MA �cowrr�� CLERK'S OFFICE Planning �Buarb One 6alem Oreen 1003 APR IS P 2: 01 Site Plan Review Decision April 15, 2003 Peter Copalas,President Heritage Co-operative Bank 71 Washington Street Salem, MA 01970 RE: 35 Saint Peter Street On Thursday, December 5, 2002, the Planning Board of the City of Salem opened a Public Hearing regarding the application of Heritage Co-operative Bank under Section 7-18 Site Plan Review for the renovation of an existing structure, reconfiguration of existing parking, and the addition of landscaping located at 35 Saint Peter Street. A portion of the building will contain a bank, with a drive through facility located on the site. The Public Hearing was continued to December 19, 2002, January 9, 2003, January 16, 2003, February 6, 2003, February 20, 2003, and March 6, 2003. The Public Hearing was closed on March 6, 2003. At a regularly scheduled meeting of the Planning Board held on March 6, 2003, the Board voted by a vote of eight(8) in favor(Power, Puleo, Moustakis, Lombardini, Sullivan, Collins, Durand, Cullin), none(0) opposed, and one absent (Weiner) to approve the application as complying with the requirements of Site Plan Review, subject to the following conditions: 1. Conformance with the Plan Work shall conform with the plans entitled, "Heritage Coop Bank, 35 Saint Peter Street, Salem, MA", sheets L-1.0, and L-1.1 prepared by Royal Design Builders, 82 Tide Mill Road, Hampton,N.H. 03842, dated March 6, 2003. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. The Planning Department will work with the owner of the site, the applicant, and the architect to insure a plan to maintain a 19-foot wide, two-way aisle through the rear of the site adjacent to Saint Peter Street. b. A yield sign shall be hung from the canopy of the Heritage Bank drive-through. c. The pedestrian entrance marked number 3 on the approved plan will be reconstructed to be at a 45 degree angle and recessed 5 feet to provide an area for pedestrians to view oncoming traffic prior to crossing the parking area. d. Emergency lights will be placed in entrance number 3, and the emergency entrance, visible from the drive-through, so that oncoming vehicles will be alerted if there is a building emergency and pedestrians will be exiting. e. The street light located along Federal Street will be moved to a more suitable location. The City Planner shall approve the proposed location for the light prior to installation. f The parking spaces designated on the site plan as numbers 1, 2, 3 will be striped as employee parking only. 4. Entrance Area Prior to the issuance of a building permit, the Planning Department and the applicant will meet to resolve outstanding issues regarding the safety and effectiveness of the entrance to the site from Saint Peter Street. Specifically, the gate blocking the entrance area will be discussed. Any changes recommended shall be shown on an amended plan for approval by the City Planner. 5. Landscaping a.All landscaping shall be done in accordance with the approved set of plans. b.Trees shall be a minimum of 3 % inch caliper and with a minimum height of 8-feet. c. Maintenance of landscape vegetation shall be the responsibility of the developer,his successors or assigns. d. After such landscaping is completed, the developer will add farther landscaping if such is requested by the Planning Board or the City Planner. 6. Signage Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 7. Lighting a. No light shall cast a glare onto adjacent parcels or adjacent rights of way. b. A final lighting plan shall be submitted to the City Planner for review and approval 35 Saint Peter,Heritage Bank 1 , Site Plan Review-3 prior to the issuance of a building permit. c. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of a Certificate of Occupancy. 8. Conservation Commission All work shall comply with the Order of Conditions issued by the Salem Conservation Commission, if applicable. 9. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules,regulations and ordinances of the City of Salem. f All construction vehicles left overnight at the site, must be located completely on the site. 10. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant,his successors or assigns' expense, as is deemed necessary by the City Planner. 11. Board of Health All Board of Health requirements as specified in the attached decision dated January 9, 2003, shall be strictly adhered to. 12. Fire Department All work shall comply with the requirements of the Salem Fire Department. 13. City Engineer The applicant shall comply with all requirements of the City Engineer. 15. Salem Redevelopment Authority All requirements as set forth by the Salem Redevelopment Authority shall be adhered to. 16. Utilities Any Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 17. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant,his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2)year period. 18. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. 19. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
