Decision For The Petition of Nextel Communications of the Mid-
Atlantic, Inc. For The Property Located At 117 Lafayette Street
A Public Hearing on this petition was held on July 6, 2000. The following Planning Board members
were present: Walter B.Power,III,Chairman; Chuck Puleo; Gene Collins;Lee Harrington; Bill Cullen,
and John Moustakis. Notice of this meeting was sent to abutters and notice of the hearing was properly
published in the Salem Evening News.
The petitioner is requesting a Wireless Communication Facility Special Permit under Section 5-3,
Special Permit Uses, of the City of Salem Zoning Ordinance,to allow the installation of twelve antennas
on the roof of the building located at 117 Lafayette Street, Salem, MA. An equipment room will be
located in the basement and the antennas and cables will be painted to match the structure.
The Planning Board reviewed the application and plans submitted and found that the petitioner addressed
the requirements of this section for the issuance of a Special Permit.
On July 6, 2000,the Board closed the Public Hearing and then the Planning Board voted by a vote of six
(6) in favor,none opposed,to grant the Wireless Communication Facility Special Permit for the location
stated above, in accordance with the applications(dated June 2,2000)and site plan last dated June 27,
2000,titled"Nextel, Salem Neck, 117 Lafayette Street, Salem,MA 01970"and drawn by TeleCom
City, submitted and now part of the file. The Special Permit was approved with the condition that the
applicant paint the antennas to match the color of the building and the existing roof structures. In
addition,the applicant shall maintain the paint on the antennas.
This endorsement shall not take effect until a copy of the decision bearing certification of the City Clerk
that twenty(20)days have elapsed and no appeal has been filed or that if such appeal has been filed that
it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed in the
grantor index under the name of the owner of record or is recorded and noted on the owner's certificate
of title. The fee for recording or registering shall be paid by the owner or applicant.
I hereby certify that a copy of this decision is on file with the City Clerk and that a copy of the decision
and plans is on file with the Planning Board.

RE: Lincoln Hotel , 117 Lafayette Street
On Thursday, May 7, 1987 , the Planning Board ,of the City of Salem held a
Public Hearing under Section VII — R, Site Plan Review, of the Salem
Zoning Ordinance on the application of Frederick Small with respect to
the rehabilitation and expansion of the Lincoln Hotel at 117 Lafayette
Street.
At a regularly scheduled meeting of the Planning Board held August 31 ,
1987 , the Board voted, by a vote of three in favor, two opposed, to
approve the application as complying with the requirements for issuance
of a Special Permit , subject to the following conditions:
1 . Conformance With Plan
Work shall conform to plan entitled, "Site Plan, Lincoln Hotel",
dated April 29, 1987 .
2 . Landscaping
Landscaping of the site shall conform to plan entitled, "Site Plan
of Land, Lincoln Hotel" , dated April 29, 1987 :
A. Maintenance of the landscape vegetation in a healthy and
thriving condition shall be the responsibility of the developer,
his successors or assigns.
B. Trees shall be a mininum of 3," caliper.
3. Utilities
Utilitv installation shall be reviewed and approved by the
Engineering Department.

4. Construction Practices
All construction shall be conducted in accordance with the following
conditions:
A. No work shall commence before 7:00 a.m. on weekdays and 8:00
a .m. on Saturdays . No work shall continue beyond 5:00 p.m.
There shall be no work conducted on Sundays or holidays. Inside
work of a quiet nature may be permitted at other times .
B. All reasonable action shall be taken to minimize the negative
effects of construction on abutters. Advance notice shall be
provided to all abutters in writing at lease 72 hours prior to
commencement of construction.
5. Violation
Any violation of these conditions shall result in revocation of this
permit by the Planning Board.
I hereby certify that a copy of this decision and plans have been filed
with the City Clerk and copies are on file with the Planning Board.
This Special Permit shall not take effect until a copy of this decision
bearing the certification of the City Clerk that twenty (20) days have
elapsed and no appeal has been filed, and it has been dismissed or
denied, is recorded in the Essex County Registry of Deeds and is indexed
in the grantor index under the name of the owner of record or is
recorded on the owner's Certificate of Title. The fee for recording or
registering shall be paid by the owner or applicant .
