In the spring of 1985, I presented to my abuttors an architect's sketch of a proposed plan. This was not acceptable to them and at this time I was told by Mr. Moran that he would not object to any proposal which adhered to the regulations and that would not require any variances. In 1986, an offer to purchase was made and the prospective buyers met with the City Planner and Mr. Moran - that plan was not acceptable. My first survey of the present subdivision shows the access to the two other proposed single family lots as a right of way over my existing driveway. A similar situation does exist on both sides of my property. The number 414¢ is situated behind number 414 and number 418 is situated behind number 420. Neither Mr. Moran nor Mr. Picotta would accept this plan because it would require a waiver. The plan now before the Planning Board will not require a any waivers, but will require a new road and sidewalk at the other side of my property since those abuttors oppose the use of my driveway. I have, since 1979, legally (as the enclosed current certificates show) operated a kindergarten and nursery school in part of my home. Not only has the school not interfered with my neighbors but many are unaware that it exists. I have never had as my intent in the past, do not now have, nor will in the future, the destruction of the integrity of my home or the neighborhood. You will believe what you will, but there does not exist a sinisterplot to undermine the quality of the area. I have in excess of 57,000 square feet of land and simply want to divide that footage into three single family homes, including my own. Aside from being obligated to build another entrance to the back lots, the appearance from there will not chAnge and the use will not change. July 2 , 1987 Mr. Walter Powers Chairman Planning Board C/o Planning Department 1 Salem Green Salem, MA 01970 Dear Mr. Powers, When I purchased my property at 418 Lafayette Street, which abutts the petitioner' s property at 416 Lafayette Street, I did so only after extensive research. I was leaving a congested area on the Salem Common for the sole purpose of finding a secluded living space offering peace and quiet within a protected naturalized area. I sought this not only for the enjoyment of our children but also for the health and well being of my husband who has various medically documented breathing and environmentally related problems which are highly exacerbated in congested living areas. When I located the property at 418 Lafayette Street, extensive research documented that the probability of future encroachment on the area was almost impossible. The neighborhood and the city itself had recently held on an appeal that even to convert the three family home at 418 Lafayette Street into condos would significantly alter the character of the neighborhood, even though the proposal was to leave the open land area intact. The opposition was spearheaded by none other than Jane Lyness herself. I carefully investigated the probability of future development on all abutting properties. The only immediately available open land areas were those properties at #416 and #418 . The realtor assured me that no prospective development would be allowed to occur at the neighboring #416 residence because of the success the owner of that property had had in preventing any alterations to the character of the neighborhood and given that no access road would be legal to allow dense development at the rear of that property. This was confirmed for me by both the city planner and the building inspector of the City of Salem prior to my purchase of my home at 418 Lafayette Street in 1982. I also researched the historical aspects of the neighborhood and learned that the house at #416 was documented by the Essex institute to be the oldest house in South Salem, originally dating from 1762 . I felt this was even greater assurance of status quo protection. Surely, I felt, the planning department of one of America' s most Page 1 of 2 Page 2 of 2 architectually significant communities would not allow the dese- cration or alteration of one of its most historic and outstanding properties. Furthermore, the city had already set a precedent by disallowing "character" changes to the newer 1905 property directly abutting it. On that basis, I went ahead with my purchase. I have now learned that the previous assurances and precedents may not be honored. After half a decade of extensive repairs and renovations to almost every square inch of my secluded home, I am learning of a proposed assault which will mean the creation of a totally different health and living environment for my family. If approved, we will simply have to move. Who, I wonder, is willing to reimburse the substantial loss I will incurr on the value of my property due to such a destructive action? Not since 1940,when the Institute published Fiske Kimball's Mr. Samuel McIntire, Carver. . . has a major illustrated volume on the architectural history of Salem appeared. No comprehensive architectural guidebook for the city has ever before been published, although interest in doing so has been expressed for many years. This volume has been compiled for a general audience and is intend- ', ed as a field guide rather than a general history; hence, it exclusively focuses on the surviving architecture of Salem. Powers, When I purchased my property at 418 Lafayette Street, which abutts the petitioner ' s property at 416 Lafayette Street , I did so only after extensive research. I was leaving a congested area on the Salem Common for the sole purpose of finding a secluded living space offering peace and quiet within a protected naturalized area. I sought this not only for the enjoyment of our children but also for the health and well being of my husband who has various medically documented breathing and environmentally related problems which are highly exacerbated in congested living areas. When I located the property at 418 Lafayette Street, extensive research documented that the probability of future encroachment on the area was almost impossible. The neighborhood and the city itself had recently held on an appeal that even to convert the three family home at 418 Lafayette Street into condos would significantly alter the character of the neighborhood, even though the proposal was to leave the open land area intact. The opposition was spearheaded by none other than Jane Lyness herself. I carefully investigated the probability of future development on all abutting properties. The only immediately available open land areas were those properties at #416 and #418 . The realtor assured me that no prospective development would be allowed to occur at the neighboring #416 residence because of the success the owner of that property had had in preventing any alterations to the character of the neighborhood and given that no access road would be legal to allow dense development at the rear of that property. This was confirmed for me by both the city planner and the building inspector of the City of Salem prior to my purchase of my home -at 418 Lafayette Street in 1982. I also researched the historical aspects of the neighborhood and learned that the house at #416 was documented by the Essex institute to be the oldest house in South Salem, originally dating from 1762 . I felt this was even greater assurance of status quo protection. Surely, I felt, the planning department of one of America' s most Page 1 of 2 i Page 2 of 2 architectually signiEicant communities would not allow the dese- cration or alteration of one of its most historic and outstanding properties. Furthermore, the city had already set a precedent by disallowing " character" changes to the newer 1905 property directly abutting it . On that basis, I went ahead with my purchase. I have now learned that the previous assurances and precedents may not be honored. After half a decade of extensive repairs and renovations to almost every square inch of my secluded home, I am learning of a proposed assault which will mean the creation of a totally different health and living environment for my family. If approved, we will simply have to move. Who, I wonder, is willing to reimburse the substantial loss I will incurr on the value of my property due to such a destructive action?
