George Atkins D nm Ronan, Segal, and Harrington �3 59 Federal Street m N D Salem, MA 01970 _J RE: 435 Lafayette Street, Wetlands and Flood Hazard District Special Permit On Thursday, October 7, 1999, the Planning Board of the City of Salem opened a public hearing regarding the application of Kenneth Gelpy for a Wetlands Special Permit under Section P, Wetlands and Flood Hazard Districts of the Salem Zoning Ordinance, with respect to a proposal to construct a single-family dwelling, utilities, and landscaping in a buffer zone to a salt marsh and over land subject to coastal storm flowage. The dwelling is proposed to be constructed on piles. The proposal is located at 435 Lafayette Street, which is within the Flood Hazard District. At a regularly scheduled meeting of the Planning Board held on October 21, 1999, the Board voted by a vote of eight (8) in favor and none opposed,to approve the application as complying with the requirements for the issuance of the permit with the following conditions: 1. Conformance with Plan Work shall conform to the plan entitled, "Permit Site Plan in Salem, MA", prepared by Hancock Survey Associates, Inc. and last revised on April 28, 1999. In addition, work shall conform with the plan entitled, "New House, Mr. and Mrs. Kenneth Gelpy", prepared by Richard W. Griffen and dated October 20, 1999. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed necessary by the City Planner, shall be brought to the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Conservation Commission Work shall comply with all requirements of the Superceding Order of Conditions (DEP File 464-288) issued by the Department of Environmental Protection on July 23, 1999. 435 Lafayette Street October 26, 1999-2 4. Board of Health All Board of Health requirements as specified in the attached decision dated October 22, 1999, shall be strictly adhered to. 5. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 6. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules,regulations and ordinances of the City of Salem. 7. Sidewalks and Curbing a. Six inch vertical granite curbing shall be installed along the entire frontage of the parcel. Plans for the curbing installation shall be submitted to the City Planner for his review and approval prior to the issuance of a building permit. b. The sidewalk located adjacent to the lot shall be replaced for the entire frontage of the lot. The sidewalk shall be constructed of concrete and of a minimum width of four feet. Design plans for the sidewalk shall be submitted to the City Planner for his review and approval prior to the issuance of a building permit. 8. Driveway a. A french drain shall be constructed by the developer at the end of the driveway, adjacent to the sidewalk. Design plans for the french drain shall be submitted to the City Planner for his review and approval prior to the issuance of a building permit. b. A tum around area shall be constructed in the driveway. 9. Drainage The drain pipe located in close vicinity to the catch basin shall be replaced with a 12 inch pipe by the developer, his successors or assigns. Replacement of the drain pipe shall be completed prior to the issuance of a certificate of occupancy. 10. Stone Wall The stone wall located adjacent to the parcel shall be maintained by the owner, his successor, or assigns. The maintenance shall be for the portion of the wall abutting the entire frontage A_vc 435 Lafayette Street October 26, 1999-3 of the parcel. The City of Salem shall retain ownership of the wall. 11. Pre-Construction a. A pre-construction survey shall be completed by the applicant. The survey shall include the abutting parcels. b. A photographic record of the entire stone wall shall be completed by the applicant. A copy of the record shall be submitted to the City Planner prior to the applicant obtaining a building permit. 12. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 13. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I hereby certify that a copy of this decision and plans has been filed with the City Clerk and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
