Code.
The excerpt above refers us to Chapter II, of the State Sanitary Code. Enclosed
please find a copy of the Department of Public Health State Sanitary Code I:
General Administrative Procedures, 105 CMR 400:500 and 400:600,Chapter II.

The Department of Public Health has been asked for its opinion as to the
responsibilities.of. Local Boards:of Health-with`regard to the Massachusetts
;Recital Voucher, Program :(MKVP) : . Your .l
. etter :also states that, "The Health
Department has the understanding.that.this verification can only be
performed by Board of Health Personnel through the Department Certificate of
Fitness Program".
You have asked two questions. One, is a local board of health required
to conduct an inspection for the MRVP and two, may anyone other than the
board of health conducted these inspections in the City of Salem?
The Department's office of the General Counsel is researching the
responsibility of local boards of health in regard to whether a board of
health must conduct a "pre-rental" inspection for the purpose of
certification. While a board of health does have the statutory authority to
enforce the housing code theme should be no reason to exclude a properly
credentialed person from certifying compliance with 105 CMR 410.000.
The situation in Salem is somewhat different, however, because of its
Certificate of Fitness ordinance. If I am correct no housing can be rented
in Salem until such time as a Certificate of Fitness has been issued by the
board of health. This means that even if a third party certifies the
dwelling as being in compliance with 105 CMR :410.00 it can notbe occupied

without the Boards certification. The DepartmPxit congratulates the City of
Salem for having this program which goes a long way towards protecting its
citizens from housing related illness and injury.
