PLANNING BOARD
Will give a public hearing under Section 7-18 , Site Plan
Review Special Permit , of the Salem Zoning Ordinance, at the
request of the House of Seven Gables Settlement Association. The
purpose of this hearing is to discuss the applicant ' s proposal to
construct a 14, 000 square feet addition to part of the present
Visitor ' s Center located at 46-54 Turner Street . In addition, a

On Thursday, July 16 , 1992, the Planning Board of the City of
Salem held a public hearing regarding the application of House of
Seven Gables Settlement Association, for a Special Permit under
Section VII-18, Site Plan Review, of the City of Salem Zoning
Ordinance with respect to the construction of a 14,000 square feet
addition to part of the present Visitor ' s Center and a 160 square
feet kitchen addition to Retire Becket House located at 46-54
Turner Street .
At a regularly scheduled meeting of the Planning Board held on
Thursday, November 5, 1992, the Board voted, by a vote of eight in
favor , none opposed, to approve the application as complying with
the requirements of a Special Permit , subject to the following
conditions:
1 . Conformance with Plan
Work shall conform to plan entitled "Site Plan -
Education Center, The House of The Seven Gables" prepared
by Donham and Sweeney, Inc. , dated November 2, 1992.
2 . Construction Practices
All construction shall be conducted in accordance with
the following conditions:
a. No work shall commence before 8 : 00 a.m. on weekdays
and 8:00 a.m. on Saturdays. No work shall continue
beyond 5:00 p.m. There shall be no work conducted on
Sundays or holidays. Inside work of a quiet nature may
be permitted at other times .

C. All construction vehicles shall be cleaned prior to
leaving the site so that they do not leave dirt and/or
debris on roadways as they leave the site.
d. All construction shall be performed in accordance
with the Rules and Regulations of the Planning Board, and
in accordance with any and all rules, regulations and
ordinances of the City of Salem.
3 . Landscaping
Landscaping of the site shall conform to plan entitled,
"House of the Seven Gables Parking Lot - Planting Plan" ,
dated November 2, 1992 and "Planting Plan - Ed Center"
House of the Seven Gables dated November 2 , 1992 .
a. Trees shall be a minimum of 4 1/2" caliper deciduous tree
at the north-east area where junipers are to be removed.
b. Vegetation surrounding Grand Turk parking lot shall be
maintained in a healthy and thriving condition.
C. Large Norway Maple multistem tree behind the Retire
Becket House shall be maintained.
d. Large tree on Derby Street across from Settlement House
should be cut back .
e . Maintenance of landscape vegetation shall be the
responsibility of the developer , his successors or
assigns.
f . After all project landscaping is completed, and prior
to the issuance of a Certificate of Occupancy, the
developer will be required to add further landscaping
if it is requested by the Planning Board or City
Planner .
4 . Utilities
a. Memorandum #93-12 from City Engineer , Stanton Bigelow
dated October 15, 1992 shall be adhered to unless further
review by City Engineer deems additional alterations may
be necessary.
b. Additional utility installation, if any, shall be
reviewed and approved by the City Engineer or other
appropriate department head prior to the issuance of a
building permit. .

10 . Crosswalk
A new crosswalk will be installed in the vicinity between

11 . Amendments
Any amendments to site plan shall require the approval of
the Planning Board.
12 . Violations
Violations of any condition shall result in the
revocation of this approval by the Planning Board.
I hereby certify that a copy of this decision and plans have
been filed with the City Clerk and copies are on file with the
Planning Board. This Special Permit shall not take effect until a
copy of this decision bearing the certification of the City Clerk
that twenty ( 20) days have elapsed and no appeal has been filed or
denied, is recorded in the Essex County Registry of Deeds and is
indexed under the name of the owner of record or is recorded on the
owner ' s certificate of title. The fee for recording or registering
shall be paid by the owner of applicant .

Plan Engineering Review Meeting
Ref: Brett Donham's Meeting Minutes Memo of October 8, 1992
The enclosed meeting minutes are an accurate statement of the
points made at the above-referenced engineering review meeting.
The meeting was held at the Salem City Engineer' s Office in
response to a request by Attorney John Serafini, Sr. , acting on
behalf of the House of Seven Gables Settlement Association, that
several requests for information in our letter to your office of
July 29 , 1992 be clarified.
The recent meeting with Attorney Serafini and Brett Donham, AIA,
was an update of the status of the project proponents ' engineering
and architectural studies, and information was recieved and filed
with respect to preliminary storm drainage design alternatives.
It would appear from the report prepared by Judith Nitsch Engin-
eering that a system of leaching pit-type catch basins, which
recharge runoff to the underlying sandy soils, would be preferable
to an optional system that would involve piping of runoff to a
Salem Harbor discharge at the lower end of Turner Street.
Information contained in soil borings, received by this office on
this date, indicate a typical "compact fine brown sand." in the
area, which would, with proper design, lend itself well to an
infiltration system. As noted in Donham's memo, runoff and capa-
city calculations will have to be submitted to this office with
final submittals .

Of particular note is the fact that there appears to be an exist-
ing storm drainage system, of sorts, that discharges to the sewer
in Turner Street through an old building sewer. It should be in-
cumbent upon the project proponents to have this existing pipe
investigated and, if it is indeed a building sewer, include a
replacement or abandonment proposal in the final submittals .
Hydrant test submittals, along with the certification of the fire
protection engineer with respect to the adequacy of the service
for support of a sprinkler system, were received and filed. It
appears that the existing water system will be adequate for the
intended fire demands in the proposed project.

The storm water disposal study prepared by Judith Nitsch Engineers
was accepted. It recommends the use of 5 leaching pits for
disposal of surface water and roof run-off. Bigelow requested that
Donham & Sweeney send him a copy of the test boring logs. The
final construction documents must include run-off and capacity
calculations to be submitted to Bigelow.
Copies of the water pressure and flow tests as well as the fire
protection engineer's statement regarding design of the sprinkler
system were accepted. The final construction documents must
include a back flow device, and must be submitted to and approved
by:

The Board of Health concurred with the proposal subject to the following
conditions:
1) The design proposal concur with the City Engineering Department
and City Plumbing Inspector for utility tie-ins for drinking
water, sanitary waste and toilet facilities, gas lines and/or
any other utility service.
2) Employ an acceptalbe method for dust and street cleaning control
during site construction and submit a copy of the method utilized
to the Health and Planning Departments in writing.
3) Prior to site start-up, demolition and also during site construction,
employ a licensed pest control firm for site evaluation and service
with a copy of the service program sent to the Health and Planning
Departments.
4) Measures be taken to assure that air pollution due to odors and
noise does not occur during and after site construction. Hours
of work per City of Salem Ordinance, between the hours of 7:00 a.m.
and 5:00 p.m. Monday thru Saturday.
5) All backfilling be done in accordance with good engineering practices
to prevent future damage to all underground utilities.
6) All kitchen provisions and facilities installed in accordance with
105 CMR 590.000 State Sanitary Code Article X.

DECISION ON THE PETITION HOUSE OF SEVEN GABLES SETTLEMENT ASSOCIATION
FOR VARIANCES AT 46-54 TURNER STREET (R-2/B-1 )
A hearing on this petition was held May 20, 1992 with the following
Board Members present: Richard A. Bencal, Chairman; Messrs. , Febonio,
Greaiish, Touchette and Associate Member Plante. Notice of the hearing
was sent to abutters and others and notices of the hearing were properly
published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
?etitioners, owners of the property, are requesting Variances from front
vard setbacks and minimum distance between buildings to allow
construction of a new building and an addition to an existing building
in this R-2/B-1 district.
The variances which have been. requested may be granted upon a finding by
the Board that:
1 . Special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures involved.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence
presented at the hearing, and after viewing the plans, makes the
following findings of fact:
1. The petitioner, through Counsel and expert witnessess, introduced
evidence as the topography of the property, the proposed building
locations and the extent of the rehabilitation and renovation.
2. The lot is located in two different zones, one portion is located in
the B-1 zone and the other portion is R-2. The proposed buildings
comply with the R-2 except for the requested variances.
3. Several neighbors spoke in favor of the petitioners request and a
petition with signatures of fifty (50) Salem residents supporting the
request was also submitted.

4 . That the particular size and shape of the petitioners' lot
especially affects the land and structures involved and are conditions
not generally affecting other land, buildings or structures in the
district.
5. That the uniqueness of the Historical Site and the buildings located
thereon especiallyl affect the petitioners property and do not generally
affect other land, building or structures in the district.
6. That due to the existing Historical buildings located on the
property, as well as the unique size and shape of the land, the proposed
construction could not be reasonably located on any other spot withing
the property.
7. :hat adequate on-site parking will be available per the petitioner's
plans (67 spaces ) and that the proposed off-site parking of buses will
be less detrimental to the district than the existing situation with
buses parking on site.
3 . That the petitioner sought and received neighborhood input and that
three neighborhood meetings were held.
9 . That the petitioner derives its existence from the money generated
by tourists visiting the property, and currently the petitioner is
unable to adequately serve the needs of the visiting tourists with the
configuration of the existing facilities .
10. That the funds generated by visiting tourists to the property allow
the petitioner to establish and maintain the Historical buildings and
grounds as well as several social service programs available to the
entire community, which have been historically funded by the petitioner.
11. That the new facilities would permit handicapped access, and would
enable the petitioner to conduct its educational and orientation
services for visitors in an adequate manner and in an environment that
is not exposed to the elements.
12. That the petitioner would suffer substantial hardship in lost
revenues and services if the variances requested are not granted and the
Zoning Ordinance provisions are literally enforced.
13. That the variances requested are in harmony with other properties
within the district and can be granted without substantial detriment to
the public good and without nullifying or substantially derogating from
the intent of the district or purpose of the Ordinance.
On the basis of the above findings of fact, and on the evidence
presented at the hearing, the Board of Appeal concludes as follows:

intent of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 4-1 (Mr. Bencal voted in
opposition) to grant the variances requested, subject to the following
conditions:
1 . Petitioner shall comply with all city and state statutes,
ordinances , codes and regulations.
2 . All construction shall be done as per the plans and dimensions
submitted and by legal building permit.
3 . All requirements of the City of Salem Fire Prevention Bureau
relative to smoke and fire safety shall be strictly adhered to.
4 . Proper numbering shall be obtained from the City of Salem Assessor.
5 . Appropriate approval from all other City Boards, Commissions or
Authorities having jurisdiction over this property shall be obtained.
6. A preconstruction survey is to be obtained.
7. A neighborhood :impact study is to be conducted.
8. Parking plans for workers and construction vehicles for off site
parking to be approved by the Planning Department.
9. A Plan for bus parking, drop-off, pick-up of visitors is to be
approved by the Planning department before construction begins.

Introduction
The proposed project, The House of the Seven Gable Education Center, is
a 14 , 000 sq. ft. addition to part of the present Visitor's Center. A
Portion of the present Visitor's Center will come down to accommodate
the expanded Education Center. The proposed Education Center is a one
story building with a full basement. It will contain an
exhibition/ticketing/reception area, two classrooms for 45 persons each,
a museum shop, a 100 person lecture hall, curatorial space, toilets, and
other support spaces. A 160 sq. ft. kitchen addition is proposed for the
Retire Becket House. Parking for 67 cars will be provided on site.
Regulatory Status
The project has received zoning variances from the Board of Appeal for
a front yard setback and the separation between buildings. The Board of
Appeal also approved the number of parking spaces.
The Salem Historic District Commission has approved in concept the
building "footprint" and its massing. Further review and 'approval of
exterior colors, windows, and architectural details will take place
before a Certificate of Appropriateness can be issued. The
Massachusetts Historical Commission is undertaking similar reviews.
Three informational meetings have been held with the neighbors in which
they were mailed invitations or personally invited to review the model
and the drawings. A question and answer period followed each of the
presentations. About 15 to 25 people attended each time.

Description of Site
The site is most of the entire block bordered by Hardy Street, Derby
Street, Turner Street and Salem Harbor. The full block contains two
small parcels not owned by the Gables Settlement Association. The
Gables' portion of the block contains 1.768 acres and falls in both an
R-2 zone and a B-1 zone. Grades in the site are generally flat, from
Derby Street to the middle of the site and then slope very gently from
a grade of 18 feet to a grade of 13 feet near the harbor. In the
vicinity of the proposed building, the grade slopes from 17.5 feet to
14.5 feet.

Buildings
The proposed buildings, at one story, will be compatible in scale,
materials, and details with the existing structures on site and in the
neighborhood. Extensive review by the Salem Historic District
Commission and the Massachusetts Historical Commission will ensure that
the building is appropriate in its surroundings. The building will
utilize pitched roofs and painted clapboards. Colors will be those
presently used for buildings on the site.
Parking and Loading
As proposed and approved by the Board of Appeal, the site will have
parking for 67 cars, 3 of which are handicapped accessible. Buses will
drop off those visitors who are in tour groups. The buses will then
leave the site for a remote parking area and be recalled when needed.
Designation of the remote bus parking site and its use by several
cultural attractions in Salem is being coordinated by the Planning
Department. A through drive loop is planned with buses entering at the
northwest corner of the site as they presently do, and leaving at the
northeast corner of the site. This will eliminate the present problem
created by buses needing to back up onto Derby Street as they leave the
site.
No loading bay or dock is provided since the amount of deliveries is not
expected to increase over the present volume and is of a very low level.
Deliveries will be via the front entrance in the parking lot or via the
parking lot off Hardy Street. Trash pick up will also be as at present
and is not expected to increase. It consists of a maximum of 10 bags
each picked up on Monday by the city, and picked up Wednesday and Friday
by a private carter.
Traffic Flow and Circulation
Traffic flow for buses will be a one-way loop through the site as
described above. The majority of the cars will utilize the same one-way
loop. To reduce traffic on Turner Street, two of the present three
exits onto Turner Street will be closed.
External. Lighting
Four pole lights will be added down the middle of the parking lot.
These will be the type that cast their light downward rather than out,
and will be reviewed by the Historic District Commission. Next to the
entrance are two flag poles with lights directed straight down. In
front of the building, in the ground, are four light fixtures
illuminating the front of the building near the entrance. The Historic
District Commission would not permit any light fixtures attached to the
building itself.

Landscaping and Screening
Kanter Landscape Design, the firm that has maintained the widely known
and admired Gables Gardens for years, has prepared a landscape and
planting plan that extends the present design themes of the site. Many
of the plants shown in the new plan will be mature plants presently on
the site but relocated for the new plan. Consultation with the
neighbors, particularly the family whose house is in the middle of the
site, has taken place. Plant species and sizes are indicated on the
attached Landscape Plan.
utilities
Utilities will be brought from Hardy Street and Turner Street.
Electric Service will be underground from a pole on Hardy Street to a
pad mounted transformer and then underground to the building.
Massachusetts Electric Company will provide the power and has approved
the service arrangement.
Gas, for heat, will be provided underground by Boston Gas Company.
Water supply for a full sprinkler system and domestic water uses will be
via a six inch line in Hardy Street.
Sanitary sewage will be removed via an eight inch line in Turner Street.
There is not expected to be a significant increase in loading during the
peak periods of use.
Storm drainage will be to storm drain lines in Turner Street. There is
no proposed increase in hard surfaces, so there will be no increase in
storm water runoff.
Snow Removal
Snow removal will continue to take place as it has been for years. In
the winter, several unused parking spaces will be designated as
temporary depositories for the snow while it melts.
Natural Area Protection and Enhancement
The site where the building will take place is an urbanized built-up
area. An extensive landscaping and planting program will be part of the
building project. The site plan was reviewed in 1991 with staff of the
Conservation Commission, and the building site was determined to be too
far from Salem Harbor to require their review.

Noise
With the exception of the construction period, the project will not
increase noise levels. Tour buses which are presently parked on-site
with the engines running will, as part of this proposal, be parked off-
site, thereby reducing noise. Construction activity will take place
during winter months when neighbors' windows are closed. The building's
structure will be steel framed, reducing carpentry noises.
Air
There will be no odors emanating from the site during construction or
anticipated after completion of the development.
Dust generation during construction will be avoided by instituting a
regular and closely supervised water spray application.
No burning will take place during construction, therefore, no smoke will
be present during or after construction. All excess burnable
construction waste will be hauled from the site by a private collection
contractor to approved waste disposal facilities. All other detritus,
such as vegetation, will be chipped or mulched into usable landscaping
materials.
No incineration of refuse or other activity which could adversely affect
air quality is proposed for this project. All refuse will be handled
within enclosed areas until removed by land carriers to approved waste
disposal facilities.
Schools
No impact on the school population is expected as a result of the
project.
Police
The facility proposed is an educational center. Police protection for
the abutting neighborhood is satisfactory and the development of this
site with its private security should supplement and enhance the general
security of the neighborhood. The building will have a private alarm
system.
Fire
The building will be a steel frame and protected wood construction
completely protected by an automatic fire alarm and sprinkler fire
protection. A 6" and an 8" water main exist on the abutting streets.
The Salem Fire Department is satisfied as to the adequacy of the fire
protection system.

The Gables was granted 2 variances; one for the front yard
setback and the other for the separation between buildings.
Both of these variances allowed the Gables to conform to
existing conditions.

The Board of Health concurred with the proposal subject to the following
conditions.:
1) The design proposal concur with the City Engineering Department
and City Plumbing Inspector for utility tie-ins for drinking
water, sanitary waste and toilet facilities, gas lines and/or
any other utility service.
2) Employ an acceptalbe method for dust and street cleaning control
during site construction and submit a copy of the method utilized
to the Health and Planning Departments in writing.
3) Prior to site start-up, demolition and also during site construction,
employ a licensed pest control firm for site evaluation and service
with a copy of the service program sent to the Health and Planning
Departments.
4) Measures be taken to assure that air pollution due to odors and
noise does not occur during and after site construction. Hours
of work per City of Salem Ordinance, between the hours of 7:00 a.m.
and 5:00 p.m. Monday thru Saturday.
5) All backfilling be done in accordance with good engineering practices
to prevent future damage to all underground utilities.

Dear Annie:
My understanding of decisions reached last night at the
Commission meeting is:
* The large glazed areas at the front (entrance) and rear of
the building shown on the sketches dated 10/20/92 were
approved.
* The location and placement of the windows shown on the
sketches dated 10/20/92 was approved. The Gables has a
choice of whether one or two windows will go in the storage
shed north elevation.
* The red color, matching the Hawthorne birthplace, was
approved. The entrance glazed area will be grayish/tan
stain, lighter than the stain used at the Gables site
presently.
* Horizontal clapboards, spread 3 to 4 inches apart, are to
be used on all new surfaces.
* Six over six double hung windows as shown on Scheme C,
dated 10/20/92 , were approved with the understanding that
if the Gables feels strongly, an alternative muntin pattern
could be submitted at a later date.
* Columns supporting the trellis, both scheme A & B were
approved but with an expressed preference for B.
* The lighting consisting of the Salem Derby Street fixture
was approved but the Commission wants to see a fixture cut
and a proposed height.

As you know, Gail and James Sagris were present at the Planning
Board ' s September 17, 1992 meeting seeking a Determination of
Specific and Material Change regarding the construction of a deck
at 10 Dearborn Street due to a denial for a Special Permit from the
Board of Appeal.
The Planning Board approved the Change with a vote of six ( 6 ) in
favor none opposed, a 2/3 Board approval. (The Board has in the
past generally voted on the basis on a 2/3 vote; in some instances
even less than 2/3 vote has been obtained) .
A letter was then submitted to the ZBA stating this approval.
At the Board of Appeals September 30, 1992 meeting a question was
raised regarding whether the 2/3 votes, which the Planning Board
obtained, was sufficient. The ZBA was of the belief that more than
a "2/3 member present" approval was necessary.
In reviewing the past files, Twelve ( 12) of the nineteen ( 19)
Determinations of Specific and Material Change which were presented
to the Planning Board, were approved with either 4, 5 or 6 members.
The dates ranged from February 19, 1987 to May 16, 1991 .
The Planning Department sought an opinion from Assistant City
Solicitor , Len Femino. Mr . Femino reviewed Chapter 40A Section 16
more closely and has summarized that the petitioner needs the
approval of all but one Planning Board Members; Eight ( 8) of the
Nine ( 9) members. Len Femino has advised the Planning Board that
the easiest way to address this issue is to hear the petition
again.
Unfortunately, this means that the Sagris ' must reappear before the
Board to submit their project plans and changes for a Determination
of Substantial Change.
As you know, it is rare that we have an eight member attendance so
it is imperative that all the Planning Board members attend this
meeting so we may finalize the Board's responsibility to hear the
Sagris ' petition.

Unfortunately, the Architect was unable to attend the October 1
meeting so we had to postpone discussion until the October 15
meeting.
Attorney Serafini and Brett Donham will be present at our meeting
to discuss the concerns which were raised at the July 16 , 1992
meeting and to discussed proposal solutions. ( In last week ' s
packet you will find the list of concerns which were sent in
memorandum form to Attorney Serafini ) .
I will present a draft decision to the Board at our meeting for
review purposes, not for approval at this time.

Dear Sir: .
On behalf of House of Seven Gables Settlement
Association, owners of a parcel of property situated in Salem
described on plans submitted herewith, I hereby make application
for a Special Permit under the Site Plan Review Section 7-18 of
the City of Salem Zoning Ordinance.
The Site Plan Review requested is for a project
consisting of a 14, 000 square foot addition to part of the present
Visitor' s Center. A portion of the present Visitor' s Center will
come down to accommodate the expanded Education Center. The
proposed Education Center is a one story building with a full
basement. It will contain an exhibition/ticketing/reception area,
two classrooms for forty-five (45) persons each, a museum shop, a
one hundred (100) person lecture hall, curatorial space, toilets,
and other support spaces. A 160 square foot kitchen addition is
proposed for the Retire Becket House. Parking for sixty-seven (67)
cars will be provided on site. The project is to be constructed.
on property of the applicant as shown on the plans submitted
herewith.
The property in question consists of .a parcel of land of
approximately 1. 768 acres situated on Derby, Hardy and Turner
Streets in said Salem. The applicant has complied with the
requirements of the Site Plan Review regulations and has filed its
informational Environmental Impact Statement as required by the
City of Salem Zoning Ordinance.

The project in question complements the general
development known as the House of Seven Gables site, is located in
an R-2 and B-1 Zone, and is a permitted use. The building known
as the House of Seven Gables site is on . the National Historic
Register, and has been in existence on that part of the site for
many, many years. The site, because of its national and
international reputation, accommodates many visitors throughout the
years. Historically and culturally the site fills the public need
and conforms to the public good by enhancing public awareness to
present and future generations of the historical treasures that
comprise the House of Seven Gables site.
The plans as filed indicate the fact that the new
building will be in keeping with the general architectural
perameter of other buildings on the site and, also, in general,
will be in conformity with that area of the City of Salem.
The architecture is in keeping with the period. The
Historical Commission has approved the plan in concept, and we are
having continued discussions as to the details.
The plans as filed, together with the Environmental
Impact Statement which serves as the narrative under the list of
requests contained in your Site Plan Review requirements, give a
pretty comprehensive and complete view of the project.
We feel the project is a worthwhile addition to the City
of Salem and will provide long term benefits. The architects have
taken special pains to accommodate areas of concern.
We trust the Site Plan Review process will proceed
favorably, and that a Special Permit as requested will be granted.

p� 777} The proposed plan shows a nine car dead end parking aisle in
1i this area. The lot ends two feet from the property line, as
; I a result the large existing vegetation in this area would have
u to be removed. There is also no path from the bus drop off to
9 the building entrance. The most direct route would cross two

parking aisles and three rows of spaces.
A possible solution to these concerns would be to orient the
spaces perpendicular to the existing aisle. This would leave
room for an eight foot walk and would allow ample room for
protection of the existing vegetation.
2 . The proposed plan shows angled parking oriented so that it
could only be accessed from the Turner Street side. Orienting
these spaces perpendicular to the aisle would allow parking
from either direction.
3 . Concerns expressed by the neighbors may lead to closing the
Turner Street entrance. A better solution would be to make
this an exit only . This would allow a car to drop people off
at the building entrance and continue out to Derby Street.
4 . Cars can not back straight out of the corner space nere the
bus drop off . Orienting these spaces perpendicular to the
aisle would correct this problem. Since this aisle is already
one way angled parking in itself is not a problem in this
area.
5 . The proposed addition on the Retire Becket House, as it is
currently shown will necessitate the removal of the large
Norway Maples. Reorienting the addition so that it is a
minimum of five feet from all parts of the trees would help
save them.

1. Conformance with Plan
Work shall conform to plan entitled "Site Plan - Proposed
Education Center" prepared by Donham and Sweeney, Inc. ,
dated 6/19/92 revised 6/29/92, 7/8/92 and
2. Construction Practices
All construction shall be conducted in accordance with
the following conditions:
a. No work shall commence before 8 : 00 a.m. on weekdays
and 8 :00 a.m. on Saturdays. No work shall continue
beyond 5:00 p.m. There shall be no work conducted on
Sundays or holidays. Inside work of a quiet nature may
be permitted at other times.
b. All reasonable action shall be taken to minimize the
negative effects of construction on abutters. Advance
notice shall be provided to all abutters in writing at
least 72 hours prior to commencement of construction.
c. All construction vehicles shall be cleaned prior to
leaving the site so that they do not leave dirt and/or
debris on roadways as they leave the site.
d. All construction shall be performed in accordance
with the Rules and Regulations of the Planning Board, and
in accordance with any and all rules, regulations and
ordinances of the City of Salem.
3 . Landscaping
Landscaping of the site shall conform to plan entitled,
"House of the Seven Gables Parking Lot - Planting Plan" ,
dated 6/30/92, revised and "House of Seven
Gables Planting Plan - Education Center" dated 6/30/92,
revised
a. Trees shall be a minimum of 3 1/2" caliper deciduous tree
at the north-east area where junipers are to be removed.
b. Vegetation surrounding Grand Turk parking lot shall be
maintained in a healthy and thriving condition.
c. Large Norway Maple multistem tree behind the Retire
Becket House shall be maintained.
d. Large tree on Derby Street across from Settlement House
should be cut back.
e . Maintenance of landscape vegetation shall be the
responsibility of the developer, his successors or
assigns .
f . After all project landscaping is completed, and prior
to the issuance of a Certificate of Occupancy, the
developer will be required to add further landscaping is
requested by the Planning Board or City Planner.
4 . Utilities
Uti—` lity installation shall be reviewed and approved by
the City Engineer or other appropriate head prior to the
issuance of a building permit.
5 . Board of Health
Board of Health conditions stated in a letter dated July
14, 1992 (attached) shall be strictly adhered to.
6 . Board of Appeal Decision
Board of Appeal Decision requirements as set forth in
decision time stamped by the City Clerk on June 3, 1992,
shall be adhered to.
7 . Lighting
a. Exterior lighting shall be installed and maintained
in such a manner so as not to reflect or cause glare on
abutting properties or which adversely effects safe
vision of operators of vehicles moving on nearby streets.
b. Lighting for the project shall be reviewed and
approved by the City Planner prior to the issuance of a
Certificate of Occupancy.
8. Signage
Signage for the building shall be reviewed and approved
by the City Planner prior to issuance of Certificate of
Occupancy.
a. Install signs at Derby Street and Turner Street
indicating buses entering.
9 . Rooftop Equipment
Rooftop equipment shall be screened or otherwise
mitigated from abutting neighbors. Such screening shall
be approved by the City Planner , prior to issuance of a
Certificate of Occupancy.
10 . Walkway
A walkway shall be installed to direct walking traffic in
an orderly fashion. The walkway shall be defined with
granite curbing.
11 . Amendments
Any amendments to site plan shall require the approval of
the Planning Board.
12. Violations
Violations of any condition shall result in the
revocation of this approval by the Planning Board.

The storm water disposal study prepared by Judith Nitsch Engineers
was accepted. It recommends the use of 5 leaching pits for
disposal of surface water and roof run-off. Bigelow requested that
Donham & Sweeney send him a copy of the test boring logs. The
final construction documents must include run-off and capacity
calculations to be submitted to Bigelow.
Copies of the water pressure and flow tests as well as the fire
protection engineer's statement regarding design of the sprinkler
system were accepted. The final construction documents must
include a back flow device, and must be submitted to and approved
by:

Enclosed is the result of a parking survey covering April
through October, 1991. Edith Harman says there are fewer cars this
year. This gives you some guidance of the number of buses per day.
Also enclosed is a parking lot survey for June 1992,
indicating the number of empty bus parking spaces and the number
of empty car parking spaces during the day. It would appear that
there is plenty of room on the lot, even during peak hours of
operation.
I will have a letter from Edith to you indicating that
after discharging passengers the buses will be parked off the site
in a spot designated by the City.
Please call me if you have any questions and I will
amplify.

On Thursday, July 16 , 1992 a public hearing was held under
Section 7-18 - Site Plan Review provision of the City of Salem' s
Zoning Ordinance for a proposal by the House of Seven Gables .
As you will recall , the Site Plan Review Special Permit
requested is for a project consisting of a 14 ,000 square foot
addition to part of the present Visitor ' s Center . A portion of the
present Visit_or ' s Center will come down to accommodate the expanded
Education Center is a one story building with a full basement . It
will contain an exhibition/ticketing/reception area, two classrooms
for forty-five ( 45 ) persons each, a museum shop, a one hundred
( 100 ) person lecture hall , curatorial space, toilets and other
support spaces . A 160 square foot kitchen addition is proposed for
the Retire Becket House.
A number of concerns were raised by the Planning Board at this
meeting . They are as follows : O#L��CONCERN:

passengers at the site.

and water questions have been addressed by Stanton Bigelow,
Department of Public Services Director , (see attached letter ) and
are being worked out with the engineers of the project. These
concerns may also be included in the decision as being subject to
the Director of Public Services approval .

An owner of land along a way mistakenly believed to be a public way may not
require the planning board to reendorse a plan relating to the same way,as any
rights acquired adhere in the plan endorsed and not in the way itself.Goldman v.
Planning Board of Burlington, 347 Mass. 320, 324-25, 197 N.E.2d 789, 792
(1964).
Frontage on a Way Maintained and Used by the
Public
In Casagrande, 377 Mass. at 708(1979),the Supreme Judicial Court ruled that
a town's maintenance of a statutory public way for over fifty years by removing
snow, graveling, grading, removing brush, widening to permit snow plowing,
naming(officially)the way and including in it a list of public roads did not require
the town clerk to certify that the way was used and maintained as a public way.
The court emphasized the lack of evidence as to use as a public way./d.
rFrontage on an Approved and Endorsed Way
There is also no "subdivision" where every lot within the tract so divided has
frontage on "a way shown on a plan theretofore approved and endorsed in 5,.
accordance with the subdivision control law."G.L.c.41,§81L.Away isapproved

Dear Debbie:
I have completed my review of the above-referenced Application for
Special Permit under Site Plan Review and its accompanying Envir-
onmental Impact Statement and Narrative and Site Plans including
an Existing Conditions Plan prepared by Andover Consultants Inc.
and dated December 14 , 1990 . My comments are as follows :
1 ) In the Environmental Impact Statement and Narrative, p. 4 , un-
der the heading "Utilities , " the project proponents state that
"Storm drainage will be to storm drain lines in Turner Street. "
To our knowledge, there is presently no storm drain line in Turner
Street, but only a single catch basin at the Harbor end of the
street with a direct discharge to Salem Harbor at that point. In
addition, I note that in the general Site Plan submitted, Donham &
Sweeney Inc . , Architects for the project, show proposed "CB/MH"
structures on the site of the proposed education center being con-
nected by pipes to a pipe/manhole system shown. as "ST S, " or storm
sewer (by the Key) , in Turner Street, with a direction of flow
away from the Harbor. Further, in the Existing Condition Plan, no
indication of a storm drain in Turner Street is made, which is in
keeping with our plans of record for area utilities .
2 ) In the Environmental Impact Statement and Narrative, p. 4 , also
under the heading "Utilities , " the project proponents state that
"Water supply for a full sprinkler system and domestic water uses
will be via a six-inch line in Hardy Street. " We note that there

are six-inch diameter water mains in both Hardy and Turner
Streets, and that a fire service for sprinkler protection for the
proposed building use will require at least a six-inch diameter
service. Flow tests should be conducted for City hydrants on both
streets to determine adequacy of pressures and fire flows for the
installation of such a system off the Hardy Street main as pro-
posed, and plans should be made for upgrading the Hardy Street
main to 8-inch diameter if existing conditions are found to be in-
sufficient to support such a sprinkler system.
In light of the comments provided above, I would recommend the
following conditions be made a part of any permit approval by the
Planning Board:
1 ) That prior to proceeding further with the proposed project, the
project proponents retain a Registered Professional Civil Engineer
to prepare design plans and details for storm drainage facilities
for the entire parcel of land owned by them, to and including a
proper point of disposal into facilities of the City or an appro-
priate receiving water, and that such design plans be as approved
by the City Engineer.
2 ) That prior to proceeding further with the proposed project, the
project proponents retain a firm licensed to conduct such tests to
conduct hydrant flow tests on hydrants in the vicinity of the pro-
posed project, in consultation with the City Engineer, to deter-
mine adequacy of pressures and fire flows, as well as "C" factors
for existing water mains in the area .
3) That prior to proceeding further with the proposed project, the
project proponents retain a Registered Professional Fire
Prevention Engineer to prepare design plans and details for
building sprinkler systems including fire service with backflow
prevention equipment. Such plans for backflow prevention
equipment, to include lineflow detection meter loop, to be
submitted to Massachusetts Department of Environmental Protection,
Division of Water Supply, Northeast Regional Office and the City
Engineer for concurrent review and approval (by DEP) . Fire
service piping requirements and sprinkler system specifications to
be in accordance with the requirements of the NFPA Code,
Massachusetts General Laws Chapter 148 (Fire Prevention) and the
Massachusetts Fire Prevention Regulations (527 CMR) , as admin-
istered by the Salem Fire Prevention Office, Capt. Norman
LaPointe, Chief Fire Prevention Officer.

attempt to settle the legal issues surrounding the bankruptcy
proceedings for the commercial portion of the Fafard development .

legal issues and the Bank of Boston has taken control of the
commercial portion of the development .
On Thursday, a representative of the Bank of Boston will be
present at Thursday ' s meeting to introduce themselves to the Board
and to discuss their plans for completion of the commercial portion
of the development .

of empty car parking spaces during the day. It would appear that
there is plenty of room on the lot, even during peak hours of
operation.
I will have a letter from Edith to you indicating that
after discharging passengers the buses will be parked off the site
in a spot designated by the City.

rooftop HVAC unit to be installed on the proposed Education Center and the ambient
noise measurements made on site. We carried out the noise measurements on Tuesday, 15
September 1992 between 12:30 p.m. and 1:00 p.m. on the property of the House of the
Seven Gables at locations adjacent to the neighbors at #42 and #47 on Turner Street. We
did not make ambient noise measurements during nighttime hours, because we understand
that the unit will not operate at night. This letter presents our evaluation of the expected
noise impact of the proposed rooftop HVAC unit on these neighbors, and briefly discusses
schematic noise control options.
MEASUREMENTS AND OBSERVATIONS
We measured overall A-weighted ambient noise levels in the range of 47 to 52 dBA during
our site visit. Contributions to the ambient noise on site included a light sea breeze,
visitor activity at the museum, local traffic noise, birds, and a low level of A/C equipment
noise that seemed to come from many directions,in that neighborhood. Visitor activity at
the museum appeared to be fairly light (the parking lot was about 1/3 to 1/2 full with
cars).
ANALYSIS AND RECOMMENDATIONS
On the basis of the plans we have received for the Education Center and the information
regarding the proposed rooftop HVAC unit, we estimate that the proposed rooftop HVAC
unit will generate noise at the property line of 1142 Turner Street that approaches 40 dBA
at ear level and noise at the second floor windows that approaches 53 dBA. Because of
the high gabled roof between the HVAC unit and Turner Street, we expect that rooftop

HVAC unit noise at #47 Turner Street will be much lower than the daytime ambient noise
we measured.
We believe that the estimated noise at ear level at #42 should be acceptable during daytime
hours. At the second floor level the estimated noise level is 1 to 6 dBA above the
measured ambient levels. Typically an increase in overall sound level of 1 dBA is not
noticable, while a 6 dBA increase is typically clearly noticeable. We expect that noise
from the HVAC unit is likely to be audible in second floor rooms of#42 which overlook
the North face of the Education Center when windows in those rooms are open, but would
likely be considered acceptable by many people.
Outlined below are two noise control options you may want to consider to reduce the
amount of rooftop HVAC noise that reaches the second floor of 1#42 Turner Street:
1. Break the line of sight between the unit and the second floor windows of 1142 by
increasing the elevation of the architectural roof sections which exist between the unit
and the North face of the building, or by erecting a solid barrier wall on the roof of
the Education Center between the unit and the North face of the building;
2. Specify a significantly quieter rooftop HVAC unit.
This concludes our comments regarding noise from the proposed rooftop'HVAC unit at
the House of the Seven Gables in Salem. Our scope of services is complete with submis-
sion of this letter. Please let us know if you have any questions. We would be happy to
provide additional services regarding the development or evaluation of noise control
options.

2) Employ an acceptalbe method for dust and street cleaning control
during site construction and submit a copy of the method utilized
to the Health and Planning Departments in writing.
3) Prior to site start-up, demolition and also during site construction,
employ a licensed pest control firm for site evaluation and service
with a copy of the service program sent to the Health and Planning

4) Measures be taken to assure that air pollution due to odors and

The enclosed meeting minutes are an accurate statement of the
points made at the above-referenced engineering review meeting.
The meeting was held at the Salem City Engineer' s Office in
response to a request by Attorney John Serafini, Sr. , acting on
behalf of the House of Seven Gables Settlement Association, that
several requests for information in our letter to your office of
July 29 , 1992 be clarified.
The recent meeting with Attorney Serafini and Brett Donham, AIA,
was an update of the status of the project proponents ' engineering
and architectural studies, and information was recieved and filed
with respect to preliminary storm drainage design alternatives .
It would appear from the report prepared by Judith Nitsch Engin-
eering that a system of leaching pit-type catch basins, which
recharge runoff to the underlying sandy soils, would be preferable
to an optional system that would involve piping of runoff to a
Salem Harbor discharge at the lower end of Turner Street.
Information contained in soil borings, received by this office on
this date, indicate a typical "compact fine brown sand" in the
area, which would, with proper design, lend itself well to an
infiltration system. As noted in Donham' s memo, runoff and capa-
city calculations will have to be submitted to this office with
final submittals .

Of particular note is the fact that there appears to be an exist-
ing storm drainage system, of sorts, that discharges to the sewer
in Turner Street through an old building sewer. It should be in-
cumbent upon the project proponents to have this existing pipe
investigated and, if it is indeed a building sewer, include a
replacement or abandonment proposal in the final submittals.
Hydrant test submittals , along with the certification of the fire
protection engineer with respect to the adequacy of the service
for support of a sprinkler system, were received and filed. It
appears that the existing water system will be adequate for the
intended fire demands in the proposed project.

DECISION ON THE PETITION HOUSE OF SEVEN GABLES SETTLEMENT ASSOCIATION
FOR VARIANCES AT 46-54 TURNER STREET (R-2/B-1 )
A hearing on this petition was held May 20, 1992 with the following
Board Members present: Richard A. Bencal, Chairman; Messrs. , Febonio,
Greaiish, Touchette and Associate Member Plante. Notice of the hearing
was sent to abutters and others and notices of the hearing were properly
published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioners, owners of the property, are requesting Variances from front
yard setbacks and minimum distance between buildings to allow
construction of a new building and an addition to an existing building
in this R-2/B-1 district.
The variances which have been requested may be granted upon a finding by
the Board that:
1 . Special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures involved.
2 . Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence
presented at the hearing, and after viewing the plans, makes the
following findings of fact:
1 . The petitioner, through Counsel and expert witnessess, introduced
evidence as the topography of the property, the proposed building
locations and the extent of the rehabilitation and renovation.
2. The lot is located in two different zones, one portion is located in
the B-1 zone and the other portion is R-2. The proposed buildings
comply with the R-2 except for the requested variances.
3. Several neighbors spoke in favor of the petitioners request and a
petition with signatures of fifty (50) Salem residents supporting the
request was also submitted.

4 . That the particular size and shape of the petitioners' lot
especially affects the land and structures involved and are conditions
not generally affecting other land, buildings or structures in the
district.
5. That the uniqueness of the Historical Site and the buildings located
thereon especially) affect the petitioners property and do not generally
affect other land, building or structures in the district.
6 . That due to the existing Historical buildings located on the
property, as well as the unique size and shape of the land, the proposed
construction could not be reasonably located on any other spot withing
the property.
7. ;hat adequate on-site parking will be available per the petitioner's
plans 167 spaces ) and that the proposed off-site parking of buses will
be less detrimental to the district than the existing situation with
buses parking on site.
8 . That the petitioner sought and received neighborhood input and that
three neighborhood meetings were held.
9 . That the petitioner derives its existence from the money generated
by tourists visiting the property, and currently the petitioner is
unable to adequately serve the needs of the visiting tourists with the
configuration of the existing facilities.
10. That the funds generated by visiting tourists to the property allow
the petitioner to establish and maintain the Historical buildings and
grounds as well as several social service programs available to the
entire community, which have been historically funded by the petitioner.
11. That the new facilities would permit handicapped access, and would
enable the petitioner to conduct its educational and orientation
services for visitors in an adequate manner and in an environment that
is not exposed to the elements.
12. That the petitioner would suffer substantial hardship in lost
revenues and services if the variances requested are not granted and the
Zoning Ordinance provisions are literally enforced.
13. That the variances requested are in harmony with other properties
within the district and can be granted without substantial detriment to
the public good and without nullifying or substantially derogating from
the intent of the district or purpose of the Ordinance.
On the basis of the above findings of fact, and on the evidence
presented at the hearing, the Board of Appeal concludes as follows:

1. Special conditions exist which especially affect the subject
property but not the district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 4-1 (Mr. Bencal voted in
opposition) to grant the variances requested, subject to the following
conditions:
1 . Petitioner shall comply with all city and state statutes,
ordinances, codes and regulations.
2. All construction shall be done as per the plans and dimensions
submitted and by legal building permit.
3 . All requirements of the City of Salem Fire Prevention Bureau
relative to smoke and fire safety shall be strictly adhered to.
4. Proper numbering shall be obtained from the City of Salem Assessor.
5. Appropriate approval from all other City Boards, Commissions or
Authorities having jurisdiction over this property shall be obtained.
6. A preconstruction survey is to be obtained.
7. A neighborhood .impact study is to be conducted.
8. Parking plans for workers and construction vehicles for off site
parking to be approved by the Planning Department.
9. A Plan for bus parking, drop-off, pick-up of visitors is to be
approved by the Planning department before construction begins.

1 . The proposed plan shows a nine car dead end parking aisle in
this area. The lot ends two feet from the property line, as
a result the large existing vegetation in this area would have
to be removed. There is also no path from the bus drop off to
the building entrance. The most direct route would cross two
parking aisles and three rows of spaces .
A possible solution to these concerns would be to orient the
spaces perpendicular to the existing aisle. This would leave
room for an eight foot walk and would allow ample room for
protection of the existing vegetation.
2 . The proposed plan shows angled parking oriented so that 1t
could only be accessed from the Turner Street side. Orienting
these spaces perpendicular to the aisle would allow parking
from either direction.
3 . Concerns expressed by the neighbors may lead to closing the
Turner Street entrance. A better solution would be to make
this an exit only . This would allow a car to drop people off
at the building entrance and continue out to Derby Street.
4 . Cars can not back straight out of the corner space nere the
bus drop off. Orienting these spaces perpendicular to the
aisle would correct this problem. Since this aisle is already
one way angled parking in itself is not a problem in this
area.
5 . The proposed addition on the Retire Becket House, as it is
currently shown will necessitate the removal of the large
Norway Maples . Reorienting the addition so that it is a
minimum of five feet from all parts of the trees would help
save them.

On Thursday, July 16, 1992, the Planning Board of the City of
Salem held a public hearing regarding the application of House of
Seven Gables Settlement Association, for a Special Permit under
Section VII-18, Site Plan Review, of the City of Salem Zoning
Ordinance with respect to the construction of a 14,000 square feet
addition to part of the present Visitor 's Center and a 160 square
feet kitchen addition to Retire Becket House located at 46-54
Turner Street.
At a regularly scheduled meeting of the Planning Board held on
Thursday, November 5, 1992, the Board voted, by a vote of eight in
favor, none opposed, to approve the application as complying with
the requirements of a Special Permit, subject to the following
conditions:
1 . Conformance with Plan
Work shall conform to plan entitled "Site Plan -
Education Center, The House of The Seven Gables" prepared
by Donham and Sweeney, Inc. , dated November 2, 1992 .
2 . Construction Practices
All construction shall be conducted in accordance with
the following conditions:
a . No work shall commence before 8 :00 a.m. on weekdays
and 8: 00 a.m. on Saturdays. No work shall continue
beyond 5:00 p.m. There shall be no work conducted on
Sundays or holidays . Inside work of a quiet nature may
be permitted at other times.

ordinances of the City of Salem.
3 . Landscaping
Landscaping of the site shall conform to plan entitled,
"House of the Seven Gables Parking Lot - Planting Plan" ,
dated November 2, 1992 and "Planting Plan - Ed Center"
House of the Seven Gables dated November 2, 1992.
a. Trees shall be a minimum of 4 1/2" caliper deciduous tree
at the north-east area where junipers are to be removed.
b. Vegetation surrounding Grand Turk parking lot shall be
maintained in a healthy and thriving condition.
C. Large Norway Maple multistem tree behind the Retire
Becket House shall be maintained.
d. Large tree on Derby Street across from Settlement House
should be cut back .
e. Maintenance of landscape vegetation shall be the
responsibility of the developer , his successors or
assigns.
f. After all project landscaping is completed, and prior
to the issuance of a Certificate of Occupancy, the
developer will be required to add further landscaping
if it is requested by the Planning Board or City
Planner .
4 . Utilities
a. Memorandum #93-12 from City Engineer, Stanton Bigelow
dated October 15, 1992 shall be adhered to unless further
review by City Engineer deems additional alterations may
be necessary.
b. Additional utility installation, if any, shall be
reviewed and approved by the City Engineer or other
appropriate department head prior to the issuance of a
building permit. ,

7 . Lighting
a. Exterior lighting shall be installed and maintained
in such a manner so as not to reflect or cause glare on
abutting properties or which adversely effects safe
vision of operators of vehicles moving on nearby streets .
b. Lighting for the project shall be reviewed and
approved by the City Planner prior to the issuance of a
Certificate of Occupancy.
8 . Signage
Signage for the building shall be reviewed and approved
by the City Planner prior to issuance of Certificate of
Occupancy.
a. Install signs at Derby Street and Turner Street
indicating buses entering.
9 . Rooftop Equipment
Rooftop equipment shall be screened or otherwise
mitigated from abutting neighbors. Such screening shall
be approved by the Planning Board, prior to issuance of
a Certificate of Occupancy.
a. Rooftop equipment must be installed with a timing
device to eliminate the usage of the equipment between
10 : 00 p.m. and 8: 00 a.m.
10 . Crosswalk
A new crosswalk will be installed in the vicinity between
the Grand Turk Tavern parking lot and the existing
crosswalk at the intersection of Derby and Turner Streets
subject to the City Planner 's approval.
11. Amendments
Any amendments to site plan shall require the approval of
the Planning Board.
12 . Violations
Viol ons of any condition shall result in the
revocation of this approval by the Planning Board.
I hereby certify that a copy of this decision on and plans have
been filed with the City Clerk and copies are on file with the
Planning Board. This Special Permit shall not take effect until a
copy of this decision bearing the certification of the City Clerk
that twenty ( 20) days have elapsed and no appeal has been filed or
denied, is recorded in the Essex County Registry of Deeds and is
indexed under the name of the owner of record or is recorded on the
owner ' s certificate of title. The fee for recording or registering
shall be paid by the owner of applicant .
