Hamilton, MA 01982 On Thursday, June 5, 1986, the Planning Board of the City of Salem held a public hearing regarding the application of Maine Post and Beam for a • Special Permit, under Section R, Site Plan Review, of the Salem Zoning Ordinance, with respect to the construction of fourteen (14) residential dwelling units around Tedesco Pond, off of Marcia Avenue. At a regularly—scheduled meeting of the Planning Board held on June 25, 1986, the Board voted, by a vote of six in favor, one opposed, to approve the application as complying with the requirements for the issuance of the Special Permit with the following conditions: 1. Work shall conform to plan entitled "Site Plan, Tedesco Pond Place,. . sheers 1-5" dated April 29, 1986, and supporting data entitled, "Drainage Computations", dated March, 1984, and "Sewage Pump Station Flow Computations", dated September, 1984, all prepared by Hancock Survey. 2. All requirements of the Engineering Department set forth in a letter dated June 5, 1986, to the Salem Planning Board, shall be adhered to, including the installation of a five—foot sidewalk along the westerly side of the roadway. Specific locations of such sidewalks shall be defined on a plan to be submitted to and approved by the Planning Board. 3. All Board of Health requirements set forth in a letter dated June 12, 1986, shall be adhered to. • 4. All conditions set forth in Board of Appeal decision dated May 14, 1986, shall be strictly adhered to. 5. "Agreement with Abutters" dated April 27, 1986 and "Covenant Granting Limited Access Privilege" dated April 27, 1986, shall be . a Page 2 - • 6. Landscaping of the site, including screening of proposed pump station and any trash receptacles, shall be in conformance with plan entitled "Tedesco Pond Place, Planting Plan", prepared by Frank Todd & Associates, dated February; 1986 and shall be further reviewed and approved by the Planning Department prior to issuance of Certificates of Occupancy. a. Maintenance of vegetation in a healthy and thriling condition shall be the responsibility of the developer, his successors or assigns. 7. Sloped granite curbing. shall be installed along the entire roadway. a . Sloped granite curbing shall be installed in other areas as defined by the City Planner. b. Cape Cod berms shall be allowed where sloped granite curbing is not deemed to be necessary. 8. Exterior lighting shall be installed and maintained in such a manner so as to not reflect or cause glare on abutting or facing • residential premises. a. All exterior lighting shall be reviewed and approved by the Planning Department prior to issuance of Certificates of Occupancy. 9. Exterior designs shall conform in height and architectural style to plan entitled "Tedesco Pond Place", dated February 27, 1986, revised June 1, 1986, prepared-by Tracy Moore and shall be reviewed and approved by the Planning Department prior to issuance of Building Permits. 10. Location, design, and construction specifications of mail collection areas and entrance areas into the project, and the landscaping of such areas, shall be reviewed and approved by the Planning Department. 11 . Proposed improvements to the open space areas shall be reviewed and approved by the Planning Department prior to issuance of Certificates of Occupancy. 12. All construction shall be carried out in accordance with the Rules and Regulations of the Planning Board. a. A Clerk of the Works will be required at the expense of the . developer as is deemed necessary by the City Planner and/or the Director of Public Services. r- _ - Page 3 - • b. As-built plans, stamped by a Registered Professional Engineer or Land Surveyor shall be submitted to the Engineering Department prior to issuance of Certificates of Occupancy. c. All roadway, sidewalk, and utility construction shall be completed prior to issuance of Certificates of Occupancy. d. A performance guarantee, in a form satisfactory to the Planning Department and Engineering Department shall be submitted prior to issuance of building permits. 13. Any violation of these conditions shall result in the revocation of this permit by the Planning Board. The application complies with the requirement that the Cluster Development will not result in a negative environmental impact in that after review of the Environmental Impact Statement prepared for the Salem Planning Board by Sea Plantations, Inc., and after receipt of comments by the Salem Conservation Commission stating that the development will contain minimum disturbance of the land and preservation of natural areas for open space, and after review of comments received at the public hearing, the Planning Board determined that the proposed Cluster Residential Development would not result in a net negative environmental impact. By a vote of seven in favor, none opposed, the Planning Board voted to grant the Special Permit for Cluster Residential Development,subject to the following conditions: 1. The number of dwelling units shall be reduced to sixteen. The locations of these units and their respective lot lines shall be modified to reflect that plan submitted to the Planning Board on May 31, 1984, entitled,"Proposed Revisions to Tedesco Pond Place." All roadway specifications, open space areas, lot areas, and walkways shall be modified to reflect those changes shown on the May 31st reference plan. 2. All pedestrian walkways shall have a'six inch gravel subbase and will be constructed of V roofing gravel stone. The plan shall show the location of all walkways and shall define the accessibility of each walkway to the public. The plan shall,show all walkways and driveways. The.system of walkways, roadways, and driveways shall be approved by the Planning.Board prior to the initiation of construction, and the Planning Board shall reserve the right to require additional walkways, roadways and driveways as it deems appropriate. The adequate maintenance of all walkways, roadways and driveways.in addition to the footbridge and settlement basin shall be sufficiently defined in the rules and regulations of the homeowners association and shall be subject to the approval of the Planning Board. 3. The list of requested waivers submitted by the developer on March 22, 1984, shall be modified to.reflect the shortened length of the main roadway as seven hundred and sixty five feet with an access roadway, ten feet wide, for an additional one hundred ten feet. The hammerhead turnaround shall belocated at the northenmost corner of the site, adjacent to units twelve, thirteen, and fourteen. With the exception to those requested waivers,the pians shall conform to all requirements set forth in the Salem Massachusetts Subdivision Regulations, as amended December 4, 1975. The roadway right of way shall have a minimum width of thirty feet. The roadway shall have a minimum paved surface of twenty four f feet and shall have a granite curb on both sides. Waivers shall be adopted with { approval reservation by the Planning Board. A sidewalk shall be required on one side of the roadway, the location and composition of which subject to Planning Board approval. -3- '84 JUL -2 P i :5z 4. The developer shall resolve the issues addressed by the.Acting City Engineer Richard Swenson, in the Definitive Plan and Wetland$ o rpFpts aF�ert dated April 17, 1984, and April 19, 1984, on file at the Salem. Plar}f{i r partmen . pecifically: ._ a. The Engineer's concurrence with the plan is.subject to the. City Engineer's approval of the design, operation, maintenance, maintenance schedule, installation, and inspection of the sewage pump station. The installation of an eight inch diameter ductile iron water main is required and subject to the City Engineer's review,and approval. b. There will be a minimum five foot horizontal separation between the force main and the gravity sewer main from the pump station to Elm Avenue. This is subject to the review and approval of the City Engineer. c. There will be no construction or alteration of the land u on p existing drainage easements unless approved pp oved by the Planning Board. d. Since a portion of the sanitary sewer is to be constructed below water level, precautions shall be' made to prevent water from entering the pipes during construction and to assure proper bedding for the pipes. Specifically, 1) proper jointing of the pipes shall be adhered to; 2) proper care shall be assured in the laying of the pipe; 3) the pipe shall be sealed at the end of each construction day until the final connection and jointing has been completed; and 4) proper pumping procedure shall be followed p , to keepthe trench de-watered watered dur' to construction These precautions are subject to the review an g J d approval of the Cit Engineer are PP Y E g neer and to be in accordance with ASTM standards. e. Specific building locations and the base elevations of the lowest level shall be shown on the plans and shall be subject to the approval of the Planning Board prior to the start of construction of the development. 5. The development shall conform to the requirements.set forth for Wetlands and for Cluster Residential Special Permits as defined in Section VII of the Salem Zoning Ordinance. 6. The five concerns raised by the Salem Board of Health in their letter dated April 9, 1984, (attached hereto) shall be adequately addressed to the satisfaction of the Planning Board. 7. Emergency access to Tedesco Pond Place from Eleanor Road shall be approved by the Fire Marshall and the City Engineer prior to the occupancy of any home. The homeowners association shall be responsible for the adequate maintenance of road emergency access and shall be responsible for snow removal at the terminus of Eleanor Road. A granite curb shall be installed at the terminus of Eleanor Road to impede general traffic and said curb shall be subject to the approval of the Fire Marshall and the City Engineer. The rules and regulations of the homeowners association shall specify that snow removal shall include that emergency access -4- p gate at Eleanor Road be kept free of snow at all timd814nd11&S'Ah8 roadshall be accessible to emergency vehicles at all times. A breakaway barrier.shall be installed and maintained at the terminus of Eleanor #n(-shall be`sG6ject to the review and approval of the Fire Marshall prior to 9h DaEion. 8. The developer shall adequately address the existing drainage flow from Peter Road and Eleanor Road such that the proposed development when constructed will not negatively affect said flow. Plans by the developer shall conform-to the proposed changes specified in Engineering Consultant James MacDowell's letter of June 7, 1984. Specifically: a. The contour of the land in the southeast corner of. the site shall be swaled in a manner which will direct storm water run-off from Peter Road into the proposed development's drainage system. b. A catch basin shall be installed over the existing sixty inch drain on Eleanor Road to catch existing storm water runoff from Eleanor Road. This catch basin shall be constructed such that all storm water run-off from Eleanor Rdad shall be received by it. This catch basin shall be constructed with an overflow mechanism. c. The design of the storm water drainage system pertaining to run-off from Eleanor Road and Peter Road including the location of all catch basins shall be subject to the approval of the City Engineer. Construction shall not begin until the City Engineer has made a determination that the construction of the development shall have no detrimental effect upon the water drainage of the neighborhood. 9. Only calcium chloride may be used as a de-icing agent within the development. 10. Access to the development for construction purposes shall be from Tedesco Street only. 11. Common areas and buffer zones shall be restricted by the following conditions: a. In the buffer zone adjacent to the existing residential neighborhood and in all common areas, the developer shall provide a landscaping plan which must be approved by the Planning Department prior to the sale of any lot in the subdivision. The developer shall request and take into account the thoughts and requests of property abutters as the landscaping plan is developed. The developer is responsible for fully implementing the landscaping plan. The developer shall make certain that plantings shall be maintained in a healthy and thriving condition. Should these plantings not remain in a healthy and thriving condition,the developer shall replace said plantings and shall be repsonsible for the healthy and thriving condition of those plantings for a period of one year following replanting. Following those one-year periods, the homeowners association shall be responsible for maintaining buffer zone plantings in a healthy and thriving condition. nrr . .. _5_ r JUL84 L -2 P 1 .52 b. All improvements to common areas shall be completed or appropriately bondld-F prior to the sale of any lot. d. A covenant governing the maintenance of the common area shall be submitted to the Planning Board and shall be approved prior to the sale of any lot. This agreement shall run in perpetuity. e. The developer shall develop a plan for the type of limited access to the pond and common areas as defined in Section VII of the.Salem Zoning Ordinance and said plan shall be approved by the Planning Board prior to.the sale.of any lot. 12. Refuse removal, road and ground maintenance, and snow removal from Tedesco Pond Place shall be the exclusive responsibility of the homeowners association. 13. As required by the Salem Massachusetts Subdivision Regulations, Section III, Part B, an Environmental Impact Statement must be submitted to the Planning Board. The developer must submit those items missing in the original submission. Specifically: a. Natural Environment: Items 1. Air,2.Land, 4. Energy,5. Noise b. Man-made environment: Items 4. Architecture, and 5. Historic Areas c. Public Facilities: Items 5. Refuse Disposal, and 6. Traffic Facilities d. Community Services: All Items e. Human Considerations: All Items 14. All construction within the development shall be conducted in accordance with the following conditions: a. The developer shall make certain that no construction shall take place in areas which might cause disturbance to abutters prior to 7:00 a.m. on any work day, 8:60 a.m. on Saturdays, or at any time on Sundays, provided that nothing herein shall be deemed to restrict interior work or provided that it is exterior work which does not cause a disturbance. Work shall cease no.later than 6:00 p.m. b. The developer shall take all actions necessary to minimize inconveniences to residents in the immediate neighborhood. Said inconveniences may relate to noise, vibration, dust, blocking of City roads or those concerns deemed appropriate by the appropriate Department heads of the City of Salem at the time of occurrence. The developer shall provide an access easement to the City of Salem which shall provide access to the footbridge siltation barrier for the;purpose of inspection and/or maintenance when appropriate. 17. All building exteriors and designs shall be approved.by the Planning Board prior to issuance of a building permit. 18. Prior to the approval of the plan, the developer: a) shall submit and record a duly executed restrictive covenant setting forth the conditions set forth herein in a form satisfactory to the Planning Board and b) shall revise the plan to include a reference to said covenant. Both such actions shall take place prior to the initiation of any construction. This restrictive covenant shall include any provisions the Planning Board deems appropriate to:allow the City of Salem to ? enforce the maintenance obligations of the homeowners association as set forth herein. 19. The developer shall accept all conditions set forth herein and shall follow all requirements set forth in the Salem Massachusetts Subdivision Regulations and the Salem Massachusetts Zoning Ordinance, except as waived herein. 20. Any change i.n the above conditions must have approval of the Planning Board, and the Conservation Commission shall be notified prior to any change. 21.
