Rossi, Jr. for a Special Permit under Section P, Wetlands and Flood Hazard Districts of the Salem Zoning Ordinance, with respect to a proposed 1 ,500 square foot addition within a Flood Hazard Zone at 73 North Street. At a regularly scheduled meeting of the Planning Board on September 8, 1988, the Board voted by a vote of eight in favor, none opposed to approve the application as complying with the requirements for the issuance of the permit with the following conditions: 1 . Conformance with Plan Work shall conform to plan entitled, "Plot Plan of land located in Salem, prepared for G. M. Realty Trust", dated June 30, 1988. 1 2. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 7:00 a.m. on weekdays and 8:00 a.m. on Saturdays. No work shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or holidays. b. Rossi G&M Realty Trust 73 North Street Salem, MA 01970 RE: Wetlands and Flood Hazard District Special Permit- 73 North Street On Thursday, February 6, 2003, the Planning Board of the City of Salem opened a Public Hearing regarding the application of Gabriel Rossi, Trustee of G&M Realty Trust, under the Wetlands and Flood Hazard District Special Permit for a 720 square foot addition at 73 North Street. The addition will be used for storage purposes. The Public Hearing opened on February 6, 2003, and closed on February 6, 2003. At a regularly scheduled meeting of the Planning Board held on February 6, 2003 the Board voted by a vote of 6 (Power, Puleo, Lombardim, Sullivan, Durand, Weiner) in favor, 0 opposed, and 3 absent (Moustakis, Collins, and Cullen) to approve the application as complying with the requirements of the Wetlands and Flood Hazard District, subject to the following conditions: 1. Conformance with the Plan Work shall conform with the plan originally entitled, "Permit Site Plan", prepared by Hancock Engineering Associates, dated August 9, 2002 and revised in accordance with the decisions and requirements of all other applicable Boards and Commissions in the City of Salem. Revised plans reflecting these changes must be submitted and approved by the City Planner prior to the issuance of a building permit. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed substantial by the City Planner, shall be brought to the Planning Board for review and approval. Any waiver of conditions contained within shall require the approval of the Planning Board. Lighting No light shall cast a glare onto adjacent parcels or adjacent rights of way. 5. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. f All construction vehicles left overnight at the site, must be located completely on the site. 6. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 7. Other Approvals The applicant shall receive all other necessary approvals from other Boards and Commissions, particularly any licenses required in the City of Salem. 8. Fire Department I�0 All work shall comply with the requirements of the Salem Fire Department. A 10. Conservation Commission All work shall comply with the Order of Conditions issued by the Salem Conservation Commission. 11. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 12. Utilities a. Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. b. The applicant shall provide the City Engineer with the existing and proposed location and size of all utilities (water, sewer, gas, main, etc.)to be utilized for the site, if applicable. In addition, the applicant shall provide the City Engineer with a plan showing any connections to be made to city lines. 13. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Trees shall be a minimum of 3 %" caliper. c. Maintenance of landscape vegetation shall be the responsibility of the developer,his successors or assigns. d. After such landscaping is completed, the developer will add further landscaping if such is requested by the Planning Board or the City Planner. 14. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off- site. c. Maintenance of all landscaping shall be the responsibility of the applicant,his successors, or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two- (2) year period. 14. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. 73 North Street February 6,2003 15. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. If a DEP tracking number is issued for this site under the Massachusetts Contingency Plan, no structure shall be constructed until the Licensed Site Professional responsible for the site certifies that soil and ground water on the entire site meets the DEP standards for the proposed use. 2. The developer shall employ a licensed pesticide applicator to exterminate the area prior to construction, demolition, and/or blasting and shall send a copy of the exterminator's invoice to the Health Agent 3. The developer shall maintain the area free from rodents throughout construction. 4. The resultant establishment(s) shall dispose of all waste materials resulting from its operations in an environmentally sound manner as described to the Board of Health. McClure FROM: Valerie Gingrich SUBJECT: O'ROURKE-73 NORTH STREET DATE: JANUARY 8, 2004 1 have reviewed the Planning Board file for a Wetlands & Flood Hazard Special Permit for O'Rourke Brothers at 73 North Street. The plan reviewed and approved by the Planning Board is a plot plan,which shows only the footprint of the addition. There are no elevations of the proposed addition in the file. The decision does not mention the elevations. The site plan requirements for a WFHSP state that"elevations should be noted", along with location, contours, boundaries,utilities, etc. (See attached for complete list of requirements). I also reviewed the ZBA file,which also does not contain elevations. Tom said that it's strange that the elevations are not in the file and he said he would call George Atkins (O'Rourke's Attorney) to try to get some information. The building permit has dimensions of 24'x30'x22' for the addition. The structure is supposed to be 22' high. However, the plan submitted to the building department show the height as a slant from 22' to 24' (as shown below). It appears that the Planning Board approved the project without reviewing elevations, and it is possible that the ZBA did the same thing. 24' 22' 30' 24' WFHSP REQUIREMENTS 1. Location of existing and proposed structures, watercourses, drainage and drainage easements, means of access, utilities, and sewer disposal facilities including leaching fields, if any.
