NR ❑ Proper Public Purpose: For nonwater-dependent projects, a statement must be included that explains how the project serves a proper public purpose that provides greater benefit than detriment to public rights in tidelands or great ponds and the manner in which the project meets the applicable standards. If the project is a nonwater-dependent project located in the coastal zone, the statement should explain how the project complies with the standard governing consistency of the policies of the Massachusetts Coastal Zone Management Program, according to 310 CMR 9.54. If the project is located in an area covered by a Municipal Harbor Plan,the statement should describe how the project conforms to any applicable provisions of such plan pursuant to 310 CMR 9.34(2). 0 Plans: Prepared in accordance with the applicable instructions contained in Appendix A-B of this application. For initial filing, meet the requirements of 310 CMR 9.11(2)(b)(3). Applicant Certification:All applications must be signed by"[he landowner if other than the applicant. In lieu of the landowner's signature,the applicant may provide other evidence of legal authority to submit an application for the project site." If the project is entirely on land owned by the Commonwealth (e.g.most areas below the current low water mark in tidelands and below the historic high water mark of Great Ponds), you may simply state this in lieu of the"landowner's signature". Municipal Zoning Certification: If required, applicants must submit a completed and signed Section E of this application by the municipal clerk or appropriate municipal official or, for the initial filing, an explanation of why the form is not included with the initial application. If the project is a public service project subject to zoning but will not require any municipal approvals, submit a certification to that effect pursuant to 310 CMR 9.34(1). (� Municipal Planning Board Notification: Applicants must submit a copy of this application to the municipal planning board for the municipality where the project is located. Submittal of the complete application to DEP must include Section H signed by the municipal clerk, or appropriate municipal official for the town where the work is to be performed, except in the case of a proposed bridge, dam, or similar structure across a river, cove, or inlet, in which case it must be certified by every municipality into which the tidewater of said river, cove, or inlet extends. Final Order of Conditions: A copy of one of the following three documents is required with the filing of a General Waterways Application: (1) the Final Order of Conditions (with accompanying plan) under the Wetlands Protection Act; (2) a final Determination of Applicability under that Act stating that an Order of Conditions is not required for the project; or (3) the Notice of Intent for the initial filing (if the project does not trigger review under MEPA). NA ❑ Massachusetts Environmental Protection Act(MEPA): MGL 30, subsections 61-61A and 301 CMR 11.00, submit as appropriate: a copy of the Environmental Notification Form (ENF) and a Certificate of the Secretary of Environmental Affairs thereon, or a copy of the final Environmental Impact Report (EIR) and Certificate of the Secretary stating that it adequately and properly complies with MEPA; and any subsequent Notice of Project change and any determination issued thereon in accordance with MEPA. The original construction documents for the ramp are dated 1967 as prepared by the Department of Public Works, Division of Waterways, under Contract No. 34. The City of Salem and the Massachusetts Department of Fish and Game through the Office of Fishing and Boating Access (OFBA) have determined the need for the work. The work of this project does not include the adjacent paved parking and queuing area. The Office of Fishing and Boating Access recognizes that Stormwater Management improvements will require consideration when the paved area requires reconstruction. Demolition of the existing concrete ramp and reconstruction activities will be confined within a cofferdam to be designed by the contractor so that all work will be performed "in the dry". A floating silt curtain will be positioned outboard of the cofferdam and all dewatering pump discharges will be directed between the cofferdam and the curtain. Excavation to the required subgrade limits will be accomplished by mechanical methods. All excess material will be removed from the site and properly disposed of and all work will be in accordance with contract standards prepared by the Office of Fishing and Boating Access. The clear width of the reconstructed concrete ramp surface will be made consistent with a requirement for 30 ft., which is approximately 2 feet wider than the existing at 28 ft. In addition, a row of 6 ft. wide, pile held, floating boarding docks is proposed along the South side of the ramp to facilitate launching and loading of boats in a safe and efficient manner. The existing rip rap armor stone will be expanded due to the widening of the ramp and it will support and protect both sides of the ramp. The length of the reconstructed ramp will increase by approximately 5 ft. and the profile will be increased to 15% (i.e. made steeper) to improve boat launching and loading throughout the tide range. The finished grade at the outboard end of the reconstructed ramp will be El— 4.0 ft. Mean Low Water datum, approximately 3.7 ft below the existing ground at EI —0.3 ft. COASTAL RESOURCE AREAS R:\TS-027-PAB-SALEM\07-EmiroPemits\DEPChpt91\ProiDescResAreaslmpactCH91.doc ] Fay, Spofford & Thorndike, LLC August 2008 Kemwood Street Boat Ramp, Salem Resource areas were determined based on the applicable sections of the Wetlands Protection Act, 310 CMR 10.00. site survey of existing conditions, and proposed work. 310 CMR 10.04 Land Subject to Coastal Storm Flowage By its very nature, the existing ramp is largely within Land Subject to Coastal Storm Flowage. FEMA Flood Maps show that the project site is largely within Flood Zone A2 (10) or El 14.5 based on Mean Low Water datum. We do not anticipate that the reconstructed project will significantly restrict coastal storm flowage or cause a significant increase in flood stage or flow velocity. 310 CMR 10.25 Land Under the Ocean Approximately 23 linear ft of the reconstructed ramp is within Land Under the Ocean (LUO) as measured along the construction baseline, outboard from the Mean Low Water line. The LUO impact area is approximately 1,273 s.£ and includes a portion of the ramp, prop wash pads, and excavation on the North, East and South sides of the ramp. Reconstruction of the water-dependent boat ramp is designed using best available measures to minimize adverse effects on marine fisheries habitat by use of a cofferdam to construct the work "in the dry" and sloped transitions from existing ground to the reconstructed ramp that are gradual and open at the outboard end. Therefore, we do not anticipate that the reconstructed ramp will restrict water circulation or the distribution of sediment. We are not aware of the presence of any eelgrass or widgeon grass beds, or high densities of polychaetes, mollusks or macrophytic algae. 310 CMR 10.27 Coastal Beach Approximately 749 square ft of Coastal Beach (CB) will be impacted by extending the existing rip rap slopes on the North and South sides of the ramp for support and protection. We do not anticipate that the addition of rip rap armor stone will cause a significant increase in erosion or significant decrease in volume or form of the beach or adjacent beaches as they function to prevent storm damage and control flooding because the rip rap armor stone is sloped and transitions are smooth. Therefore, we do not anticipate a concentration of wave energy that would erode the beach. The existing water circulation and water quality characteristics, and distribution of sediment are largely established by the existing ramp and we do not anticipate that the proposed work will cause a significant adverse impact to those interests. 310 CMR 10.30 Coastal Bank R:\TS-027-PAB-SALEM\07-EnviroPennits\DEPChpi9I\ProjDescResAreaslmpactCH9 Ldoc 7 Fay, Spofford & Thorndike, LLC August 2008 Kemwood Street Boat Ramp, Salem The existing boat ramp crosses the Coastal Bank and existing rip rap armor stone covers the bank on each side of the ramp. It is our opinion that the bank is a buffer to storm waters and is not a source of sediment to the adjacent beach. The design for reconstructive maintenance of the ramp will involve approximately 68 ft. of Coastal Bank and will not have an adverse effect on the stability of the bank. 310 CMR 10.32 Salt Marsh The work of the project is within the buffer zone to Salt Marsh. Salt Marsh is found approximately 65 ft North of the centerline of the ramp, and North of the adjacent pier. Salt Marsh is also found approximately 140 ft south of the centerline of the ramp. No work is proposed in the resource area. The proposed cofferdam and floating silt curtain that surrounds the work of the boat ramp, and the silt fence proposed at the top of bank will delineate areas of work and protect the resource.
