A public meeting was held on September 7, 2006 regarding the application of David Jalbert,75
North Street, Salem, MA for a Wetlands and Flood Hazard Special Permit (pursuant to Section
7-16 of the Zoning Ordinance of the City of Salem) for construction of a one and one-half(1 '/2)
story addition on top of the existing one story, thirty(30) by ninety(90) foot wing of the
structure, a thirty (30) by nineteen and one-half(19 '/2") foot loading area and a seven (7) by
seventeen (17) foot stair tower.
The public hearing was continued to October 19, 2006. The public hearing was closed on October
19, 2006. At the regularly scheduled Planning Board meeting on October 19, 2006 the Board voted
by a vote of eight (8) in favor (Power,Moustakis, Collins, Kavanagh, Puleo,Lombardini, Ready,
Sullivan) and none (0) opposed, to approve the Wetlands and Flood Hazard Special Permit subject
to the following conditions:
1. Conformance with the Plan
Work shall conform with the plans entitled, "Salem Kitchen and Bath" prepared by
Richard Griffin, 37 Turner Street, Salem, MA 01970, and dated June 30, 2006.
2. Utilities
a. Utility installation shall be reviewed and approved by the City Engineer.
b. All utilities shall be installed underground.
3. Board of Health
All requirements of the Board of Health shall be strictly adhered to.
4. Fire Department
The applicant shall comply with all requirements of the Salem Fire Department.
5. Building Inspector
The applicant shall comply with all requirements of the City Building Inspector.
6. City Engineer
The applicant shall comply with all requirements of the City Engineer.

7. Design Review Board
The following conditions shall be implemented and verified prior to the issuance of a
certificate of occupancy.
a. The first and second floor windows on the South Elevation shall have shutters that
match the Front Elevation.
b. The windows in the roof peak of the South and North Elevations shall contain
pediments and headers similar to the lower windows on the South Elevation.
c. The entry under the "Creations" sign shall be recessed by 1-1/2 feet.
d. The gable ends on the dormers shall stick out, slightly, and the trim shall measure
5 '/a x 8. The gable ends of the building should stick out by 8 inches or more
8. Conservation Commission
The applicant shall comply with all requirements of the Conservation Commission.
9. Amendments
Any further amendments to the site plan shall be reviewed by the City Planner and if
deemed necessary by the City Planner, shall require approval of the Planning Board.
Any waiver of conditions contained within shall require the approval of the Planning
Board.
10. Construction Practices
All construction shall be carried out in accordance with the following conditions:
a. The operation of tools or equipment used in construction or demolition work shall
occur in accordance with Salem Ordinance Section 22-2 (5)• Construction and
Blastine and between the hours of 8:00 AM and 5:00 PM on weekdays and
Saturdays. No work shall take place on Sundays or holidays.
b. Any blasting,rock crushing,jack hammering, hydraulic blasting, or pile driving shall
occur in accordance with Salem Ordinance Section 22-2 (5): Construction and
BlasdaVrid be limited to Monday-Friday between the hours of 8:00 AM and 5:00
PM. There shall be no blasting, rock crushing, jack hammering, hydraulic blasting,
or pile driving on Saturdays, Sundays, or holidays.
c. Blasting shall be undertaken in accordance with all local and state regulations.
d. All reasonable action shall be taken to minimize the negative effects of construction
on abutters. Advance notice shall be provided by the applicant to all abutters in
writing at least 72 hours prior to commencement of construction of the project.
e. All construction vehicles and equipment shall be cleaned prior to leaving the site so
that they do not leave dirt and/or debris on surrounding roadways as they exit the
site.
f. The applicant shall abide by any and all applicable rules, regulations and ordinances
of the City of Salem.
g. All construction vehicles and equipment left overnight at the site must be located
completely on the site.
h. All staging of materials and equipment shall be on-site.
i. No Street shall be closed without prior approval of the Department of Planning and
Community Development, unless deemed an emergency by the Salem Police
Department.
j. Any roadways, driveways, or sidewalks damaged during construction shall be
restored to their original condition by the Owner.
11. Violations
Violations of any condition shall result in revocation of this permit by the Planning
Board, unless the violation of such condition is waived by a majority vote of the
Planning Board.
12. As-built Plans
As-built Plans, stamped by a Registered Professional Engineer, shall be submitted to the
Department of Planning and Community Development and Department of Public
Services prior to the issuance of the final Certificate of Occupancy.
The As-Built plans shall be submitted to the City Engineer in electronic file format
suitable for the City's use and approved by the City Engineer, prior to the issuance of the
final Certificate of Occupancy.
A completed tie card, a blank copy (available at the Engineering Department) and a
certification signed and stamped by the design engineer, stating that the work was
completed in substantial compliance with the design drawing must be submitted to the
City Engineer prior to the issuance of the final Certificate of Occupancy; as well as, any
subsequent requirements by the City Engineer.
I hereby certify that a copy of this decision and plans has been filed with the City Clerk and
copies are on file with the Planning Board. The Special Permit shall not take effect until a copy
of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and
no appeal has been filed or that if such appeal has been filed, and it has been dismissed or
denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the
owner of record is recorded on the owner's Certificate of Title. The owner or applicant, his
successors or assigns, shall pay the fee for recording or

SUBJECT: DRB Recommendation—401 Bridge Street

At the Design Review Board meeting held on October 17, 2006, the Board unanimously
voted to recommend approval of the project at 401 Bridge Street as modified by the
applicant in plans dated October 17, 2006 and with conditions listed below.
PROPOSAL
The applicant appeared before the Design Review Board on September 27, 2006 to discuss
the plans for the construction of a new building at 401 Bridge Street. The original submittal
is on file in the Department of Planning and Community Development dated September 20,
2006.
The DRB asked the applicant to provide the Board with the following modifications prior to
their special meeting on October 17, 2006:
• The landscaping plan should be modified to include vertical growing
Bradford Pear trees and it was suggested that the Hemlocks be changed to
Oriental Spruce;
• The rhythm of the windows could be more creative;
• The design of the building should be modified to be more inspired and pick
up characteristics of Salem's architecture;
• The colonnade along Bridge Street should be looked at farther as it relates to
the sidewalk;
• A fence or landscaping should be added at the church side of the parking lot;
and
• The applicant should look at burying the electrical poles and changing the
light posts along Bridge Street.

The applicant made changes to the plans and presented those to the DRB on October 17,
2006. The modified plans are on file in the Department of Planning and Community
Development dated October 17, 2006 and a narrative overview of the changes are outlined
in the attached email from the applicant.
RECOMMENDATION
At their meeting on October 17, 2006, the DRB recommended approval of the plans dated
September 20, 2006 and amended in the plans dated October 17, 2006 for the project at 401
Bridge Street with the following conditions:
1. The applicant will submit final construction plans and material samples for review
and approval by the DRB prior to obtaining a building permit.
2. The metal entry points should be modified to show a break in the vertical plane at
the roofline by at least one-foot.
3. The electrical poles should be removed and the lines should be buried. The
streetlights should be removed or replaced with a more aesthetically pleasing light.
4. The masonry chosen for the details on the building should relate to the masonry on
the church.
5. The relocated dumpster must be screened.
6. The corners of the site should be modified to include some additional site features
such as low-level plantings, signage or lighting.

The following is the narrative you requested relative to the resubmission to the Design Review Board for 401
Bridge Street.
The comments from the Board from the last meeting on 4 October 2006
•Landscaping—specify vertical growing Bradford Pear because of the limited space the trees have to grow.
Also suggested we change the Hemlock to Oriental Spruce.
•Rhythm of the windows could be more creative.
•Building is uninspired......It should be better.....I was hoping for more.
•Should have`oversized"windows on the second floor.
•New fence at the church parking lot
•Look into moving the power lines along Bridge Street underground.
The original idea of a 3 story predominantly brick building with horizontal masonry accents remains intact.
What has changed is the addition of another material(metal panels),which allow for the opportunity to create a
more orderly colonnade and entrance sequence on both the North and South elevations and a resealing of the
East and West elevations. Recessing the plane of the second floor windows and expressing the canopy for the
length of the colonnade clarified the concept of the covered pedestrian walkway.Metal panels run above and
below the colonnade canopy and behind the columns then extend horizontally and vertically from under the
colonnade to create the entrances on the long elevations. Large-scale windows in the metal panels create a
counterpoint to the smaller masonry openings. Adding"bays"of a contrasting material to the end elevations
modulates the overall scale of the building in addition to the window pattern.
The landscaping changes have been made.
A new wooden fence is planned for the boundary of the church parking lot.
The electrical engineer has contacted the power company and we are investigating the possibility of burying the
power lines along Bridge Street.

At the Design Review Board meeting held on September 27, 2006, the Board unanimously
voted to recommend approval of the project at 75 North Street as modified by the applicant
in plans submitted to the DRB on September 15, 2006 and with conditions listed below.
PROPOSAL
The applicant appeared before the Design Review Board on August 22, 2006 to discuss the
plans for an addition and renovation project at 75 North Street. The original submittal is on
file in the Department of Planning and Community Development dated August 11, 2006.
The DRB asked the applicant to provide the Board with the following modifications and
samples prior to their meeting on September 27, 2006:
• Additional shutters on the first floor windows at the front (east) elevation;
• Modification of the windows from vinyl to a wood replacement window
such as an Anderson 200 series window;
• Removal of the awning at the Kitchen and Bath store;
• "Creations" signage lettering changed to all caps;
• Sample of the roof shingle; and
• HVAC plans shown on the drawings that show that the equipment will be
concealed from the street.
The applicant made the changes and presented those to the DRB on September 27, 2006.
The modified plans are on file in the Department of Planning and Community Development
dated September 15, 2006. In the presentation to the board, the applicant stated that while
they revised the drawings to show the Kitchen and Bath store without the awning, they
would like to keep it up and felt that seeing as it is an existing feature, it should be allowed to
remain.

RECOMMENDATION
At their meeting on September 27,2006, the DRB recommended approval of the plans
dated September 15, 2006 for the project at 75 North Street with the following conditions:
1. The first and second floor windows on the South Elevation have shutters that match
the Front Elevation.
2. The windows in the roof peak of the South and North Elevations contain pediments
and headers similar to the lower windows on the South Elevation.
3. The entry under the"Creations" sign should be recessed by 1-1/2 feet.
4. The gable ends on the dormers should stick out, slightly, and the trim should
measure 5 '/4x 8. The gable ends of the building should stick out by 8 inches or
more
5. The DRB prefers that the awning at the Kitchen and Bath store be removed but
understands that the owner is not under an obligation to do so.
