Ladies and Gentlemen of the Council :
On September 29 , 1994 , following a Joint Public Hearing with
the City Council , the Salem Planning Board reviewed the request of
Jefferson Realty Trust for a proposed zoning amendment which would
rezone a parcel from a Residential 2 ( R2 ) District to an Industrial
( I ) District located at 4 Jefferson Avenue .
The Planning Board, by a vote of seven ( 7 ) in favor , none ( 0 )
opposed, voted to recommend that the proposed amendment be granted
on the basis that 1 ) this area has historically been an industrial
use since the fire of 1914 and 2 ) this site has never been used as
any use other than industrial .

Dear Mr. President:
Enclosed please find the petition of Jefferson Realty
Trust, owner of the real property situated at 4 Jefferson Avenue,
Salem. The owner of the real estate is also the owner of Thermal
Circuits, Inc. , the business conducted at that particular site.
The owner is petitioning the City Council to commence
proceedings relative to rezoning the parcel shown on the attached
Exhibit A from R-2 to Industrial. The site has been occupied by
a building that has been used as an industrial building for many
years.
I believe through inadvertence in the various zoning
changes that have taken place in the City, this small triangular
area was left Out of the Industrial Zone. This became apparent to
the owner just a short while ago, and, of course, while the present
use is grandfathered in, the zoning should reflect the underlying
use. Both sides of Jefferson Avenue in that vicinity are zoned
Industrial.
The petitioner respectfully requests that the Council
take the necessary steps under the General Laws to proceed with its
Petition for zoning changes. I believe the first step is to refer
the request to the Planning Board.

PETITION TO SALEM CITY COUNCIL
Under Massachusetts General Laws Chapter 40A
To Rezone Land Shown on Attached Exhibit A
Gentlemen:
In accordance with the requirements of Massachusetts
General Laws Chapter 40A, section 5, the Petitioner, John H.
Kellogg, Trustee of Jefferson Realty Trust, owner of the real
property situated at 4 Jefferson Avenue, bounded and described as
shown on the attached Exhibit A, the parcel consisting of some
27, 470 square feet, as shown on the attached Exhibit B, requests
that the City of Salem City Council include the said property in
the adjacent Industrial zone.
The property at 4 Jefferson Avenue is located in an area
bounded by industrial and business uses. For better than fifty
years manufacturing facilities have been located on the property,
and the building has housed a number of manufacturing uses going
back to the turn of the century. It is across the street from the
City garage, a property that is zoned Industrial.
It is the Petitioner's belief that during the zoning
changes and updates that have taken place in the City of Salem, the
specific use of the property was never realized as being
historically Industrial, so that area was zoned R-2 . The owners
of the property had not been aware of the situation until
very when research Indicated that this area,
apparently
through inadvertence, was left out of the Industrial zone. Y
The Petitioner is anxious to relocate its existing
business and is in the process of searching for a new location.
The Petitioner has been working with the Planning Department to
find a building in Salem, since most of its employees come from the
Salem area. In trying to market the building for a proposed sale
to financially assist in the relocation, the problem of being zoned
R-2 surfaced. We would request that the City of Salem take the
necessary steps to extend the Industrial zone on Jefferson Avenue
across from the premises at 4 Jefferson Avenue so as to include the
area shown on Exhibits A and B. The Petition respectfully requests
that this property be rezoned to Industrial.
