I called your office the day following the receipt of this letter, and left a message. I tried again to call last Friday, but it seems your office closes at noon on Fridays. The letter you sent pertains to a said violation of the certificate of occupancy. I wish to make it clear that at no time has anyone been living in Unit 2 since I purchased the property 4 years ago. The unit is still undergoing renovations, and at this time does not even have a gas connection to the gas range. There has been furniture moved into the unit for it's planned future use as a corporate rental, but this does not in any way mean that there are any person(s) living in or renting the space. I hope this clears up any misunderstanding that may have arisen as to the current state of affairs with Unit B at 2 Pleasant Street Ave. Should there be additional points of which I should be made aware, Please contact me at: 617.797.0703. Notice of the hearing was sent to abutters and others and notices of the hearing were published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner is requesting a Variance from the number of stories to construct a 3`d floor dormer for the property located at 34 Pleasant Street located in an R-2 district. The Variance which has been requested may be granted upon a finding of the Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures in the same district; b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; and c. On the basis of the above finding of fact, the evidence presented at the hearing, the Zoning Board of appeal concludes as follows: 1. Special conditions exist which especially affect the subject property but not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petition. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction and the building permit shall have a condition that requires the approval of the condominium association. 5. Exterior finishes of the new construction shall be in harmony with the existing structure. 6. There will be a third floor unit with deck allowed on the dormer. 7. A Certificate of Occupancy is to be obtained. 8. Petitioner shall obtain proper street numbering from the City of Salem Assessors office and shall display said number so as to be visible from the street. Tqe lot in question is behind a multi-family dwelling at 51-53 Washington Square North at the corner of Pleasant Street and Washington Square. My building also a multi-family is situated across Pleasant Street Avenue at 34 Pleasant Street. The new parking lot faces my yard. I bring it to your attention as it not only offends the view from my house and yard, but more importantly upsets the flow of traffic on the tiny side street. 51-53 is a multi-family dwelling. However, there are already six (6) parking spaces in existence and the new lot appears to add 4 more spaces. It is my under- standing that the owner, an abesentee landlord, intends to rent the spaces to tenants of another building on Washington Square East. This, I understand, is not in accordance with an R-2 xoning which does not permit land to be used for commercial purposes.
