Dear Mr. Barbeau,
This letter is in response to the violation notice sent to me dated February 26, 2007 (see
attached). I called your office the day following the receipt of this letter, and left a
message. I tried again to call last Friday, but it seems your office closes at noon on
Fridays.
The letter you sent pertains to a said violation of the certificate of occupancy. I wish to
make it clear that at no time has anyone been living in Unit 2 since I purchased the
property 4 years ago. The unit is still undergoing renovations, and at this time does not
even have a gas connection to the gas range. There has been furniture moved into the
unit for it's planned future use as a corporate rental, but this does not in any way mean
that there are any person(s) living in or renting the space.
I hope this clears up any misunderstanding that may have arisen as to the current state of
affairs with Unit B at 2 Pleasant Street Ave. Should there be additional points of which I

The above listed property has been found to be in violation of the following State
Codes and/or City Ordinances:
780 CMR, State Building Code, Section 118.1, states that `It shall be unlawful
for any person,firm or corporation to use, occupy or change the use or occupancy of
any building or structure or to erect, construct, alter, extend, repair, remove, or
demolish any building or structure or any equipment regulated by 780 CMR, or cause
same to be done, in conflict with any of the provisions of 780 CMR." It is our
understanding that this unit is being occupied without the benefit of a "Certificate of
Occupancy"which is a requirement of the above stated Code.
Said violations must begin to be corrected, repaired, and/or brought into
compliance within 2 days of your receipt of this notice. Failure to do so may result in
further actions being brought against you, up to and including the filing.of complaints at
District Court.

DECISION ON THE PETITION OF WILLAIM HARE REQUESTING A VARIANCE
FOR THE PROPERTY LOCATED AT 34 PLEASANT STREET R-2
A hearing on this petition was held on June 15, 2005 with the following Board Members
present: Nina Cohen, Chairman, Nicholas Helides, Edward Moriarty, Stephen Pinto and
Bonnie Belair. Notice of the hearing was sent to abutters and others and notices of the
hearing were published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioner is requesting a Variance from the number of stories to construct a 3`d floor
dormer for the property located at 34 Pleasant Street located in an R-2 district.
The Variance which has been requested may be granted upon a finding of the Board that:
a. Special conditions and circumstances exist which especially affect the land, building
or structure involved and which are not generally affecting other lands, buildings and
structures in the same district;
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district or the purpose
of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented and after
reviewing the plans at the hearing, makes the following findings of fact:
1. The house has been convened into three condominiums. The third unit is vacant and
the owner of the second unit was not present.
2. There was no opposition to the proposed variance.
On the basis of the above finding of fact, the evidence presented at the hearing, the
Zoning Board of appeal concludes as follows:
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petition.

3. Desirable relief can be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district or the purpose
of the Ordinance.
Therefore, the Zoning Board of Appeal voted 5-0, to grant the Variances requested,
subject to the following conditions:
1. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction and the
building permit shall have a condition that requires the approval of the condominium
association.
5. Exterior finishes of the new construction shall be in harmony with the existing
structure.
6. There will be a third floor unit with deck allowed on the dormer.
7. A Certificate of Occupancy is to be obtained.
8. Petitioner shall obtain proper street numbering from the City of Salem Assessors
office and shall display said number so as to be visible from the street.

A hearing on this petition was held December 1, 1993 and continued
until January 19, 1994 with the following Board Members present:
Francis Grealish Jr. , Chairman; George Ahmed, Stephen Touchette and
Stephen O'Grady. Notice of the hearing was sent to abutters and
others and notices of the hearing were properly published in the Salem
Evening News in accordance with Massachusetts General Laws Chapter
40A.
The Board of Appeal at the request of petitioners Attorney, George
Atkins voted unanimously 4-0 to grant petitioners leave to withdraw

Campbell B. Seamans and Dale H. Seamans have requested the Zoning
Board of Appeals allow them to withdraw their petition for Special
Permit and Variance without prejudice. In accordance with your
letter to Mr. and Mrs . Seamans dated September 23, 1993, Mr. Seamans
will immediately discontinue any use of the garage at 34 Pleasant
Street as a woodworking shop in connection with his self-employment.
Mr. Seamans has not yet located alternative space and, therefore,
tools, equipment and some materials will remain in the garage until
alternate space is located. However, no business activity will be
conducted in the structure.

Dear Mr. Munroe:
I am writing this letter as instructed by the good people� i.n,vour_ofr Qe to
complain about the construction of a new parking lot in my neighbor's yard. Tqe
lot in question is behind a multi-family dwelling at 51-53 Washington Square North
at the corner of Pleasant Street and Washington Square. My building also a
multi-family is situated across Pleasant Street Avenue at 34 Pleasant Street.
The new parking lot faces my yard. I bring it to your attention as it not only
offends the view from my house and yard, but more importantly upsets the flow of
traffic on the tiny side street.
51-53 is a multi-family dwelling. However, there are already six (6) parking
spaces in existence and the new lot appears to add 4 more spaces. It is my under-
standing that the owner, an abesentee landlord, intends to rent the spaces to tenants
of another building on Washington Square East. This, I understand, is not in
accordance with an R-2 xoning which does not permit land to be used for commercial
purposes.
Since the project is well under way, I would appreciate your prompt response
to this problem.
