The work proposed is limitedtoreplacement of existing pole-mounted switching mechanisms connecting the M191 circuit(running north south along the North River)and the C155S circuit(running generally NW to SE across the North River). iThe proposed work will occur within or above filled or flowed tidelands.However,the majority of the proposed upgrades represent very minor changes in the use of these tidelands, i likely falls within the maintenance and repair provisions of the Chapter 91 regulations at 310 CMR 9.22(1). These include: ➢ Replacement of the deteriorated tower-mounted M191 55-91 airbrake switch on M191 Structure No.2 located between the Route 107 bridge abutment and the railroad. i ➢ Replacement of the existing M191 Structure No. 1 with a new"H-Frame"dead-end structure with tiebacks and new concrete caisson foundations,to be located approximately 25 feet to the northwest of the existing Structure No. 1. This task includes removal of obsolete foundation elements within the existing fill. These project elements are located entirely within the footprint of existing authorized fill and represent a di minimis alteration to the existing licensed infrastructure. However,the relocation of M191 Structure 2 will shift the overhead conductors iapproximately 12 to 15 feet to the west,extending over the flowed tidelands of the North iA-1 Project Narrative 1 ® Yauasse_Sangen8rustlin..lnc i i River. The proposed location of these conductors is immediately adjacent to the existing M191 conductors but extend beyond the footprint of the existing structures. This License Application seeks the Department's approval for the relocation of the dead-end "Fl-Frame"M191 Structure No.2 and the relocation of the associated conductors over flowed i tidelands of the North River. While the proposed overhead conductors will be marginally lower than the existing wires(54 feet instead of 59.5 feet),this will not result in a substantive reduction in the space available for navigation within the North River because the proposed , overhead conductors will still be too high to interfere with the small craft able to navigate in this nearshore area,as explained in more detail below. Site Description ' The Project Site consists of approximately 1,000 SF of filled tidelands and adjacent flowed tidelands within and adjacent to the North River in Salem,Massachusetts. The site location is depicted on Figure 1 and Figure 2. , The Project Site is dominated by existing overhead electric utility infrastructure associated with the M191 and Cl 55S circuits located within a utility easement. The ground surface at ' the project site is otherwise undeveloped and consists of an unpaved access drive and low-cut vegetation/minimally maintained grasses. The shoreline is dominated by rocky fill material with mud flats beyond. The land between M191 Structure 1 and M191 Structure 2 includes a railroad right-of-way owned and operated by the MBTA,rock slopes comprising the railroad ballast and adjacent , mud flats of the North River. Public access to the shoreline is not restricted in any way in those portions of the project site seaward of the railroad right-of-way. There is a well-worn path providing informal access around the adjacent C155S Structure 12. Access to filled ' tidelands within the railroad right-of-way are strictly prohibited to protect public safety. Licensing and Cartographic History , The Project Site is located at the edge of the historic shoreline of the North River. The ' MassDEP presumed historic shoreline is based on the U.S.Coast and Geodetic Survey Register No.3765,published in 1919. An excerpt of this map identifying the existing and historic high water marks is provided in Figure 3. The fill and structures appear to have been placed under the authority of the several licenses ' issued by the Massachusetts Department of Public Works and issued to predecessor electric utility companies and, in part within fill placed during the construction of the Boston and Maine Railroad prior to 1855. Table I provides a list of licenses for the project site obtained from NEP's records and supplemented and confirmed in consultation with MassDEP Waterways staff. Work Description The Project includes the following construction activities within filled tidelands: ➢ Demolition and removal of obsolete underground foundation elements with filled tidelands; ➢ Replacement of the deteriorated tower-mounted M191 55-91 airbrake switch on M191 Structure No.2 located between the Route 107 bridge abutment and the railroad tracks; ➢ Replacement of the existing M191 Structure No. 1 with a new"H-Frame"dead- end structure with tiebacks and new concrete caisson foundations,to be located approximately 25 feet to the northwest of the existing Structure No. 1. ➢ Installation of new conductors connecting M191 Structure 2 with the replacement dead-end H-Frame M191 Structure 1. ' ➢ Electrification of the replacement electric infrastructure; ➢ Demolition and removal of the existing,then obsolete M191 Structure No. 1. The existing concrete footings within filled tidelands are anticipated to abandoned in-place. All construction activities are expected to be completed from terra firma. No in-water,or �- barge-mounted work is anticipated or proposed. Construction activities are expected to occur in the following phases: 1. Site Preparation including removal of existing obsolete foundations not presently supporting the existing infrastructure; ' 2. Construction of new caisson foundations for the replacement dead-end H-Frame M191 Structure No. 1; 3. Installation of new conductors in close coordination with the MBTA to ' accommodate work within the railroad right-of-way; - 6. Activation and testing of the replacement infrastructure; 7. ' Tidelands Impacts ' The proposed project will result in the following changes to the tidelands: ➢ Relocation of the dead-end H-Frame M191 Structure 1 within the footprint of existing licensed filled tidelands resulting in a di minimis change in the use of the existing fill; ' Relocation of three vertically stacked overhead conductors connecting the existing - M191 Structure No.2 with the new M191 Structure No. 1. This actionwill shift the three overhead conductors approximately 12 to 25 feet to the northwest of their ' current location,extending further over flowed tidelands of the North River. This minor relocation of the existing overhead transmission lines will have no measurable effect on the use the flowed tidelands of the North River. Under existing conditions,the lowest conductor is located a minimum of 59.5 feet above mean high water. Under proposed conditions,this clearance will be reduced to a minimum of 54 feet above mean high water. , This five and one-half(5.5)foot reduction in the clearance between the North River and the overhead conductors is not expected to have a measurable effect on the use of filled or flowed tidelands at the site because: 1. The footprint of the new structure over flowed tidelands will be relatively small,only 25 feet at its widest; 2. The flowed tidelands within the footprint of the proposed conductors are relatively shallow and consist of exposed mud flats at low tide and further confined on two sides by rocky fill slopes. These site characteristics severely limit the size of vessel that could navigate within this small area. No masted vessel tall enough to come into close proximity to the lowest conductor ' could safely navigate in these close confines or in such shallow water. Small craft,powered by motor,sail or personal efforts,will not be effected by the overhead transmission lines located a minimum of 54 feet overhead at high tide. The replacement of the M191 airbrake switch on Structure 2 will have no long or short-term effect on the public's use of the shoreline.No new fences or other means of restricting public access along the shoreline is proposed and no long-term substantive impacts to tidelands are anticipated. 1 A-4 Project Narrative ® Vanassu Hangew-ftus lin-Mc. Water-Dependency This application seeks a new Waterways License for the relocation of M191 Structure No. 1 and the relocation of the three vertically stacked conductors connecting existing Structure 2 with the proposed replacement Structure 2 to a position approximately 12 to 25 feet west (seaward)of the existing location. ' This work is proposed as an ancillary facility to two exiting Water-Dependent Infrastructure Crossings-the M191 and the C155S transmission lines. These existing licensed projects ' consist entirely of infrastructure facilities which convey electricity across the North River an the Danvers River connecting existing utility infrastructure on opposite banks of these rivers, meeting the definition of Infrastructure Crossing Facility at 310 CMR 9.02. This regulation further defines such ancillary facilities as including: '...any structure which is operationally related to such crossing facility and ' requires an adjacent location." The proposed improvements are integral to the interconnection of the two transmission lines and could not be located away from these facilities. Regulatory Compliance The Waterways Regulations at 310 CMR 9.31 divides the License Requirements into two ' categories:(1)Basic Requirements and(2)Proper Public Purpose Requirements.The following summarizes the project's compliance with these standards. > Basic Requirements The Project has been reviewed relative to the basic requirements contained in 310 CMR 9.31(1). The applicability of these standards has been determined. Compliance with all applicable standards is described below. ' > Proper Public Purpose Requirements—The waterways regulations at 310 CMR 9.3](2)require the Department to determine that all projects requiring a license ' meet a proper public purpose which provides greater benefit than detriment to the rights of the public in said land. The only permit or approval required is a Chapter 91 Waterways License. Massachusetts Wetlands.Protection Act ' The Project includes work within the state-regulated resource Land Subject to Coastal Storm Flowage and the 100-foot buffer zone to Coastal Bank and is therefore within a geographic ' area subject to the Massachusetts Wetlands Protection Act. ' ■ 310 CMR 9.35 Standards to Preserve Water-Related Public Rights ' This regulation requires projects to: `...preserve any rights held by the Commonwealth in trustfor the public to use ' tidelands, Great Ponds and other waterways for lawful purposes;and shall preserve any public rights of access that are associated with such use." The regulations at 310 CMR 9.35(2)through(6)establish specific standards for the preservation of water-related public rights in tidelands.The following provides a summary of these standards and describes how the project complies with each. ' 310 CMR 9.35(2) Public Rights Applicable to All Waterways This standard prohibits projects from significantly interfering with: , ➢ the public rights of navigation which exist in all waterways; ' ➢ free passage over and through the water;and ➢ access to town landings. The Project complies with each of these requirements by limiting modifications to the Project Site to the replacement of the dead-end H-Frame Structure No. 1 and the minor relocation of the overhead conductors approximately 12 to 25 feet seaward of the existing conditions. The ' proposed replacement conductors will be 54 feet above mean high water and will not have a measurable effect on the public's rights of navigation or affect the free passage over and through the water. ' There are no town landings within the project area. 310 CMR 9.35(3) Public Rights Applicable to Tidelands and Great Ponds , This regulation provides the following two standards for public access to tidelands and Great Ponds: "(a)Fishing and Fowling-The project shall not significantly interfere with public rights offtshing and following which exist in tidelands and Great Ponds... ' The Project will not have a measurable effect on the public's ability to fish or fowl in the waterway or in areas adjacent to the site because the relocated conductors will be a minimum of 54 feet above mean high water and only five feet below the elevation of the existing ' conductors. The Project will not restrict or interfere with public rights to walk or otherwise pass freely on private tidelands.The Project Site does not contain any Commonwealth Tidelands. 310 CMR 9.35(5) Management of Areas Accessible to the Public ' This regulation requires that any project that includes tidelands or Great Ponds accessible to the public shall provide for long-term management of such areas which achieves effective public use and enjoyment while minimizing conflict with other legitimate uses. While the Project Site is generally open to the public,the site lacks adequate space and means of accessibility to expand public access beyond the current ad-hoc nature of the informal footpath that exists around Cl 55S Structure 12. - As stipulated by 310 CMR 9.35(5)(c),no gates,fences or structures will be placed in a way which would impede public access to the shoreline facilities,except as may be required to ' manage visitors in safe and orderly manner and to restrict unauthorized motorized vehicles. ■ ' 310 CMR 9.36 Standards to Protect Water-Dependent Uses The regulations at 310 CMR 9.36 establish the following four standards applicable to all ' proposed projects subject to Chapter 91.These standards are intended to preserve the littoral property owners' rights from adjacent development which would diminish the capacity of sites to support nearby existing,planned or recent water dependent uses. Private Access to Littoral or Riparian Property A-11 Project Narrative ® Vanasse Hangen.Brustlh"nc. ' The regulation at 310 CMR 9.36(2)prohibits projects from significantly interfering with littoral or riparian property owners' right to approach their property from a waterway and to , approach the waterway from said property. The Project is limited to the replacement of an existing dead-end H-Frame Structure and ' relocation of the existing conductors.No new fencing or barriers are proposed. The minimal reduction in clearance from 59.5 to 54 feet will not have a measurable effect on the ability of any adjacent private landowner to approach their property from the water or to approach the t water from their property. The project complies with this standard. Existing Water Dependent Uses The regulation at 310 CMR 9.36(3)prohibits the disruption of"any existing water dependent use project in operation, as of the date of license application, at an off-site location within the proximate vicinity of the site." The Project will not displace any existing water dependent use at or adjacent to the site and ' complies with this standard. Recent Water Dependent Uses The regulation at 310 CMR 9.36(4)prohibits"the displacement of water dependent use that ' has occurred at the site within five(5)years prior to the date of application except upon a clear showing that: a) the activity did not take place on a reasonably continuous basis,for a substantial period of ' time,or b) the activity has been or will be discontinued at the site by the user,for reasons unrelated ' to the proposed project or as a result of voluntary arrangements with the applicant. - - The project supports the existing C155S transmission line that crosses the site. No other , water dependent uses have been located on the site since this infrastructure was built in 1954. Designated Port Areas The regulation at 310 CMR 9.36(5)prohibits the placement of fill or structures which , preempt water-dependent-industrial use within a Designated Port Area(DPA). This standard is not applicable to the project because it is not located within a Designated Port Area as defined by the Massachusetts Coastal Zone Management Plan. The work inside the substation facility involves the replacement of a battery cabinet within the fenced substation yard. 1 This work will not result in any upgrades or substantial enlargements to this existing facility. In addition, it will be necessary to remove deteriorated equipment on an existing transmission structure(Structure #2) and replace another existing transmission structure (Structure #1). The two electric transmission structures which require maintenance are associated with the existing M191 Line and are located just outside the 1 existing substation and adjacent to the North River and the MBTA corridor. All work will be within previously disturbed and currently maintained portions of National Grid's facilities. 1 NEP is planning to perform this work in accordance with the provision of the Massachusetts Wetlands Protection Act(MGL 131-40)and local bylaw which allows for the maintenance of an existing and lawfully located facility used in the service of the public to provide electric services without filing a Notice of Intent. 1 Appropriate Best Management Practices such as erosion control barriers will be implemented, as necessary, to ensure there are no short or long term adverse effects to wetland resources as a result of this necessary maintenance.
