Introduction:
BHCM Inc is filing the Chapter 91 application for the proposed construction of 7,500 s.f.
footprint water dependent Marina Boatyard Building in historically filled tidelands. An existing
municipal-private drainage pipe and outfall will be removed and replaced with a new outfall.
The installation of the new outfall will require work in the existing revetment in filled and flowed
tidelands. Infrastructure improvements are proposed as well. The purpose of the application is
to construct a New Boatyard building and provide stormwater quality with infrastructure
improvements. The New facility will allow BHCM to conduct Marina Operations storage and
maintenance inside the building.
Background:
In accordance with the Public Waterfront Act, 30 CMR 9.00 the Brewer Hawthorne Cove
Marina (BHCM Inc.) is applying for a Chapter 91 Waterways Application for the Water-
Dependent Use. The applicant is applying for a BRP WW01b Water-Dependent License with a
licensing period of 30 years. The project is adjacent to Salem Harbor and contains historically
filled tidelands and flowed tidelands below the mean high watermark. The area is in not
contained within an Area of Critical Environmental Concern (ACEC). The entire site is mapped
as a Zone AE, elevation 10 and a portion of the site is contained in a Velocity Zone, elevation
13, as shown on FIRM Map Number 25009C0419G, dated July 16, 2014. A portion of the site
is located in the Designated Port Area for Salem Harbor. No filling or work is proposed any
closer to Salem Harbor than the toe of the existing revetment.

Proposed Proiect Plans-Application, Permits and Certifications:
Proposed Project Plans:
The Chapter 91 Waterways Plans and application provided in this submittal are prepared in
accordance with the Chapter 91 Waterways License Application, Appendix A: License Plan
Checklist and Appendix C: Application Completeness Checklist. Appendix B: Dredging Permit
is not applicable, as no dredging is proposed. The proposed marina building is located in
historically filled tidelands and the Zone AE at elevation 10. A portion of the building is located
in the Zone VE, elevation 13. The entire structure is located above the mean annual high water
line. The proposed location of the new building requires the removal of the existing municipal-
private drainage system which discharges into Salem Harbor via an existing 24" RCP drain in
the revetment area. A new drainage system is proposed from the end of White Street thru the
site via a new 30" RCP outfall pipe in a similar location as the existing outfall. The existing,
revetment in the vicinity of the stormwater outfall area will be reconstructed as shown on the
attached plans. The reconstructed revetment will be no closer to the Harbor than the toe of
slope of the existing revetment. Stormwater Quality improvements are proposed such as: deep
sump catch basins with gas traps, rooftop recharge system, a First Defender treatment unit,
tidal gate and long term stormwater pollution prevention plan (SWPPP). The proposed project
complies with the DEP's Stormwater Management Regulations.
Public access and use areas are proposed for the site.
The proposed plan and application complies with 310 CMR 9.00 purpose as shown below:
• . The proposal protects and promotes the public interests in tidelands as codified in the
Colonial Ordinance of 1641-47.
• Preserves and protects the rights of tidelands of the inhabitants of Commonwealth are
utilized for water-dependent uses.
• Protects public health, safety and general welfare in the tidelands. The proposed
stormwater management system will improve the quality of stormwater discharging into
Salem Harbor. The new facility will provide a modern facility for completing marina
operations inside a new building. The public access area provides designated safe
areas for public use while protecting their welfare.
• Supports public and private efforts to revitalize an urban waterfront area. The new
facility, site and infrastructure improvements will provide a new, modern and clean
looking revitalized boatyard facility which promotes public accessibility.
• Fosters the rights of the people to clean air and water, freedom from excessive noise
and the natural scenic, historic and aesthetic qualities of their environment. The new
facility and stormwater improvements will result in improved indoor maintenance
operations inside of a new building designed in keeping with the area. The indoor
maintenance activities will result in a quieter environment. Stormwater quality will be
improved prior to discharging into Salem Harbor. The proposed building and site
improvements will enhance the historic and aesthetic qualities of the area.
In closing, we have attached a formal request for a MEPA Advisory opinion from the Executive
Office of Energy and Environmental Affairs (EOEEA). The project as proposed protects public
health, environment and safety. The improvements provides revitalization of the area in an
environmentally responsible manner while ensure public accessibility is provided. Enclosed

Appendix B: Dredging Permit Plan Checklist
For projects applying for dredging permits only, enclose drawings with the General Waterways
Application that include the following information:

illustrate the project on 8-1/2 inch X 11 inch paper.

provided on the form. Use black ink(blue ink or pencil are not easily reproducible, therefore,
neither will be accepted). If additional space is needed, attach extra 8-1/2"x 11"sheets of paper.
® Proper Public Purpose: For nonwater-dependent projects, a statement must be included that
explains how the project serves a proper public purpose that provides greater benefit than detriment
to public rights in tidelands or great ponds and the manner in which the project meets the applicable
standards. If the project is a nonwater-dependent project located in the coastal zone, the statement
should explain how the project complies with the standard governing consistency of the policies of
the Massachusetts Coastal Zone Management Program, according to 310 CMR 9.54. If the project

In lieu of the landowner's signature, the applicant may provide other evidence of legal authority to
submit an application for the project site." If the project is entirely on land owned by the
Commonwealth(e.g. most areas below the current low water mark in tidelands and below the historic
high water mark of Great Ponds), you may simply state this in lieu of the"landowner's signature".
® Municipal Zoning Certification: If required, applicants must submit a completed and signed
Section E of this application by the municipal clerk or appropriate municipal official or,for the
initial filing, an explanation of why the form is not included with the initial application. If the project
is a public service project subject to zoning but will not require any municipal approvals, submit a
certification to that effect pursuant to 310 CMR 9.34(1).
® Municipal Planning Board Notification: Applicants must submit a copy of this application to the
municipal planning board for the municipality where the project is located. Submittal of the
complete application to DEP must include Section H signed by the municipal clerk, or appropriate
municipal official for the town where the work is to be performed, except in the case of a
proposed bridge, dam, or similar structure across a river, cove, or inlet, in which case it must be
certified by every municipality into which the tidewater of said river, cove, or inlet extends.
® Final Order of Conditions: A copy of one of the following three documents is required with the
filing of a General Waterways Application: (1)the Final Order of Conditions (with accompanying
plan) under the Wetlands Protection Act; (2)a final Determination of Applicability under that Act
stating that an Order of Conditions is not required for the project, or (3)the Notice of Intent for the
initial filing(if the project does not trigger review under MEPA).
® Massachusetts Environmental Protection Act(MEPA): MGL 30, subsections 61-61A and 301
CMR 11.00, submit as appropriate: a copy of the Environmental Notification Form (ENF) and a
Certificate of the Secretary of Environmental Affairs thereon, or a copy of the final Environmental
Impact Report(EIR)and Certificate of the Secretary stating that it adequately and properly
complies with MEPA; and any subsequent Notice of Project change and any determination issued
thereon in accordance with MEPA. For the initial filing, only a copy of the ENF and the Certificate
of the Secretary thereon must be submitted.
Note: If the project is subject to MEPA,the Chapter 91 Public Notice must also be submitted to MEPA for
publication in the"Environmental Monitor". MEPA filing deadlines are the 15'h and 30"of each month.

Please accept this Request for an Advisory Opinion on the proposed Marina Building located
at BHCM Inc., 10 White Street, Salem, MA. The proposed project consists of demolishing the
existing office building, removal of some existing sheds and tent, removing an existing drain
line, constructing the new 7,500 s.f. footprint Marina Building, installing a new drain line with
stormwater quality improvements, a new drainage outfall in the same general vicinity of the
existing line to be replaced and infrastructure improvements. The work is proposed will take
place within existing developed area, i.e. the parking lot for the building and parking lot
drainage. The new drainage outfall is proposed in the existing revetment. The revetment will
be reconstructed in the area of the new drainage outfall area. The revetment reconstruction will
not be passed the toe of the existing revetment in the Harbor area.
We are now preparing and submitting applications to the DEP Waterways Division. We seek
your confirmation that the proposed project does not require the submittal of an Environmental
Notification Form. Feel free to contact the undersigned with any questions or comments.
