A Public Hearing on this petition was held on May 20, 1993 at 7 : 30 p.m. , with the following Board members: Linda Vaughan, Acting Chairperson, Debbie Hilbert, Carter Vinson, David Hart, Albert Hill and Chuck Puleo. Notice of this Hearing was sent to abutters and notice of the hearing was properly published in the Salem Evening News . Petitioner, owner of the property, is requesting a waiver from frontage requirements for lots 702, 703 and 357 from the Subdivision Regulations under M.G.L. - Chapter 41 - Section 81 R. This Section states that "A planning board may in any particular case, where such action is in the public interest and not inconsistent with the intent and purpose of the subdivision control law, waive strict compliance with its rules and regulations, and with the frontage or access requirements specified in the law. . . " The waiver for lots 702 and 703 ONLY are being granted upon a finding by this Board that : 1 . Lots 702 and 703 are in an existing subdivision of similar sized lots . 2. Special conditions and circumstances exist which affect lot 703 due to its configuration and location between the structures on two existing lots. The lot is located at a turn in the road which serves as a hammer head turn to assure access of emergency vehicles. 3 . Lot 703 is a corner lot which widens toward the rear of the lot and such will be able to accommodate the placement of a single family home. The waiver for lot 357 will not be granted. Therefore, the Planning Board voted by a vote of five ( 5) in favor , one ( 1) opposed, to grant the Waiver from frontage requirements for lots 702 and 703 and to deny granting a waiver from frontage requirements for lot 357 . WAIVER GRANTED JUNE 17, 1993 This endorsement shall not take effect until a copy of the decision bearing certification of the City Clerk that twenty ( 20) days have elapsed and no appeal has been filed or that if such appeal has been filed that it has been dismissed or denied, is recorded in the Essex South District Registry of Deeds and is indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner ' s certificate of title. The fee for recording or registering shall be paid by owner or applicant .
