Wetlands & Flood Hazard District Special Permit
On Thursday,July 1, 2004, the Planning Board of the City of Salem opened a Public Hearing regarding the
application of Norman Dube, 117 Judge Road,Lynn, MA, 01904, under the Wetlands & Flood Hazard
District Special Permit for the construction of a 9,900 square foot office/storage building at 4 Technology
Way. The project includes associated paving,grading,utilities and drainage
The public hearing was continued to July 15, 2004, September 2, 2004, September 16, 2004 and October 7,
2004. The Public Hearing was closed on October 7, 2004. At the regularly scheduled meeting of the
Planning Board held on October 7, 2004, the Board voted by a vote of seven in favor (Power, Durand,
Moustakis,Lombardini, Puleo, Sullivan, DiGerommo), one opposed (Collins), to deny the application
based on the following reasons:
1. During the public hearing process with the Planning Board, the Conservation Commission
reviewed the submitted plans during their public process, made changes to the plans and approved
revised plans,which significantly changed the stormwater management system for the site. The
revised plans were not submitted to the Planning Board for their review, despite requests for those
plans.
2. The plan, dated April 30, 2004, before the Planning Board fails to protect the wetlands against
pollution and contamination, does not satisfactorily manage stormwater runoff, and would
adversely affect ground water resources.
3. Therefore, the submitted plan does not comply with the following Sections of the Salem Zoning
Ordinance:
a. Section 7-16(a)(3)
"The purpose of the section is to preserve the natural flood-control characteristics and the
water storage capacity of wetlands and floodplains and to protect against pollution and
contamination of such water supplies and to conserve valuable habitats for wildlife,
including fisheries and shellfisheries."

b. Section 7-16(d)(4)
"The cumulative effect of the proposed development or use,when combined with all other
existing and anticipated development and uses,will not obstruct or divert flood flow;
substantially reduce natural flood water storage capacity in the local drainage area; destroy
valuable habitat for wildlife,including fisheries or shellfisheries; adversely affect
groundwater resources or increase stormwater runoff velocity so that water levels on other
land are substantially raised or the danger from flooding increased."
I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on
file with the Planning Board. The Decision shall not take effect until a copy of this decision bearing the
certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if
such appeal has been filed,and it has been dismissed or denied,is recorded in the Essex South Registry of
Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of
Title. The owner or applicant, his successors or assigns, shall pay the fee for recording or registering.
